    Elementos socio jurídicos del modelaje wed cam

    En la actualidad, la actividad de modelaje web cam además de ser discriminada y tachada de “indigna”; no se encuentra regulada por la legislación colombiana y carece de toda estabilidad laboral para quienes la desarrollan, sin embargo, se ha encontrado en el transcurrir de estos últimos años, precedentes judiciales que han permitido debatir esta problemática en cuanto a los derechos laborales que le asisten a este determinado grupo de personas; que como es bien sabido y de conocimiento público, está integrado por mujeres, hombres, parejas, comunidad lgtbiq y en el peor de los casos niños, niñas y adolescentes, sin distinción alguna de raza, ideología política y/o formación académica. En concordancia a lo anterior, se puede inferir que su situación es atípica tanto desde el punto de vista legal como sociológico, pues como bien se mencionó, este grupo de personas se encuentra en una especie de limbo en la cual la actividad que ejercen no es legal pero tampoco es ilegal. Ahora bien, realizando un estudio a fondo de la última jurisprudencia de la Corte Constitucional en sentencia T- 109 de 2021 M.P Alberto Rojas Rios, acerca del tema que para el presente estudio concierne, se observa que, la Corte Constitucional es enfática en su análisis del caso en la protección de los derechos fundamentales de las personas que ejercen actividades de modelaje web cam, tales como derecho al trabajo, al mínimo vital, a la salud y a la seguridad social, cuales son esenciales para todo trabajador en Colombia, ya que con la garantía de estos derechos se respeta íntegramente la dignidad humana de la persona para su calidad de vida y el libre desarrollo de su personalidadUniversidad Libre- Facultad de Derecho- Maestria en Derecho Laboral Y Seguridad SocialAt present, the web cam modeling activity, in addition to being discriminated against and branded as "undignified"; It is not regulated by Colombian legislation and lacks any job stability for those who develop it, however, in recent years, judicial precedents have been found that have allowed us to debate this problem regarding the labor rights that assist it. to this certain group of people; which, as is well known and public knowledge, is made up of women, men, couples, the lgtbiq community and, in the worst case, boys, girls and adolescents, without any distinction of race, political ideology and/or academic background. In accordance with the above, it can be inferred that their situation is atypical both from the legal and sociological point of view, since as it was well mentioned, this group of people is in a kind of limbo in which the activity they carry out is not Legal but not illegal either Now, carrying out an in-depth study of the latest jurisprudence of the Constitutional Court in sentence T-109 of 2021 M.P Alberto Rojas Ríos, on the subject that concerns the present study, it is observed that the Constitutional Court is emphatic in its analysis of the case in the protection of the fundamental rights of people who carry out web cam modeling activities, such as the right to work, the vital minimum, health and social security, which are essential for all workers in Colombia, since with the guarantee of these rights fully respects the human dignity of the person for their quality of life and the free development of their personality. On the other hand, we must take into account that the exercise of web cam modeling has also been erected for some authors as a paradigm of liberation and reaffirmation of the rights of women, who have found in this trade a source of legal income even more in times of pandemic, which has empowered them in a macho society. In the same way, it is interesting to observe the way in which the industry appropriates and creates a model prototype that can be trained through courses and workshops, and that anyone can become the exemplary "camgirl". For this reason, this research calls for an opportunity to understand how the exercise of web cam modeling has been demonized in relation to other professions in which the body is also used as an instrument of production, and as a tip, to demonstrate how in all relationships of subordination, an objectification of the body is implicit

    Teniendo en cuenta el impacto laboral, en el que se encuentra la sociedad colombiana, se ha logrado observar una nueva modalidad de trabajo informal que se adoptó en nuestro paísdesde hace 2 décadas denominada modelaje webcam con más de 40.000 personas vinculadas. Como modelos webcam podemos encontrar mujeres, hombres, parejas, comunidad LGTBIQ y en el peor de los casos niños, niñas y adolescentes, sin distinción alguna de raza, ideología política y/o formación académica que ofrecen un servicio de entretenimiento para adultos a través de plataformas web que abarcan show y conversaciones de contenido sexualmente explícito.Por lo anterior podemos inferir que este tipo de trabajo no formal, ha tomado mucha fuerza en los últimos 5 años, toda vez que, según la estadística consultada, Colombia ocupa el segundo lugar en el mundo con modelaje webcam en un porcentaje del 33% de ocupación después de Rumania. En consecuencia, como primer punto de vista, en cuanto al tema en estudio, las suscritas podemos dar la apreciación de que, si bien es cierto, esta modalidad de trabajo informal no está regulada en nuestro ordenamiento jurídico, ha generado un gran impacto en nuestra sociedad y por lo tanto no cuenta con un piso legal que salvaguarde los derechos laborales y fundamentales de este grupo de personas que realizan la actividad anteriormente mencionada. Dicho grupo de personasse encuentra catalogado como población vulnerable, dadas las condiciones en las que tienen que desarrollar su labor y la continua exposición al ser explotadas, agredidas, marginadas por los dueños de estos establecimientos denominados estudios webcam. Dicho esto, la problemática que vivimos en Colombia frente a este tema de informalidad laboral, ha generado para nosotras la necesidad de indagar, investigar o realizar un trabajo más profundo, donde podamos desarrollar alternativas de acompañamientos a esta población, para que no sean vulnerados sus derechos.Universidad Libre – Facultad de Derecho -- Especialización en Derecho Laboral y Seguridad SocialConsideringthe labor impact, in which Colombian society finds itself, it has been possible to observe a new modality of informal work that has been adopted in our country for 2 decades called webcam modeling with more than 40,000 people linked. As webcam models we can find women, men, couples, the LGTBIQ community and in the worst case, boys, girls and adolescents, without any distinction of race, political ideology and / or academic training that offer an entertainment service for adults through web platforms that include sexually explicit content shows and conversationsFrom the above, we can infer that this type of non-formal work has taken on a lot of strength in the last 5 years, since, according to the statistics consulted, Colombia occupies the second place in the world with webcam modeling in a percentage of 33% of occupation after Romania. Consequently, as a first point of view, regarding the subject under study, the undersigned can give the appreciation that, although it is true, this modality of informal work is not regulated in our legal system, it has generated a great impact on our society and therefore does not have a legal floor that safeguards the labor and fundamental rights of this group of people who carry out the activity. This group of people is classified as a vulnerable population, given the conditions in which they have to develop their work and the continuous exposure to being exploited, attacked, marginalized by the owners of these establishments called webcam studies.That said, the problems that we live in Colombia in the face of this issue of labor informality, has generated for us the need to investigate, investigate or carry out a more in-depth work, where we can develop alternatives of accompaniment to this population, so that their Rights

