    A Fault-Based Administrative Alternative for Resolving Medical Malpractice Claims

    The recurring crises in medical malpractice litigation have been widely discussed and documented over the past two decades.\u27 In response to these crises, a growing consensus has emerged among legislatures, government agencies, and scholars in favor of tort reform. Indeed, virtually every state has passed some tort reform legislation.\u27Despite the reforms, several serious problems persist in medical malpractice. The current tort system does not compensate injured patients adequately or equitably, nor does it deter negligent practices sufficiently. These failings occur despite the increasingly high costs to society of the tort system. Particularly troublesome is the impact of these crises on the access to and quality of medical care. In response to these persistent problems and the failure of conventional tort reform efforts, the American Medical Association, thirty-one national medical specialty societies, and the Council of Medical Specialty Societies have joined together as the AMA/Specialty Society Liability Project (Liability Project) to propose a new and comprehensive alternative to the existing tort system. The proposal has three components and is designed for implementation on an experimental basis in one or more states. The proposal first calls for an administrative hearing process to re-place the civil jury system in deciding claims of medical malpractice.Second, while fault is retained as the basis for liability, the proposal modifies several of the other legal rules for determining liability. These first two elements of the proposal are designed to bring greater rationality, equity, and efficiency to the tort system\u27s goal of compensation. The proposal also includes reforms of the processes for educating, credentialing, and disciplining physicians. These changes will ensure that physicians are of a high quality which, ultimately, is the purpose of deterrence in the current malpractice system. Part II of this Article discusses the problems with the current tort regime in medical malpractice. Part III describes the medical profession\u27s proposed alternative, and Part IV explains why the proposed system is superior to the current tort system in dealing with medical injury. Part V concludes that the proposed administrative alternative is fair to patients, physicians, and the public and deserves implementation, at least on an experimental basis

    Mixed symmetry superconductivity in two-dimensional Fermi liquids

    We consider a 2D isotropic Fermi liquid with attraction in both ss and dd channels and examine the possibility of a superconducting state with mixed ss and dd symmetry of the gap function. We show that both in the weak coupling limit and at strong coupling, a mixed s+ids+id symmetry state is realized in a certain range of interaction. Phase transitions between the mixed and the pure symmetry states are second order. We also show that there is no stable mixed s+ds+d symmetry state at any coupling.Comment: 3 figures attached in uuencoded gzipped file

    Scanning Tunneling Spectroscopy on cleaved BSCCO(2212) single crystals reveal inhomogeneities on length-scales of \sim30 A˚\AA. While most of the surface yields spectra consistent with a d-wave superconductor, small regions show a doubly gapped structure with both gaps lacking coherence peaks and the larger gap having a size typical of the respective pseudo-gap for the same sample.Comment: 4 pages, 4 figure

    On pancultural self-enhancement: well-adjusted Taiwanese self-enhance on personally valued traits

    Taiwanese participants made better-than-average judgments on collectivistic and individualistic traits, evaluated the personal importance of those traits, and completed measures of psychological adjustment (depression, perceived stress, subjective well-being, and satisfaction with life). Replicating findings from other East Asian samples, participants self-enhanced (i.e., regarded the self as superior to peers) more on collectivistic than individualistic attributes and assigned higher personal importance to the former than the latter. Moreover, better adjusted participants manifested a stronger tendency to self-enhance on personally important attributes. These data are consistent with the view that self-enhancement is a universal human motive that is expressed tactically and at odds with the assertion that self-enhancement is a uniquely Western phenomenon. <br/

    Eureka and beyond: mining's impact on African urbanisation

    This collection brings separate literatures on mining and urbanisation together at a time when both artisanal and large-scale mining are expanding in many African economies. While much has been written about contestation over land and mineral rights, the impact of mining on settlement, notably its catalytic and fluctuating effects on migration and urban growth, has been largely ignored. African nation-states’ urbanisation trends have shown considerable variation over the past half century. The current surge in ‘new’ mining countries and the slow-down in ‘old’ mining countries are generating some remarkable settlement patterns and welfare outcomes. Presently, the African continent is a laboratory of national mining experiences. This special issue on African mining and urbanisation encompasses a wide cross-section of country case studies: beginning with the historical experiences of mining in Southern Africa (South Africa, Zambia, Zimbabwe), followed by more recent mineralizing trends in comparatively new mineral-producing countries (Tanzania) and an established West African gold producer (Ghana), before turning to the influence of conflict minerals (Angola, the Democratic Republic of Congo and Sierra Leone)

