    Le régime de la copie privée face à Internet

    Le présent article vise à exposer la situation du régime de la copie privée face à Internet, tant dans son application que dans sa légitimité. L’auteur soumet notamment que l’exception de la copie privée n’est applicable ni à la mise à disposition ni au téléchargement de fichiers musicaux sur Internet à moins que, quant à ce dernier acte, la copie provienne d’une source licite, ce qui exclut les réseaux peer-to-peer. Ensuite, l’auteur analyse la question quant à savoir si les enregistreurs audionumériques et les disques durs des ordinateurs personnels devraient être soumis aux redevances au Canada, et conclut à l’effet qu’une réforme de la Loi sur le droit d’auteur est de mise si l’on veut en arriver à une telle éventualité. Finalement dans la dernière partie, l’auteur soulève la question de la remise en cause du régime de la copie privée face à l’importance grandissante que l‘on accorde à la gestion numérique des droits.This article describes both the legitimacy and enforcement of the private copying regime in relation to the Internet. In particular, the author argues that private copying exceptions apply neither to providing access to nor to uploading music files on the Internet unless in the latter case the copy comes from a legal source, which excludes peer-to-peer networks. The author then analyses whether digital audio recorders and the hard disks of personal computers should be subject to levies in Canada. The conclusion is that the Copyright Act needs to be amended for that to be the case. In the last part, the author explores whether the private copying regime will be challenged as digital management of rights grows

    Imagining identity: Enshrining hermeneutics of dialogue and reflexivity within the practices of Canadian Catholic higher education

    Organizational identity is a key focus within Canadian Catholic higher education institutions (CHEIs). For the most part founded by religious communities, these institutions have traditionally depended upon the presence of priests and nuns to ensure the transmission of their religious institutional identities. Today’s more diverse workforce needs to be equipped to continue this tradition while also transforming it to ensure its continued socio-cultural relevance. This research project explores how individuals working within CHEIs experience, and exercise agency with regard to, the institutional identity of their workplaces. Working within the critical realist tradition, this project applies critical grounded theory to higher education research. Based on data collected through semi-structured interviews in three different CHEIs, new theory is built through an iterative dialogue between this data, the literature and the researcher’s own reflexive process. Three key findings emerge. First, institutional identity within these institutions is re-conceptualized as a balancing act between the structures and cultures of both the church and the academy. Second, a developmental process is put forward which traces how individuals – who I designate as identity-carriers – exercise agency with regard to their institutions’ identity. Third, the specific role of mission officer is analysed using Archer’s (2003) model of reflexivity. A final chapter examines how this research contributes to both the practice and theory of institutional identity development within CHEIs and beyond. As a whole, this research demonstrates that CHEIs are indeed adapting to their new contexts and finding novel ways to maintain and create their institutional identities. It also contributes to the wider discourse about how individuals connect to their institutional contexts and posits concrete ways of fostering positive relationships between personal and institutional identities in the workplace

    A Summary Catalogue of Microbial Drinking Water Tests for Low and Medium Resource Settings

    Microbial drinking-water quality testing plays an essential role in measures to protect public health. However, such testing remains a significant challenge where resources are limited. With a wide variety of tests available, researchers and practitioners have expressed difficulties in selecting the most appropriate test(s) for a particular budget, application and setting. To assist the selection process we identified the characteristics associated with low and medium resource settings and we specified the basic information that is needed for different forms of water quality monitoring. We then searched for available faecal indicator bacteria tests and collated this information. In total 44 tests have been identified, 18 of which yield a presence/absence result and 26 of which provide enumeration of bacterial concentration. The suitability of each test is assessed for use in the three settings. The cost per test was found to vary from 0.60to0.60 to 5.00 for a presence/absence test and from 0.50to0.50 to 7.50 for a quantitative format, though it is likely to be only a small component of the overall costs of testing. This article presents the first comprehensive catalogue of the characteristics of available and emerging low-cost tests for faecal indicator bacteria. It will be of value to organizations responsible for monitoring national water quality, water service providers, researchers and policy makers in selecting water quality tests appropriate for a given setting and application

    Migraciones interregionales y ciclos económicos en España (1988- 2001)

    Este artículo analiza la relación entre coyuntura económica y dinámica migratoria interregional en España en el período 1988-2001 a partir de la Estadística de Variaciones Residenciales (EVR). El estudio establece un nexo entre las fases del ciclo económico y la dinámica migratoria interregional: los jóvenes presentan una mayor movilidad en las fases expansivas de la economía y las CC. AA. españolas juegan papeles muy distintos en cada una de las fases del ciclo económico. Las regiones de tradición inmigratoria tienen saldos positivos entre los jóvenes y negativos entre la población de más de 55 años. Las regiones que habían sido emigratorias en los años sesenta y setenta experimentan el proceso inverso: emigración neta de jóvenes y retornos de los emigrantes de otros períodos. La migración interregional de jóvenes es afectada significativamente por las fases del ciclo económico mientras que la evolución del grupo de más de 55 años es independiente de la coyuntura económica

