    Constitutional Law - Applicability of First Ten Amendments to Unincorporated Territory - A man was killed aboard an American ship in a Virgin Island port. A police investigation was started the next day and continued for twelve days thereafter, during which twenty three witnesses were examined by the government. During most of the investigation the prisoners were present, and most of the testimony was translated into Spanish for their benefit, that being the only language they understood. No formal charge had been made against them and they were without counsel, but they were given an opportunity to explain after the testimony of each witness. The record was then transferred to the District court where the same judge presided, assisted by four lay judges. Formal charge was made, and the prisoners had counsel. The trial consisted of arguments on the facts as found in the above investigation, no more witnesses being called, although the prisoners were given the opportunity of calling witnesses in their behalf. They were found guilty. Act of Congress of March 3, 1917 (39 Stat. c. 171) provided that, as to judicial proceedings, the local laws should continue in effect in so far as compatible with the chang\u27ed sovereignty, until Congress should otherwise provide. It was assumed that the above proceedings were in accord\u27 with the local laws as established by Denmark. Held, the prisoners are entitled to a new trial, for the new sovereignty gives them the right to be confronted by the witnesses against them, and to be heard through cross-examination. Soto v. U. In later testing, it was re-named GW 9 (Geneva White 9) for ease of identification in cooperatively run yield trials. The vine was initially described as vigorous and productive with large clusters

    Direct covariance measurement of CO2 gas transfer velocity during the 2008 Southern Ocean Gas Exchange Experiment: Wind speed dependency

    Direct measurements of air-sea heat, momentum, and mass (including CO2, DMS, and water vapor) fluxes using the direct covariance method were made over the open ocean from the NOAA R/V Ronald H. Brown during the Southern Ocean Gas Exchange (SO GasEx) program. Observations of fluxes and the physical processes associated with driving air-sea exchange are key components of SO GasEx. This paper focuses on the exchange of CO2 and the wind speed dependency of the transfer velocity, k, used to model the CO2 flux between the atmosphere and ocean. A quadratic dependence of k on wind speed based on dual tracer experiments is most frequently encountered in the literature. However, in recent years, bubble-mediated enhancement of k, which exhibits a cubic relationship with wind speed, has emerged as a key issue for flux parameterization in high-wind regions. Therefore, a major question addressed in SO GasEx is whether the transfer velocities obey a quadratic or cubic relationship with wind speed. After significant correction to the flux estimates (primarily due to moisture contamination), the direct covariance CO2 fluxes confirm a significant enhancement of the transfer velocity at high winds compared with previous quadratic formulations. Regression analysis suggests that a cubic relationship provides a more accurate parameterization over a wind speed range of 0 to 18 m s−1. The Southern Ocean results are in good agreement with the 1998 GasEx experiment in the North Atlantic and a recent separate field program in the North Sea

Direct covariance estimates of momentum fluxes were collected in all four experiments and wind profiles were collected during three of them. The objective of the investigation is to improve parameterizations of the surface roughness and drag coefficient used to estimate the surface stress from bulk formulas. Specifically, the Coupled Ocean–Atmosphere Response Experiment (COARE) 3.0 bulk flux algorithm is refined to create COARE 3.5. Oversea measurements of dimensionless shear are used to investigate the stability function under stable and convective conditions. The behavior of surface roughness is then investigated over a wider range of wind speeds (up to 25 m s−1) and wave conditions than have been available from previous oversea field studies. The wind speed dependence of the Charnock coefficient α in the COARE algorithm is modified to , where m = 0.017 m−1 s and b = −0.005. When combined with a parameterization for smooth flow, this formulation gives better agreement with the stress estimates from all of the field programs at all winds speeds with significant improvement for wind speeds over 13 m s−1. Wave age– and wave slope–dependent parameterizations of the surface roughness are also investigated, but the COARE 3.5 wind speed–dependent formulation matches the observations well without any wave information.     Air–Sea Interactions from Westerly Wind Bursts During the November 2011 MJO in the Indian Ocean

    The life cycles of three Madden–Julian oscillation (MJO) events were observed over the Indian Ocean as part of the Dynamics of the MJO (DYNAMO) experiment. During November 2011 near 0°, 80°E, the site of the research vessel Roger Revelle, the authors observed intense multiscale interactions within an MJO convective envelope, including exchanges between synoptic, meso, convective, and turbulence scales in both atmosphere and ocean and complicated by a developing tropical cyclone. Embedded within the MJO event, two bursts of sustained westerly wind (>10 m s−1; 0–8-km height) and enhanced precipitation passed over the ship, each propagating eastward as convectively coupled Kelvin waves at an average speed of 8.6 m s−1. The ocean response was rapid, energetic, and complex. The Yoshida–Wyrtki jet at the equator accelerated from less than 0.5 m s−1 to more than 1.5 m s−1 in 2 days. This doubled the eastward transport along the ocean's equatorial waveguide. Oceanic (subsurface) turbulent heat fluxes were comparable to atmospheric surface fluxes, thus playing a comparable role in cooling the sea surface. The sustained eastward surface jet continued to energize shear-driven entrainment at its base (near 100-m depth) after the MJO wind bursts subsided, thereby further modifying sea surface temperature for a period of several weeks after the storms had passed

    This article aims to analyze the behavior of a portfolio of assets selected by Data Envelopment Analysis (DEA), optimized by the Sharpe approach, and compare it to portfolios of assets obtained only by DEA or the Sharpe approach. To do that, we used the DEA model to assess the efficiency of shares of the São Paulo Stock Exchange (Bovespa), employing return, variance and other indicators such as input and output variables. Also, we used the Sharpe approach to optimize the portfolio composition. In the comparison of portfolios, we noted that the resulting combination of both models performed better than the portfolios optimized by only one of the models

