    The location of international practices: what is human rights practice?

    This article opens up space to challenge state-centrism about human rights practice. To do so, it presents and critically assesses four methods that can be used to determine who and/or what counts as a part of any international practice: the agreement method, which locates a practice by referring to speech acts that define it; the contextual method, which locates a practice by referring to the actions, meanings, and intentions of practitioners; the value method, which locates a practice by identifying a value or principle that the practice reflects or instantiates; and the purpose method, which locates a practice by constructing an account of the sociopolitical reason(s) for a practice's existence. The purpose method, based on an interpretation of Rawls' constructivism, is developed, in a way that focuses on practitioners' judgement-based reasons to assign responsibility for human rights to any state or non-state actor

    Diasporas and secessionist conflicts : the mobilization of the Armenian, Albanian and Chechen diasporas

    This article examines the impact of diasporas on secessionist conflicts, focusing on the Albanian, Armenian and Chechen diasporas and the conflicts in Kosovo, Karabakh and Chechnya during the 1990s. How do diasporas radicalize these conflicts? I argue that despite differences in diaspora communal characteristics and the types of the secessionist conflicts, a common pattern of mobilization develops. Large-scale diasporic support for secessionism emerges only after independence is proclaimed by the local elites. From that point onwards diasporas become engaged in a conflict spiral, and transnational coalitions are formed between local secessionist and diaspora groups. Depending on the organizational strength of the local strategic centre and the diasporic institutions, these coalitions endure or dissipate. Diasporas exert radicalization influences on the conflict spiral on two specific junctures – when grave violations of human rights occur in the homeland and when local moderate elites start losing credibility that they can achieve the secessionist goal

    The lawyers' war: states and human rights in a transnational field

    While torture and assassination have not infrequently been used by states, the post 9/11 "war on terror" waged by the U.S. has been distinguished by the open acknowledgement of, and political and legal justifications put forward in support of, these practices. This is surprising insofar as the primary theories that have been mobilized by sociologists and political scientists to understand the relation between the spread of human rights norms and state action presume that states will increasingly adhere to such norms in their rhetoric, if not always in practice. Thus, while it is not inconceivable that the U.S. would engage in torture and assassination, we would expect these acts would be conducted under a cloak of deniability. Yet rather than pure hypocrisy, the U.S. war on terror has been characterized by the development of a legal infrastructure to support the use of "forbidden" practices such as torture and assassination, along with varying degrees of open defense of such tactics. Drawing on first-order accounts presented in published memoirs, this paper argues that the Bush administration developed such openness as a purposeful strategy, in response to the rise of a legal, technological, and institutional transnational human rights infrastructure which had turned deniability into a less sustainable option. It concludes by suggesting that a more robust theory of state action, drawing on sociological field theory, can help better explain the ways that transnational norms and institutions affect states

    How do religious norms diffuse? Institutional translation and international change in a post-secular world society

    This article draws from Habermasian post-secular theory to broaden the scope of Constructivist research on norm dynamics beyond its current Western-centric focus. In an increasingly post-secular world society, we conceptualize the mechanism of institutional translation to explain processes of norm diffusion whereby culturally situated ‘thick’ norms acquire a ‘thinner’ ethical status via a dialogical process of normative contestation across diverse ethical perspectives. Institutional translation differs from, but also complements, mechanisms of norm diffusion, such as persuasion and localization, by illustrating how norms conceived and promoted by non-Western religious-based actors can acquire global legitimacy within the institutions of the international liberal order. The article investigates the explanatory value of this framework through an empirical analysis of two contrasting cases of norm promotion by the Organization of Islamic Conference at the United Nations.     'Show me the evidence' : mobilisation, citizenship and risk in Indian asbestos issues

    This paper examines asbestos issues, mobilisation and citizenship in India. It shows how asbestos has been considered as a tool for Indian economic growth and modernisation and explores the scientific debates around its ‘safe’ use. In seeking to locate experiences of citizenship within a globalised context, this research has focused on anti-asbestos mobilisation and protest in cosmopolitan cities as well as more decentralised contexts. It argues that the state’s narrow definition of asbestos diseases enables it to officially document the lack of asbestos diseases experienced by Indian workers. This process, which defines sufferers as politically invisible and inconsequential, accompanied by the 30 year delay between exposure and the onset of disease, hinders anti-asbestos organisations as there is no constituency to be mobilised. Parallel (and partially interrelated) grassroots asbestos movements which are more worker-orientated are, however, marginalised from the transnational protests. The paper argues that mobilisation around identity issues thus creates different contexts in India, in which activists are simultaneously both intimately connected and enormously distant to different aspects of the mobilisation process. In addition, while geographic and political differences are compressed through transnational mobilisation; class, regional and educational differences are expanded.
