    The Club Approach to Multilateral Trade Lawmaking

    The World Trade Organization (WTO) stands at the center of an emerging structure of global economic governance. Its rules affect important aspects of everyone\u27s lives--how much people pay for the products that they purchase, what types of employment are open to them, and which medicines they can access. And yet, while the WTO was conceived as a negotiating machine that would develop rules in sync with an increasingly dynamic global economy, negotiations on a new set of global trade rules have now been deadlocked for over a decade. This impasse is all the more surprising in light of the fact that the multilateral trade regime was, up until the establishment of the WTO in 1995, one of the most productive engines of international lawmaking. The present Article explores why multilateral trade lawmaking used to work, and why it is no longer working today. A key part of the answer is that before the establishment of the WTO, the multilateral trading system worked as a club, which allowed the major trading powers to manipulate the circle of participants in trade negotiations depending on how these powers weighed the costs and benefits of the participation of additional states. The Article identifies three factors that led the major trading nations to adopt this approach: (1) the greater practicality of negotiations among a smaller group of countries,(2) the insiders\u27 greater influence on the outcome of the negotiations, and (3) the chance to subsequently compel outsiders to join the agreement on the insiders\u27 terms. The Article shows how the major trading powers were able to implement the club approach to multilateral trade lawmaking throughout the pre-WTO era-an ability that accounts for much of the legislative dynamism of that time. The Article then argues that the founding of the WTO, while itself an example of the successful employment of the club logic, has made the use of the club approach in the multilateral trading system much more difficult, if not impracticable. As a result, the pace of lawmaking in the multilateral trading system is now circumscribed by the need to seek the support, or at least acquiescence, of all WTO members

    The thesis provides an analysis of multilateral trade lawmaking in the GATT and the WTO from the late 1940s to the current Doha Round negotiations. It investigates the discourses, practices, techniques, and legal concepts that have come to define what it means to make trade law. These elements are essential to multilateral trade lawmaking insofar as they provide trade negotiators with a way to frame their arguments and to go about negotiating, and with the tools to construct trade policy disciplines and to record them in legal form. On the other hand, they are also limiting, in that they endorse certain ways of going about trade lawmaking as normal, and delimit what negotiators and their audiences perceive as reasonable, legitimate, and realistic arguments in the lawmaking process. The aim of the thesis is to destabilise these elements of trade lawmaking by revealing their contingent and often contested origins, and by showing how they foreclose alternative conceptions of the objectives, means, and possibilities of trade lawmaking. While the dissertation does not provide a full-fledged normative critique of the elements of lawmaking, it attempts to elucidate the discursive, practical, technical, and legal underpinnings of trade lawmaking that any such reform effort will, of necessity, confront

    The last glaciation of Bear Peninsula, central Amundsen Sea Embayment of Antarctica: Constraints on timing and duration revealed by in situ cosmogenic 14C and 10Be dating

    Ice streams in the Pine Island-Thwaites region of West Antarctica currently dominate contributions to sea level rise from the Antarctic ice sheet. Predictions of future ice-mass loss from this area rely on physical models that are validated with geological constraints on past extent, thickness and timing of ice cover. However, terrestrial records of ice sheet history from the region remain sparse, resulting in significant model uncertainties. We report glacial-geological evidence for the duration and timing of the last glaciation of Hunt Bluff, in the central Amundsen Sea Embayment. A multi-nuclide approach was used, measuring cosmogenic 10Be and in situ14C in bedrock surfaces and a perched erratic cobble. Bedrock 10Be ages (118–144 ka) reflect multiple periods of exposure and ice-cover, not continuous exposure since the last interglacial as had previously been hypothesized. In situ14C dating suggests that the last glaciation of Hunt Bluff did not start until 21.1 ± 5.8 ka – probably during the Last Glacial Maximum – and finished by 9.6 ± 0.9 ka, at the same time as ice sheet retreat from the continental shelf was complete. Thickening of ice at Hunt Bluff most likely post-dated the maximum extent of grounded ice on the outer continental shelf. Flow re-organisation provides a possible explanation for this, with the date for onset of ice-cover at Hunt Bluff providing a minimum age for the timing of convergence of the Dotson and Getz tributaries to form a single palaeo-ice stream. This is the first time that timing of onset of ice cover has been constrained in the Amundsen Sea Embayment

