    The Architectural Works Copyright Act: Can it Protect an Architect\u27s State of the Art Development When Funded Through Federal Dollars?

    Westlawn Gardens, the multi-million, multi-phase redevelopment, is nearing completion. As it stands, the LEED award winning development is the largest public housing neighborhood in Wisconsin. But what if a commercial company or individual tried to recreate that development; would the original architect’s work be protected under copyright law? Copyright law has provided no answers and the law typically protects the architect, but when federal dollars are handed down to independent agencies the ownership line is blurred. 17 United States Code Section 105, states that “copyright protection under this title is not available for any work of the United States government, but the United States government is not precluded form receiving and holding copyrights transferred to it by assignment, bequest, or otherwise. Thus, the federal government cannot create a copyright. As a result, no one knows if an independent housing authority, and the contracting or subcontracting architects, can protect their work when they receive money from the Housing and Urban Development (“HUD”), a cabinet in the executive branch. It would make sense to say that the Housing Authority of the City of Milwaukee (“HACM”) has the ability to copyright its project, since it was the agency that procured the various architects to create this masterpiece. However, should HACM be barred from protecting its development, since the funds are from the federal government? And do the architects have any say in this, because, after all, it is the result of their work? This writer asserts that there should be available protection for both the independent agency and the architects. This Comment will shed light on those questions by analyzing the breadtrh of the Architectural Works Copyright Protection Act (“AWCPA”), and the ties between the federal government and local agencies who utilize its funds for public purposes. Milwaukee’s housing authority will be used as an example, and the first section will provide relevant background on the current AWCPA scheme. The second part of this Comment will analyze the ownership issues that arise from the current AWCPA scheme. Finally, this Comment will assert the relief available to architects whose architectural works are funded with federal dollars

    Peroxisome Proliferator-Activated Receptor (PPAR): Balance for Survival in Parasitic Infections

    Parasitic infections induce a magnitude of host responses. At the opposite ends of the spectrum are those that ensure the host's needs to eliminate the invaders and to minimize damage to its own tissues. This review analyzes how parasites would manipulate immunity by activating the immunosuppressive nuclear factor, peroxisome proliferator-activated receptors (PPARs) with type 2 cytokines and free fatty acids from arachidonic acid metabolism. PPARs limit the action of type 1 immunity, in which classically activated macrophages act through the production of proinflammatory signals, to spare the parasites. They also favor the development of alternately activated macrophages which control inflammation so the host would not be destroyed. Possibly, the nuclear factors hold a pivotal role in the establishment of chronic infection by delicately balancing the pro- and anti-inflammatory signaling mechanisms and their ligands may be used as combination therapeutics to limit host pathology

    Stealth Galaxies in the Halo of the Milky Way

    We predict that there is a population of low-luminosity dwarf galaxies orbiting within the halo of the Milky Way that have surface brightnesses low enough to have escaped detection in star-count surveys. The overall count of stealth galaxies is sensitive to the presence (or lack) of a low-mass threshold in galaxy formation. These systems have luminosities and stellar velocity dispersions that are similar to those of known ultrafaint dwarf galaxies but they have more extended stellar distributions (half light radii greater than about 100 pc) because they inhabit dark subhalos that are slightly less massive than their higher surface brightness counterparts. As a result, the typical peak surface brightness is fainter than 30 mag per square arcsec. One implication is that the inferred common mass scale for Milky Way dwarfs may be an artifact of selection bias. If there is no sharp threshold in galaxy formation at low halo mass, then ultrafaint galaxies like Segue 1 represent the high-mass, early forming tail of a much larger population of objects that could number in the hundreds and have typical peak circular velocities of about 8 km/s and masses within 300 pc of about 5 million solar masses. Alternatively, if we impose a low-mass threshold in galaxy formation in order to explain the unexpectedly high densities of the ultrafaint dwarfs, then we expect only a handful of stealth galaxies in the halo of the Milky Way. A complete census of these objects will require deeper sky surveys, 30m-class follow-up telescopes, and more refined methods to identify extended, self-bound groupings of stars in the halo.Comment: 12 pages, 7 figures, accepted by ApJ.     Healthy ageing and home: The perspectives of very old people in five European countries

