    Responsabilidad de los servidores públicos en el desarrollo de la contratación estatal

    Este es un artículo de revisión, que analiza, interpreta y critica la relación especial de sujeción del servidor público que desarrolla funciones respecto a la contratación estatal en aspectos relevantes y que impliquen una omisión a su deber funcional dentro de la actividad, contiene la doctrina más relevante sobre el tema en autores nacionales, la jurisprudencia de la Corte Constitucional y Consejo de Estado, trabajo de gran interés para los servidores públicos que ejecutan la ley contractual, teniendo en cuenta las relaciones especiales de sujeción frente a sus funciones y deberes, esto desde el punto de vista del debido proceso y la aplicación de las normas sustantivas. Finalmente presenta una propuesta que contiene aspectos de dogmática jurídica sobre intereses o bienes jurídicamente protegidos en los procesos contractuales frente a la responsabilidad como servidor público, a lo cual se considera como el aporte de los autores a las ciencias jurídicas. Se hizo una exhaustiva revisión bibliográfica y se revisaron procesos disciplinarios en ambas instancias, así como la modificación normativa vigent

    Localization and translation of McDonald’s web pages: cross-cultural adaptation

    O mote para o presente artigo enquadrou-se na unidade curricular de Localização de Software e Páginas Web, do Mestrado de Tradução, da Escola Superior de Educação do Instituto Politécnico de Bragança. Interessou-nos refletir sobre a necessidade de repensar as traduções numa lógica não só meramente linguística, mas também cultural, essencialmente porque a cultura é um pilar fundamental e único em cada nação e absolutamente vital à sua identidade. Neste sentido, considerou-se importante uma pesquisa que se focasse na dimensão cultural, designadamente, procedendo à análise das páginas web da McDonald’s de cada país e as respetivas adaptações culturais percebidas. A análise foi suportada por uma metodologia de um estudo comparativo dos websites da empresa, designadamente, em países de continentes distintos. Esta análise baseou-se, essencialmente, na observação e revisão da literatura que foi realizada através de uma pesquisa bibliográfica que se orientou por um conjunto de critérios previamente estabelecidos com o objetivo de se refinar a pesquisa. Os resultados, apresentados através de um quadro comparativo contendo os critérios deavaliação, evidenciam principalmente: produtos; campanhas de marketing; apresentação multimédia e efeitos, entre outros.This article was written as part of the curricular unit on Localization of Software and Web Pages of the Master’s in Translation at the School of Education of the Polytechnic Institute of Bragança. We were interested in reflecting on the need to rethink translations not only from a linguistic perspective, but also from a cultural one, essentially because culture is a fundamental and unique pillar in each nation and absolutely vital to its identity. In this sense, a research focused on the cultural dimension became important, namely by analyzing the McDonalds web pages of each country and the respective perceived cultural adaptations. The analysis was supported by a methodology of a comparative study of the company’s websites, namely in countries on different continents. This analysis was based essentially on the observation and review of the literature that was carried out through a bibliographical research that was guided by a set of criteria previously established with the aim of refining the research.     Spectroscopy of Bright QUEST RR Lyrae Stars: Velocity Substructures toward Virgo

    Using a sample of 43 bright (V<16.1, distance <13 kpc) RR Lyrae stars (RRLS) from the QUEST survey with spectroscopic radial velocities and metallicities, we find that several separate halo substructures contribute to the Virgo overdensity (VOD). While there is little evidence for halo substructure in the spatial distribution of these stars, their distribution in radial velocity reveals two moving groups. These results are reinforced when the sample is combined with a sample of blue horizontal branch stars that were identified in the SDSS, and the combined sample provides evidence for one additional moving group. These groups correspond to peaks in the radial velocity distribution of a sample of F type main-sequence stars that was recently observed in the same directon by SEGUE, although in one case the RRLS and F star groups may not lie at the same distance. One of the new substructures has a very narrow range in metallicity, which is more consistent with it being the debris from a destroyed globular cluster than from a dwarf galaxy. A small concentration of stars have radial velocities that are similar to the Virgo Stellar Stream (VSS) that was identified previously in a fainter sample of RRLS. Our results suggest that this feature extends to distances as short as ~12 kpc from its previous detection at ~19 kpc. None of the new groups and only one star in the sample have velocities that are consistent with membership in the leading tidal stream from the Sagittarius Dwarf Spheroidal Galaxy, which some authors have suggested is the origin of the VOD.Comment: Accepted for publication in the A

    El presente trabajo se enfoca en el plan estratégico de talento humano OXIMIG gases industriales y los procesos relacionados con la gestión de personas. En primer lugar, se aborda la importancia del plan estratégico como herramienta fundamental para alcanzar los objetivos empresariales y se describen los principales elementos que deben contemplarse en su elaboración. Se aborda el proceso de reclutamiento, selección, contratación e inducción de personal, enfatizando la relevancia de cada uno de estos pasos para la gestión eficiente de los recursos humanos. Se describe el proceso de reinducción e inducción, que busca integrar de manera efectiva al nuevo colaborador en la empresa y en su equipo de trabajo. Se destacan las actividades y estrategias que se utilizan para asegurar que el nuevo empleado se sienta cómodo y motivado en su nuevo entorno laboral y pueda desempeñar su trabajo de manera eficiente. El plan estratégico de talento humano establece las políticas y estrategias necesarias para gestionar el capital humano de una empresa, por lo que en el presente trabajo se realizó un diagnóstico mediante la matriz DOFA del proceso de gestión del talento humano de la empresa OXIMIG y se aplicó una encuesta de talento humano a todo el personal.This paper focuses on the strategic plan for human talent OXIMIG industrial gases, and the processes related to people management. In the first place, the importance of the strategic plan is addressed as a fundamental tool to achieve business objectives and the main elements that must be considered in its preparation are described. The process of recruitment, selection, hiring and induction of personnel is addressed, emphasizing the relevance of each of these steps for the efficient management of human resources. The reinduction and induction process is described, which seeks to effectively integrate the new collaborator in the company and in his work team. Activities and strategies used to ensure that the new employee feels comfortable and motivated in their new work environment and can perform their work efficiently are highlighted. The strategic human talent plan establishes the necessary policies and strategies to manage the human capital of a company, so in the present work a diagnosis was made through the SWOT matrix of the human talent management process of the OXIMIG company, and it was applied a survey of human talent to all staff

