    The Mortgages in Possession in New York and in Michigan - It is interesting to observe how tenaciously the old common law of mortgages has persisted in the state of New York, the very cradle of the modem lien theory of the mortgage. As early as 18o2 Chancellor KENT began the importation into that state of Lord MANSFIELD\u27S Civil Law doctrines of mortgage. Johnson v. Hart, 3 Johns. Cas. 322. In 1814, in the case of Runyan v. Mersereau, ii Johns. 534, the lien theory definitely triumphed over the old law.     Special Assessments Upon Cemetaries - Though the power to tax cemeteries would seem to be\u27entirely clear, very commonly land devoted to such purpose is declared by constitution or statute to be exempt. See CooLY, TAxATION, (3rd ed.) 354. So also in the case of special assessments such land, in the absence of a clear exemption, is liable thereto. Bloomington Cemetery Assoc. v. People, i39 IIl. 16, 28 N. E. io76; Mullins v. Cemetery Assoc., 239 Mo. 681, i44 S. W. iog; Buffalo City Cemetery v. Buffalo, 46 N. Y. 5o3; Lima v. Lima Cemetery Assoc., 42 Oh. St. 128, 5! Am. Rep. 8ag. It may be suggested, in view of the theory upon which special assessments go; that the owner of the land gets back the amount assessed in benefits from an enhanced value of the property, land dedicated to cemetery purposes perpetually would not be subject to such assessments. This contention wa urged in Garden Cemetery Corporation v. Baker, 218 Mass. 339, 105 N. E. io7o (x9r4), and under the facts there presented was rejected, the court distinguishing Mount Auburn Cemetery v. Cambridge, i5o Mass. 12. Where all the lots are sold and used for burial and under the law the company cannot divert the land to other uses, perhaps the argument might be difficult to meet. Exemption from special assessment, then, in general, it would seem, must be found, if at all, in some provision or provisions of the conititution, statutes, or charter, or in some inherent difficulty in the collection of the assessments

    The First Measurements of Galaxy Clustering from IRAC Data of the Spitzer First Look Survey

    We present the first results of the angular auto-correlation function of the galaxies detected by the Infrared Array Camera (IRAC) instrument in the First Look Survey (FLS) of the Spitzer Space Telescope. We detect significant signals of galaxy clustering within the survey area. The angular auto-correlation function of the galaxies detected in each of the four IRAC instrument channels is consistent with a power-law form w(θ)=Aθ1γw(\theta)=A\theta^{1-\gamma} out to \theta = 0.2\arcdeg, with the slope ranging from γ=1.5\gamma = 1.5 to 1.8. We estimate the correlation amplitudes AA to be 2.95×1032.95 \times 10^{-3}, 2.03×1032.03 \times 10^{-3}, 4.53×1034.53 \times 10^{-3}, and 2.34×1032.34 \times 10^{-3} at \theta=1\arcdeg for galaxies detected in the IRAC 3.6μ\mum, 4.5μ\mum, 5.8μ\mum, and 8.0μ\mum instrument channels, respectively.     Can big data solve a big problem? Reporting the obesity data landscape in line with the Foresight obesity system map.

    BACKGROUND: Obesity research at a population level is multifaceted and complex. This has been characterised in the UK by the Foresight obesity systems map, identifying over 100 variables, across seven domain areas which are thought to influence energy balance, and subsequent obesity. Availability of data to consider the whole obesity system is traditionally lacking. However, in an era of big data, new possibilities are emerging. Understanding what data are available can be the first challenge, followed by an inconsistency in data reporting to enable adequate use in the obesity context. In this study we map data sources against the Foresight obesity system map domains and nodes and develop a framework to report big data for obesity research. Opportunities and challenges associated with this new data approach to whole systems obesity research are discussed. METHODS: Expert opinion from the ESRC Strategic Network for Obesity was harnessed in order to develop a data source reporting framework for obesity research. The framework was then tested on a range of data sources. In order to assess availability of data sources relevant to obesity research, a data mapping exercise against the Foresight obesity systems map domains and nodes was carried out. RESULTS: A reporting framework was developed to recommend the reporting of key information in line with these headings: Background; Elements; Exemplars; Content; Ownership; Aggregation; Sharing; Temporality (BEE-COAST). The new BEE-COAST framework was successfully applied to eight exemplar data sources from the UK. 80% coverage of the Foresight obesity systems map is possible using a wide range of big data sources. The remaining 20% were primarily biological measurements often captured by more traditional laboratory based research. CONCLUSIONS: Big data offer great potential across many domains of obesity research and need to be leveraged in conjunction with traditional data for societal benefit and health promotion

The rapidly increasing prevalence of myopia poses a major public health challenge. Here, the CREAM consortium performs a joint meta-analysis to test single-nucleotide polymorphism (SNP) main effects and SNP × education interaction effects on refractive error in 40,036 adults from 25 studies of European ancestry and 10,315 adults from 9 studies of Asian ancestry. In European ancestry individuals, we identify six novel loci (FAM150B-ACP1, LINC00340, FBN1, DIS3L-MAP2K1, ARID2-SNAT1 and SLC14A2) associated with refractive error. In Asian populations, three genome-wide significant loci AREG, GABRR1 and PDE10A also exhibit strong interactions with education (P<8.5 × 10(-5)), whereas the interactions are less evident in Europeans. The discovery of these loci represents an important advance in understanding how gene and environment interactions contribute to the heterogeneity of myopia

    Within-sibship genome-wide association analyses decrease bias in estimates of direct genetic effects

    Estimates from genome-wide association studies (GWAS) of unrelated individuals capture effects of inherited variation (direct effects), demography (population stratification, assortative mating) and relatives (indirect genetic effects). Family-based GWAS designs can control for demographic and indirect genetic effects, but large-scale family datasets have been lacking. We combined data from 178,086 siblings from 19 cohorts to generate population (between-family) and within-sibship (within-family) GWAS estimates for 25 phenotypes. Within-sibship GWAS estimates were smaller than population estimates for height, educational attainment, age at first birth, number of children, cognitive ability, depressive symptoms and smoking. Some differences were observed in downstream SNP heritability, genetic correlations and Mendelian randomization analyses. For example, the within-sibship genetic correlation between educational attainment and body mass index attenuated towards zero. In contrast, analyses of most molecular phenotypes (for example, low-density lipoprotein-cholesterol) were generally consistent. We also found within-sibship evidence of polygenic adaptation on taller height. Here, we illustrate the importance of family-based GWAS data for phenotypes influenced by demographic and indirect genetic effects