    This paper reports on in-depth research, using a grounded theory approach, to examine the ways in which very old people perceive healthy ageing in the context of living alone at home within urban settings in five European countries. This qualitative study was part of a cross-national project entitled ENABLE-AGE which examined the relationship between home and healthy ageing. Interviews explored the notion of healthy ageing, the meaning and importance of home, conceptualisations of independence and autonomy and links between healthy ageing and home. Data analysis identified five ways in which older people constructed healthy ageing: home and keeping active; managing lifestyles, health and illness; balancing social life; and balancing material and financial circumstances. Older people reflected on their everyday lives at home in terms of being engaged in purposeful, meaningful action and evaluated healthy ageing in relation to the symbolic and practical affordances of the home, contextualised within constructions of their national context. The research suggests that older people perceive healthy ageing as an active achievement, created through individual, personal effort and supported through social ties despite the health, financial and social decline associated with growing older. The physicality and spatiality of home provided the context for establishing and evaluating the notion of healthy ageing, whilst the experienced relationship between home, life history and identity created a meaningful space within which healthy ageing was negotiated

    Interacting Galaxies in the A901/902 Supercluster with STAGES

    We present a study of galaxy mergers and the influence of environment in the Abell 901/902 supercluster at z~0.165. We use HST ACS F606W data from the STAGES survey, COMBO-17, Spitzer 24um, and XMM-Newton X-ray data. Our analysis utilizes both a visual classification system, and quantitative CAS parameters to identify systems which show evidence of a recent or ongoing merger of mass ratio >1/10. Our results are: (1) After visual classification and minimizing the contamination from false projection pairs, we find that the merger fraction f_merge is 0.023+/-0.007. The estimated fractions of likely major mergers, likely minor mergers, and ambiguous cases are 0.01+/-0.004, 0.006+/-0.003, and 0.007+/-0.003, respectively. (2) The mergers lie outside the cluster core of radius R < 0.25 Mpc: the lack of mergers in the core is likely due to the large galaxy velocity dispersion in the core. Mergers populate the region (0.25 Mpc < R <= 2 Mpc) between the core and outskirt. In this region, the estimated frequency of mergers is similar to those seen at typical group overdensities. This suggests ongoing growth of the clusters via accretion of group and field galaxies. (3) We compare our observed merger fraction with those reported in other clusters and groups out to z~0.4. Existing data points on the merger fraction for L<= L* galaxies in clusters allow for a range of evolutionary scenarios. (4) The fraction of mergers, which lie on the blue cloud is 80%+/-18% versus 34%+/-7% for non-interacting galaxies, implying that interacting galaxies are preferentially blue. (5) The average SFR, based on UV or UV+IR data, is enhanced by a factor of ~1.5 to 2 in mergers compared to non-interacting galaxies. However, mergers in the clusters contribute only a small fraction (between 10% and 15%) of the total SFR density.(Abridged)Comment: Accepted for publication in ApJ. 34 pages, 16 figures.     Relationship between microbiology of throat swab and clinical course among primary care patients with acute cough: a prospective cohort study.

    BACKGROUND: Acute lower respiratory tract infections (ALRTIs) account for most antibiotics prescribed in primary care despite lack of efficacy, partly due to clinician uncertainty about aetiology and patient concerns about illness course. Nucleic acid amplification tests could assist antibiotic targeting. METHODS: In this prospective cohort study, 645 patients presenting to primary care with acute cough and suspected ALRTI, provided throat swabs at baseline. These were tested for respiratory pathogens by real-time polymerase chain reaction and classified as having a respiratory virus, bacteria, both or neither. Three hundred fifty-four participants scored the symptoms severity daily for 1 week in a diary (0 = absent to 4 = severe problem). RESULTS: Organisms were identified in 346/645 (53.6%) participants. There were differences in the prevalence of seven symptoms between the organism groups at baseline. Those with a virus alone, and those with both virus and bacteria, had higher average severity scores of all symptoms combined during the week of follow-up than those in whom no organisms were detected [adjusted mean differences 0.204 (95% confidence interval 0.010 to 0.398) and 0.348 (0.098 to 0.598), respectively]. There were no differences in the duration of symptoms rated as moderate or severe between organism groups. CONCLUSIONS: Differences in presenting symptoms and symptoms severity can be identified between patients with viruses and bacteria identified on throat swabs. The magnitude of these differences is unlikely to influence management. Most patients had mild symptoms at 7 days regardless of aetiology, which could inform patients about likely symptom duration