    Observation of a new Xi(b) baryon

    The first observation of a new b baryon via its strong decay into Xi(b)^- pi^+ (plus charge conjugates) is reported. The measurement uses a data sample of pp collisions at sqrt(s) = 7 TeV collected by the CMS experiment at the LHC, corresponding to an integrated luminosity of 5.3 inverse femtobarns. The known Xi(b)^- baryon is reconstructed via the decay chain Xi(b)^- to J/psi Xi^- to mu^+ mu^- Lambda^0 pi^-, with Lambda^0 to p pi^-. A peak is observed in the distribution of the difference between the mass of the Xi(b)^- pi^+ system and the sum of the masses of the Xi(b)^- and pi^+, with a significance exceeding five standard deviations. The mass difference of the peak is 14.84 +/- 0.74 (stat.) +/- 0.28 (syst.) MeV. The new state most likely corresponds to the J^P=3/2^+ companion of the Xi(b).Comment: Submitted to Physical Review Letter

    Measurement of the charge ratio of atmospheric muons with the CMS detector

The official published version can be accessed from the link below - Copyright @ 2010 ElsevierWe present a measurement of the ratio of positive to negative muon fluxes from cosmic ray interactions in the atmosphere, using data collected by the CMS detector both at ground level and in the underground experimental cavern at the CERN LHC. Muons were detected in the momentum range from 5 GeV/c to 1 TeV/c. The surface flux ratio is measured to be 1.2766 \pm 0.0032(stat.) \pm 0.0032 (syst.), independent of the muon momentum, below 100 GeV/c. This is the most precise measurement to date. At higher momenta the data are consistent with an increase of the charge ratio, in agreement with cosmic ray shower models and compatible with previous measurements by deep-underground experiments

    Measurements of inclusive W and Z cross sections in pp collisions at root s=7 TeV

The measurements, performed in the electron and muon decay channels, are combined to give sigma(pp to WX) times B(W to muon or electron + neutrino) = 9.95 \pm 0.07(stat.) \pm 0.28(syst.) \pm 1.09(lumi.) nb and sigma(pp to ZX) times B(Z to oppositely charged muon or electron pairs) = 0.931 \pm 0.026(stat.) \pm 0.023(syst.) \pm 0.102(lumi.) nb. Theoretical predictions, calculated at the next-to-next-to-leading order in QCD using recent parton distribution functions, are in agreement with the measured cross sections. Ratios of cross sections, which incur an experimental systematic uncertainty of less than 4%, are also reported

    Search for jet extinction in the inclusive jet-pT spectrum from proton-proton collisions at s=8 TeV

Further distribution of this work must maintain attribution to the author(s) and the published articles title, journal citation, and DOI.The first search at the LHC for the extinction of QCD jet production is presented, using data collected with the CMS detector corresponding to an integrated luminosity of 10.7  fb−1 of proton-proton collisions at a center-of-mass energy of 8 TeV. The extinction model studied in this analysis is motivated by the search for signatures of strong gravity at the TeV scale (terascale gravity) and assumes the existence of string couplings in the strong-coupling limit. In this limit, the string model predicts the suppression of all high-transverse-momentum standard model processes, including jet production, beyond a certain energy scale. To test this prediction, the measured transverse-momentum spectrum is compared to the theoretical prediction of the standard model. No significant deficit of events is found at high transverse momentum. A 95% confidence level lower limit of 3.3 TeV is set on the extinction mass scale

    Search for three-jet resonances in pp collisions at √s=7 TeV

    This is a Pre-Print version of the Article - Copyright @ 2011 APSA model-independent search for three-jet hadronic resonance production in pp collisions at a center-of-mass energy of 7 TeV has been conducted by the CMS Collaboration at the LHC, using a data sample corresponding to an integrated luminosity of 35 inverse picobarns. Events with high jet multiplicity and a large scalar sum of jet transverse momenta are analyzed. The number of expected standard model background events is found to be in good agreement with the observed events.     Measurement of dijet angular distributions and search for quark compositeness in pp collisions at √s=7TeV

    Dijet angular distributions are measured over a wide range of dijet invariant masses in pp collisions at root s = 7 TeV, at the CERN LHC. The event sample, recorded with the CMS detector, corresponds to an integrated luminosity of 36 pb(-1). The data are found to be in good agreement with the predictions of perturbative QCD, and yield no evidence of quark compositeness. With a modified frequentist approach, a lower limit on the contact interaction scale for left-handed quarks of Lambda(+) = 5.6 TeV (Lambda(-) = 6.7 TeV) for destructive (constructive) interference is obtained at the 95% confidence level