    Simulating rewetting events in intermittent rivers and ephemeral streams: a global analysis of leached nutrients and organic matter

    Climate change and human pressures are changing the global distribution and extent of intermittent rivers and ephemeral streams (IRES), which comprise half of the global river network area. IRES are characterized by periods of flow cessation, during which channel substrates accumulate and undergo physico‐chemical changes (preconditioning), and periods of flow resumption, when these substrates are rewetted and release pulses of dissolved nutrients and organic matter (OM). However, there are no estimates of the amounts and quality of leached substances, nor is there information on the underlying environmental constraints operating at the global scale. We experimentally simulated, under standard laboratory conditions, rewetting of leaves, riverbed sediments, and epilithic biofilms collected during the dry phase across 205 IRES from five major climate zones. We determined the amounts and qualitative characteristics of the leached nutrients and OM, and estimated their areal fluxes from riverbeds. In addition, we evaluated the variance in leachate characteristics in relation to selected environmental variables and substrate characteristics. We found that sediments, due to their large quantities within riverbeds, contribute most to the overall flux of dissolved substances during rewetting events (56‐98%), and that flux rates distinctly differ among climate zones. Dissolved organic carbon, phenolics, and nitrate contributed most to the areal fluxes. The largest amounts of leached substances were found in the continental climate zone, coinciding with the lowest potential bioavailability of the leached organic matter. The opposite pattern was found in the arid zone. Environmental variables expected to be modified under climate change (i.e. potential evapotranspiration, aridity, dry period duration, land use) were correlated with the amount of leached substances, with the strongest relationship found for sediments. These results show that the role of IRES should be accounted for in global biogeochemical cycles, especially because prevalence of IRES will increase due to increasing severity of drying events

    Search for dark matter produced in association with bottom or top quarks in √s = 13 TeV pp collisions with the ATLAS detector

    A search for weakly interacting massive particle dark matter produced in association with bottom or top quarks is presented. Final states containing third-generation quarks and miss- ing transverse momentum are considered. The analysis uses 36.1 fb−1 of proton–proton collision data recorded by the ATLAS experiment at √s = 13 TeV in 2015 and 2016. No significant excess of events above the estimated backgrounds is observed. The results are in- terpreted in the framework of simplified models of spin-0 dark-matter mediators. For colour- neutral spin-0 mediators produced in association with top quarks and decaying into a pair of dark-matter particles, mediator masses below 50 GeV are excluded assuming a dark-matter candidate mass of 1 GeV and unitary couplings. For scalar and pseudoscalar mediators produced in association with bottom quarks, the search sets limits on the production cross- section of 300 times the predicted rate for mediators with masses between 10 and 50 GeV and assuming a dark-matter mass of 1 GeV and unitary coupling. Constraints on colour- charged scalar simplified models are also presented. Assuming a dark-matter particle mass of 35 GeV, mediator particles with mass below 1.1 TeV are excluded for couplings yielding a dark-matter relic density consistent with measurements

    Discutindo a educação ambiental no cotidiano escolar: desenvolvimento de projetos na escola formação inicial e continuada de professores

    A presente pesquisa buscou discutir como a Educação Ambiental (EA) vem sendo trabalhada, no Ensino Fundamental e como os docentes desta escola compreendem e vem inserindo a EA no cotidiano escolar., em uma escola estadual do município de Tangará da Serra/MT, Brasil. Para tanto, realizou-se entrevistas com os professores que fazem parte de um projeto interdisciplinar de EA na escola pesquisada. Verificou-se que o projeto da escola não vem conseguindo alcançar os objetivos propostos por: desconhecimento do mesmo, pelos professores; formação deficiente dos professores, não entendimento da EA como processo de ensino-aprendizagem, falta de recursos didáticos, planejamento inadequado das atividades. A partir dessa constatação, procurou-se debater a impossibilidade de tratar do tema fora do trabalho interdisciplinar, bem como, e principalmente, a importância de um estudo mais aprofundado de EA, vinculando teoria e prática, tanto na formação docente, como em projetos escolares, a fim de fugir do tradicional vínculo “EA e ecologia, lixo e horta”.Facultad de Humanidades y Ciencias de la Educació