    Bacteriological and physico-chemical assessment of wastewater in different region of Tunisia: impact on human health

    <p>Abstract</p> <p>Background</p> <p>In many parts of the world, health problems and diseases have often been caused by discharging untreated or inadequately treated wastewater. In this study, we aimed to control physico-chemical parameters in wastewater samples. Also, microbiological analyses were done to reveal <it>Salmonella </it>strains and each <it>Escherichia coli </it>(<it>E.coli</it>) pathotype.</p> <p>Findings</p> <p>Sixty wastewater samples were collected from fifteen different regions of Tunisia. All physico-chemical parameters (pH, residual free chlorine, total suspended solids, biological oxygen demand, and chemical oxygen demand) were evaluated.</p> <p>For microbiological analyses, samples were filtered to concentrate bacteria. DNA was extracted by boiling and subjected to polymerase chain reaction (PCR) using different pairs of primers.</p> <p>The mean pH values recorded for the sampling point were above the WHO pH tolerance limit. The total suspended solids (TSS) concentrations varied between 240 mg/L and 733 mg/L in entrance points and between 13 mg/L and 76 mg/L in exit points. In entrance points, the studied wastewater has an average COD concentration that varied between 795 mg/mL to 1420 mg/mL. Whereas, BOD concentration of the wastewater ranged between 270 mg/L to 610 mg/L. In exit points, COD concentration varied between 59 mg/L and 141 mg/L, whereas BOD concentration ranged from 15 mg/L to 87 mg/L.</p> <p>The bacteriological control of wastewaters showed that, in entrance points, <it>Escherichia coli </it>(<it>E.coli</it>) was detected at the rate of 76.6%. Three <it>E.coli </it>pathotypes were found: ETEC (53.3%), EAEC (16.6%) and EIEC (6.6%).</p> <p>Concerning the ETEC isolated strains, 8 of 16 (50%) have only the heat-labile toxin gene, 5 of 16 (31.2%) present only the heat-stable toxin gene and 3 of 16 (18.7%) of strains possess both heat-labile toxin gene and heat-stable toxin gene. In exist point, the same pathotypes were found but all detected ETEC strains present only the "est" gene.</p> <p>Concerning <it>Salmonella </it>isolated strains; percentages of 66.6% and 20% were found in entrance and exit points respectively.</p> <p>Conclusions</p> <p>Wastewaters contain a large amount of pathogenic bacteria that present a real impact on human health. Assessment wastewater treatment stations have to consider in account enterobacterial pathogens as potential pathogens that should be correctly controlled.</p

    Neurotensin Receptor 1 Gene (NTSR1) Polymorphism Is Associated with Working Memory

    BACKGROUND: Recent molecular genetics studies showed significant associations between dopamine-related genes (including genes for dopamine receptors, transporters, and degradation) and working memory, but little is known about the role of genes for dopamine modulation, such as those related to neurotensin (NT), in working memory. A recent animal study has suggested that NT antagonist administration impaired working memory in a learning task. The current study examined associations between NT genes and working memory among humans. METHODS: Four hundred and sixty healthy undergraduate students were assessed with a 2-back working memory paradigm. 5 SNPs in the NTSR1 gene were genotyped. 5 ANOVA tests were conducted to examine whether and how working memory differed by NTSR1 genotype, with each SNP variant as the independent variable and the average accuracy on the working memory task as the dependent variable. RESULTS: ANOVA results suggested that two SNPs in the NTSR1 gene (rs4334545 and rs6090453) were significantly associated with working memory. These results survived corrections for multiple comparisons. CONCLUSIONS: Our results demonstrated that NTSR1 SNP polymorphisms were significantly associated with variance in working memory performance among healthy adults. This result extended previous rodent studies showing that the NT deficiency impairs the working memory function. Future research should replicate our findings and extend to an examination of other dopamine modulators

    Methodological approaches for studying the microbial ecology of drinking water distribution systems

    The study of the microbial ecology of drinking water distribution systems (DWDS) has traditionally been based on culturing organisms from bulk water samples. The development and application of molecular methods has supplied new tools for examining the microbial diversity and activity of environmental samples, yielding new insights into the microbial community and its diversity within these engineered ecosystems. In this review, the currently available methods and emerging approaches for characterising microbial communities, including both planktonic and biofilm ways of life, are critically evaluated. The study of biofilms is considered particularly important as it plays a critical role in the processes and interactions occurring at the pipe wall and bulk water interface. The advantages, limitations and usefulness of methods that can be used to detect and assess microbial abundance, community composition and function are discussed in a DWDS context. This review will assist hydraulic engineers and microbial ecologists in choosing the most appropriate tools to assess drinking water microbiology and related aspects