    Search for dark matter produced in association with bottom or top quarks in √s = 13 TeV pp collisions with the ATLAS detector

    A search for weakly interacting massive particle dark matter produced in association with bottom or top quarks is presented. Final states containing third-generation quarks and miss- ing transverse momentum are considered. The analysis uses 36.1 fb−1 of proton–proton collision data recorded by the ATLAS experiment at √s = 13 TeV in 2015 and 2016. No significant excess of events above the estimated backgrounds is observed. The results are in- terpreted in the framework of simplified models of spin-0 dark-matter mediators. For colour- neutral spin-0 mediators produced in association with top quarks and decaying into a pair of dark-matter particles, mediator masses below 50 GeV are excluded assuming a dark-matter candidate mass of 1 GeV and unitary couplings. For scalar and pseudoscalar mediators produced in association with bottom quarks, the search sets limits on the production cross- section of 300 times the predicted rate for mediators with masses between 10 and 50 GeV and assuming a dark-matter mass of 1 GeV and unitary coupling. Constraints on colour- charged scalar simplified models are also presented. Assuming a dark-matter particle mass of 35 GeV, mediator particles with mass below 1.1 TeV are excluded for couplings yielding a dark-matter relic density consistent with measurements

    Mortality from gastrointestinal congenital anomalies at 264 hospitals in 74 low-income, middle-income, and high-income countries: a multicentre, international, prospective cohort study

    Summary Background Congenital anomalies are the fifth leading cause of mortality in children younger than 5 years globally. Many gastrointestinal congenital anomalies are fatal without timely access to neonatal surgical care, but few studies have been done on these conditions in low-income and middle-income countries (LMICs). We compared outcomes of the seven most common gastrointestinal congenital anomalies in low-income, middle-income, and high-income countries globally, and identified factors associated with mortality. Methods We did a multicentre, international prospective cohort study of patients younger than 16 years, presenting to hospital for the first time with oesophageal atresia, congenital diaphragmatic hernia, intestinal atresia, gastroschisis, exomphalos, anorectal malformation, and Hirschsprung’s disease. Recruitment was of consecutive patients for a minimum of 1 month between October, 2018, and April, 2019. We collected data on patient demographics, clinical status, interventions, and outcomes using the REDCap platform. Patients were followed up for 30 days after primary intervention, or 30 days after admission if they did not receive an intervention. The primary outcome was all-cause, in-hospital mortality for all conditions combined and each condition individually, stratified by country income status. We did a complete case analysis. Findings We included 3849 patients with 3975 study conditions (560 with oesophageal atresia, 448 with congenital diaphragmatic hernia, 681 with intestinal atresia, 453 with gastroschisis, 325 with exomphalos, 991 with anorectal malformation, and 517 with Hirschsprung’s disease) from 264 hospitals (89 in high-income countries, 166 in middleincome countries, and nine in low-income countries) in 74 countries. Of the 3849 patients, 2231 (58·0%) were male. Median gestational age at birth was 38 weeks (IQR 36–39) and median bodyweight at presentation was 2·8 kg (2·3–3·3). Mortality among all patients was 37 (39·8%) of 93 in low-income countries, 583 (20·4%) of 2860 in middle-income countries, and 50 (5·6%) of 896 in high-income countries (p<0·0001 between all country income groups). Gastroschisis had the greatest difference in mortality between country income strata (nine [90·0%] of ten in lowincome countries, 97 [31·9%] of 304 in middle-income countries, and two [1·4%] of 139 in high-income countries; p≤0·0001 between all country income groups). Factors significantly associated with higher mortality for all patients combined included country income status (low-income vs high-income countries, risk ratio 2·78 [95% CI 1·88–4·11], p<0·0001; middle-income vs high-income countries, 2·11 [1·59–2·79], p<0·0001), sepsis at presentation (1·20 [1·04–1·40], p=0·016), higher American Society of Anesthesiologists (ASA) score at primary intervention (ASA 4–5 vs ASA 1–2, 1·82 [1·40–2·35], p<0·0001; ASA 3 vs ASA 1–2, 1·58, [1·30–1·92], p<0·0001]), surgical safety checklist not used (1·39 [1·02–1·90], p=0·035), and ventilation or parenteral nutrition unavailable when needed (ventilation 1·96, [1·41–2·71], p=0·0001; parenteral nutrition 1·35, [1·05–1·74], p=0·018). Administration of parenteral nutrition (0·61, [0·47–0·79], p=0·0002) and use of a peripherally inserted central catheter (0·65 [0·50–0·86], p=0·0024) or percutaneous central line (0·69 [0·48–1·00], p=0·049) were associated with lower mortality. Interpretation Unacceptable differences in mortality exist for gastrointestinal congenital anomalies between lowincome, middle-income, and high-income countries. Improving access to quality neonatal surgical care in LMICs will be vital to achieve Sustainable Development Goal 3.2 of ending preventable deaths in neonates and children younger than 5 years by 2030
