Execução provisória da condenação imposta pelo Tribunal do Júri : análise jurisprudencial e acerca da constitucionalidade da medida

O Tribunal do Júri, competente para o julgamento dos crimes dolosos contra a vida, é instituto de suma importância na sociedade brasileira, pois é por meio dele que os cidadãos têm a oportunidade de exercer diretamente uma das funções atinentes ao Poder Judiciário. O procedimento do júri é complexo, dividido em duas fases: na primeira, denominada juddicium accusationis, um juiz togado buscará aferir se estão presentes indícios de autoria, bem como a materialidade do crime; havendo juízo positivo de admissibilidade, passar-se-á à segunda fase, na qual, além de atos preparatórios, há o julgamento popular propriamente dito. Concluído o julgamento, em havendo condenação pelo Conselho de Sentença, surge a controvérsia: a condenação imposta pelos jurados poderá ser executada imediatamente, ou depende de seu trânsito em julgado? Da letra fria da Lei, notadamente do artigo 492, inciso I, alínea “e”, do CPP, temos que a execução imediata é possível. Apesar de posicionamentos jurisdicionais distintos acerca do tema, no mesmo sentido tem sido a interpretação do Supremo Tribunal Federal, que tem entendido pela prevalência da soberania dos veredictos sobre a presunção de inocência, seja nos HCs que julgou sobre a matéria, seja no Recurso Extraordinário pendente, que promete dar fim à discussão, o qual possui o placar parcial de dois votos a um pela constitucionalidade da execução imediata.The Court of the Jury - competent for judging intentional crimes against life - is an institution of utmost importance in Brazilian society because it is through it that citizens have the opportunity to directly enact one of the Judiciary’s functions. The jury proceedings are complex, being divided in two phases: in the first one, juddicium accusationis, a judge seeks to assess if there are evidences of authorship as well as the materiality of the crime; being the case admissible to proceed, it moves on to the second phase in which, besides preparatory actions, the trial itself happens. After the trial is concluded, in case of conviction by the Jury Panel a controversy appears: may the punishment imposed by the jurors be executed immediately or must it await the res judiciata? According to the Criminal Procedure Code’s section 492.I.e, the immediate execution is possible. Although there are divergent jurisprudential understandings, the Brazilian Supreme Court interprets it in the same way: the jury verdicts have sovereignty over the presumption of innocence.This is true both in multiple judged habeas corpus about the subject and in the extraordinary appeal pending trial - whose purpose is to end the discussion and already has a partial voting of two to one for the constitutionality of immediate execution

GESTÃO DE RESÍDUOS SÓLIDOS URBANOS EM GRAMADO (RS): COMO A CULTURA DO PODER PÚBLICO MUNICIPAL INFLUENCIA A CULTURA DA POPULAÇÃO SOBRE A GESTÃO DO LIXO

A gestão de resíduos sólidos urbanos se mostra um problema que afeta tanto o Brasil quanto todo o mundo, no qual os resíduos, que são produzidos em enormes quantidades, acabam se tornando um problema para a administração pública. Vários são os fatores que agravam essa situação, mas ganham destaque os socioculturais. Uma das causas percebidas para tal tem relação com a falta de parceria entre a gestão municipal e a população, em que a administração pública se ausenta das suas funções de orientação e educação ambiental e dessa forma a população não recebe incentivos à mudança de hábitos entranhados em sua prática. Este estudo teve como objetivo principal verificar a influência das ações do poder público municipal da cidade de Gramado (RS), na cultura da população em relação à gestão do seu lixo. Constatou-se que existe uma carência de informações e orientações aos moradores sobre como realizar corretamente os procedimentos de separação e descarte dos resíduos e com isso, em sua maioria, os moradores não adotam hábitos ambientalmente corretos, como a separação de seus resíduos e correta disposição para coleta. Com a pesquisa, foi possível concluir que não existem incentivos por parte da Prefeitura Municipal para prática de uma gestão domiciliar de resíduos de forma adequada nem incentivos à cooperação pela busca de uma melhoria contínua ao meio ambiente em que estão inseridos

Educational TV-Programs for Children Aged between Six and Ten : Development of Quality Criteria in Consideration of Two Perspectives

Gegenstand der vorliegenden Bachelorarbeit ist die Entwicklung von Qualitätskriterien für Wissenssendungen, die sich an Kinder im Grundschulalter richten. Ziel ist es, Kriterien aus zwei unterschiedlichen Sichtweisen, der Anspruchs- und Zielgruppenperspektive, zu erarbeiten. Dazu werden im ersten Teil der Arbeit entwicklungs- und erntheoretische Grundlagen sowie neurowissenschaftliche Erkenntnisse in Bezug auf die Gedächtnisbildung und den Zustand der Aufmerksamkeit vorgestellt. Anhand einer Literaturrecherche werden anschließend Qualitätskriterien aus der Anspruchsperspektive formuliert. Im zweiten Teil der Arbeit steht die Durchführung einer qualitativen Befragung von Grundschulkindern im Mittelpunkt, die auf die Erarbeitung der Kriterien auf Zielgruppenebene abzielt. Nach Auswertung und Zusammenfassung der Ergebnisse werden die Qualitätskriterien aus Anspruchs- und Zielgruppenperspektive zusammengeführt

Schwingungsspektroskopische Untersuchung ausgewählter heterozyklischer Pflanzenschutzmittel: SERS-Spektroskopie an der Grenzfläche fest / flüssig und ab initio Berechnungen

In this work the behaviour of N-heterocyclic pesticides at the solid/liquid interface has been studied by means of Roman and surface enhanced Roman (SERS) spectroscopy. The aim was first to prove the possibilities of SERS as an analytical method for the determination of pesticides and second to present the abilities of quantum mechanical calculations as a toal for the interpretation of vibrational data. Using a combination of thin layer chromatography (TLC) and SERS enabled us to even traces of pesticides (nanogram range) in organic materials. The efficiency of this combination could be enhanced by a new kind of SERS activation. Instead of applying the offen used silver colloids a thin film of silver was evaporated onto the TLC plates delivering three orders of magnitude higher SERS signals. An excessive SERS spectra Interpretation of all pesticides presented in this work had been done showing the Power of quantum mechanical ab initio calculation as a tool in the area of predicting vibrational spectroscopic data. For example, for all in situ prepared redox forms of the model pesticide paraquat (methylviologen) the same vibrational pattern was found while a dependence of line position from binding order could be concluded. Furthermore, a new kind opto-electrochemical flow-through cell was developed, being so small that it fits in every commercial available Raman spectrometer. By means of this cell a on-line determination of water soluble pesticides could be demonstrated. The time necessary for the adsorption of the molecules, the acquisition of the SERS spectrum and finally the desorption of the pesticides lay in the order of seconds