    Athletic Performance and Recovery-Stress Factors in Cycling: An Ever Changing Balance

    We sought to examine whether the relationship between recovery-stress factors and performance would differ at the beginning (Stage 1) and the end (Final Stage) of a multi-stage cycling competition. Sixty-seven cyclists with a mean age of 21.90 years (SD = 1.60) and extensive international experience participated in the study. The cyclists responded to the Recovery-Stress Questionnaire for Athletes (RESTQ-Sport) and rated their performance (1 = extremely poor to 10 = excellent) in respect to the first and last stage. Two step-down multiple regression models were used to estimate the relationship among recovery (nine factors; e.g., Physical Recovery, Sleep Quality) and stress factors (10 factors; e.g., Lack of Energy, Physical Complaints), as assessed by the RESTQ and in relation to performance. Model-1 pertained to Stage 1, whereas Model-2 used data from the Final Stage. The final Model-1 revealed that Physical Recovery (β = .46, p = .01), Injury (β = -.31, p = .01) and General Well-being (β = -.26, p = .04) predicted performance in Stage 1 (R2 = .21). The final Model-2 revealed a different relationship between recovery-stress factors and performance. Specifically, being a climber (β = .28, p = .01), Conflicts/Pressure (β = .33, p = .01), and Lack of Energy (β = -.37, p = .01) were associated with performance at the Final Stage (R2 = .19). Collectively, these results suggest that the relationship among recovery and stress factors changes greatly over a relatively short period of time, and dynamically influences performance in multi-stage competitions

    Air-sea CO2 exchange in the equatorial Pacific

The definitive version was published in Journal of Geophysical Research 109 (2004): C08S02, doi:10.1029/2003JC002256.GasEx-2001, a 15-day air-sea carbon dioxide (CO2) exchange study conducted in the equatorial Pacific, used a combination of ships, buoys, and drifters equipped with ocean and atmospheric sensors to assess variability and surface mechanisms controlling air-sea CO2 fluxes. Direct covariance and profile method air-sea CO2 fluxes were measured together with the surface ocean and marine boundary layer processes. The study took place in February 2001 near 125°W, 3°S in a region of high CO2. The diurnal variation in the air-sea CO2 difference was 2.5%, driven predominantly by temperature effects on surface solubility. The wind speed was 6.0 ± 1.3 m s−1, and the atmospheric boundary layer was unstable with conditions over the range −1 < z/L < 0. Diurnal heat fluxes generated daytime surface ocean stratification and subsequent large nighttime buoyancy fluxes. The average CO2 flux from the ocean to the atmosphere was determined to be 3.9 mol m−2 yr−1, with nighttime CO2 fluxes increasing by 40% over daytime values because of a strong nighttime increase in (vertical) convective velocities. The 15 days of air-sea flux measurements taken during GasEx-2001 demonstrate some of the systematic environmental trends of the eastern equatorial Pacific Ocean. The fact that other physical processes, in addition to wind, were observed to control the rate of CO2 transfer from the ocean to the atmosphere indicates that these processes need to be taken into account in local and global biogeochemical models. These local processes can vary on regional and global scales. The GasEx-2001 results show a weak wind dependence but a strong variability in processes governed by the diurnal heating cycle. This implies that any changes in the incident radiation, including atmospheric cloud dynamics, phytoplankton biomass, and surface ocean stratification may have significant feedbacks on the amount and variability of air-sea gas exchange. This is in sharp contrast with previous field studies of air-sea gas exchange, which showed that wind was the dominating forcing function.     Mystery Solved: The Identification of the Two Missing Romanov Children Using DNA Analysis

    One of the greatest mysteries for most of the twentieth century was the fate of the Romanov family, the last Russian monarchy. Following the abdication of Tsar Nicholas II, he and his wife, Alexandra, and their five children were eventually exiled to the city of Yekaterinburg. The family, along with four loyal members of their staff, was held captive by members of the Ural Soviet. According to historical reports, in the early morning hours of July 17, 1918 the entire family along with four loyal members of their staff was executed by a firing squad. After a failed attempt to dispose of the remains in an abandoned mine shaft, the bodies were transported to an open field only a few kilometers from the mine shaft. Nine members of the group were buried in one mass grave while two of the children were buried in a separate grave. With the official discovery of the larger mass grave in 1991, and subsequent DNA testing to confirm the identities of the Tsar, the Tsarina, and three of their daughters – doubt persisted that these remains were in fact those of the Romanov family. In the summer of 2007, a group of amateur archeologists discovered a collection of remains from the second grave approximately 70 meters from the larger grave. We report forensic DNA testing on the remains discovered in 2007 using mitochondrial DNA (mtDNA), autosomal STR, and Y- STR testing. Combined with additional DNA testing of material from the 1991 grave, we have virtually irrefutable evidence that the two individuals recovered from the 2007 grave are the two missing children of the Romanov family: the Tsarevich Alexei and one of his sisters

    Search for squarks and gluinos in events with isolated leptons, jets and missing transverse momentum at s√=8 TeV with the ATLAS detector

    The results of a search for supersymmetry in final states containing at least one isolated lepton (electron or muon), jets and large missing transverse momentum with the ATLAS detector at the Large Hadron Collider are reported. The search is based on proton-proton collision data at a centre-of-mass energy s√=8 TeV collected in 2012, corresponding to an integrated luminosity of 20 fb−1. No significant excess above the Standard Model expectation is observed. Limits are set on supersymmetric particle masses for various supersymmetric models. Depending on the model, the search excludes gluino masses up to 1.32 TeV and squark masses up to 840 GeV. Limits are also set on the parameters of a minimal universal extra dimension model, excluding a compactification radius of 1/R c = 950 GeV for a cut-off scale times radius (ΛR c) of approximately 30