    Vanadium oxide supported on porous clay heterostructure for the partial oxidation of hydrogen sulphide to sulfur

    Vanadium oxide supported on porous clay heterostructures (PCH) catalysts have been synthesized, characterized and evaluated in the selective oxidation of H2S to elemental sulfur. The catalysts were characterized by XRD, adsorption-desorption of N-2 at -196 degrees C, diffuse reflectance UV-vis, H-2-TPR, Raman spectroscopy and XPS. The catalysts with higher vanadium content are more active and selective, exhibiting a H2S conversion close to 70% after 360h on stream with a high selectivity toward elemental sulfur and a low formation of undesired SO2. The catalysts with V2O5 crystallites have shown a higher activity and resistance to the deactivation. The analysis of the spent catalyst has revealed the formation of V4O9 crystals during the catalytic test, which has been reported as the active phase in the selective oxidation of the H2S.     Methodological framework for World Health Organization estimates of the global burden of foodborne disease

    Background: The Foodborne Disease Burden Epidemiology Reference Group (FERG) was established in 2007 by the World Health Organization to estimate the global burden of foodborne diseases (FBDs). This paper describes the methodological framework developed by FERG's Computational Task Force to transform epidemiological information into FBD burden estimates. Methods and Findings: The global and regional burden of 31 FBDs was quantified, along with limited estimates for 5 other FBDs, using Disability-Adjusted Life Years in a hazard- and incidence-based approach. To accomplish this task, the following workflow was defined: outline of disease models and collection of epidemiological data; design and completion of a database template; development of an imputation model; identification of disability weights; probabilistic burden assessment; and estimating the proportion of the disease burden by each hazard that is attributable to exposure by food (i.e., source attribution). All computations were performed in R and the different functions were compiled in the R package 'FERG'. Traceability and transparency were ensured by sharing results and methods in an interactive way with all FERG members throughout the process. Conclusions: We developed a comprehensive framework for estimating the global burden of FBDs, in which methodological simplicity and transparency were key elements. All the tools developed have been made available and can be translated into a user-friendly national toolkit for studying and monitoring food safety at the local level

    Measurement of the polarisation of W bosons produced with large transverse momentum in pp collisions at sqrt(s) = 7 TeV with the ATLAS experiment

    This paper describes an analysis of the angular distribution of W->enu and W->munu decays, using data from pp collisions at sqrt(s) = 7 TeV recorded with the ATLAS detector at the LHC in 2010, corresponding to an integrated luminosity of about 35 pb^-1. Using the decay lepton transverse momentum and the missing transverse energy, the W decay angular distribution projected onto the transverse plane is obtained and analysed in terms of helicity fractions f0, fL and fR over two ranges of W transverse momentum (ptw): 35 < ptw < 50 GeV and ptw > 50 GeV. Good agreement is found with theoretical predictions. For ptw > 50 GeV, the values of f0 and fL-fR, averaged over charge and lepton flavour, are measured to be : f0 = 0.127 +/- 0.030 +/- 0.108 and fL-fR = 0.252 +/- 0.017 +/- 0.030, where the first uncertainties are statistical, and the second include all systematic effects.Comment: 19 pages plus author list (34 pages total), 9 figures, 11 tables, revised author list, matches European Journal of Physics C versio

    Observation of a new chi_b state in radiative transitions to Upsilon(1S) and Upsilon(2S) at ATLAS

    The chi_b(nP) quarkonium states are produced in proton-proton collisions at the Large Hadron Collider (LHC) at sqrt(s) = 7 TeV and recorded by the ATLAS detector. Using a data sample corresponding to an integrated luminosity of 4.4 fb^-1, these states are reconstructed through their radiative decays to Upsilon(1S,2S) with Upsilon->mu+mu-. In addition to the mass peaks corresponding to the decay modes chi_b(1P,2P)->Upsilon(1S)gamma, a new structure centered at a mass of 10.530+/-0.005 (stat.)+/-0.009 (syst.) GeV is also observed, in both the Upsilon(1S)gamma and Upsilon(2S)gamma decay modes.