    Steady-state modulation of voltage-gated K+ channels in rat arterial smooth muscle by cyclic AMP-dependent protein kinase and protein phosphatase 2B

    Voltage-gated potassium channels (Kv) are important regulators of membrane potential in vascular smooth muscle cells, which is integral to controlling intracellular Ca2+ concentration and regulating vascular tone. Previous work indicates that Kv channels can be modulated by receptor-driven alterations of cyclic AMP-dependent protein kinase (PKA) activity. Here, we demonstrate that Kv channel activity is maintained by tonic activity of PKA. Whole-cell recording was used to assess the effect of manipulating PKA signalling on Kv and ATP-dependent K+ channels of rat mesenteric artery smooth muscle cells. Application of PKA inhibitors, KT5720 or H89, caused a significant inhibition of Kv currents. Tonic PKA-mediated activation of Kv appears maximal as application of isoprenaline (a β-adrenoceptor agonist) or dibutyryl-cAMP failed to enhance Kv currents. We also show that this modulation of Kv by PKA can be reversed by protein phosphatase 2B/calcineurin (PP2B). PKA-dependent inhibition of Kv by KT5720 can be abrogated by pre-treatment with the PP2B inhibitor cyclosporin A, or inclusion of a PP2B auto-inhibitory peptide in the pipette solution. Finally, we demonstrate that tonic PKA-mediated modulation of Kv requires intact caveolae. Pre-treatment of the cells with methyl-β-cyclodextrin to deplete cellular cholesterol, or adding caveolin-scaffolding domain peptide to the pipette solution to disrupt caveolae-dependent signalling each attenuated PKA-mediated modulation of the Kv current. These findings highlight a novel, caveolae-dependent, tonic modulatory role of PKA on Kv channels providing new insight into mechanisms and the potential for pharmacological manipulation of vascular tone

    Apparent Alkyl Transfer and Phenazine Formation via an Aryne Intermediate

    Treatment of chlorotriaryl derivatives 3a and 3d or fluorotriaryl derivatives 3b and 3e with potassium diisopropylamide afforded alkyl-shifted phenazine derivatives 5a/5b, rather than the expected 9-membered triazaorthocyclophane 2a. The phenazine derivatives were isolated in 78–98% yield depending on the halogen and alkyl group present. In the absence of the halogen (chloro or fluoro), the apparent alkyl shift proceeds more slowly and cannot proceed via the intermediacy of the aryne intermediate. Mechanistic possibilities include intramolecular nucleophilic attack on an aryne intermediate leading to a zwitterionic intermediate and alkyl transfer via a 5-endo-tet process, or via a Smiles rearrangement

    The STAGES view of red spirals and dusty red galaxies: Mass-dependent quenching of star-formation in cluster infall

    We investigate the properties of optically passive spirals and dusty red galaxies in the A901/2 cluster complex at redshift ~0.17 using restframe near-UV-optical SEDs, 24 micron IR data and HST morphologies from the STAGES dataset. The cluster sample is based on COMBO-17 redshifts with an rms precision of sigma_cz~2000 km/sec. We find that 'dusty red galaxies' and 'optically passive spirals' in A901/2 are largely the same phenomenon, and that they form stars at a substantial rate, which is only 4x lower than that in blue spirals at fixed mass. This star formation is more obscured than in blue galaxies and its optical signatures are weak. They appear predominantly in the stellar mass range of log M*/Msol=[10,11] where they constitute over half of the star-forming galaxies in the cluster; they are thus a vital ingredient for understanding the overall picture of star formation quenching in clusters. We find that the mean specific SFR of star-forming galaxies in the cluster is clearly lower than in the field, in contrast to the specific SFR properties of blue galaxies alone, which appear similar in cluster and field. Such a rich red spiral population is best explained if quenching is a slow process and morphological transformation is delayed even more. At log M*/Msol<10, such galaxies are rare, suggesting that their quenching is fast and accompanied by morphological change. We note, that edge-on spirals play a minor role; despite being dust-reddened they form only a small fraction of spirals independent of environment.Comment: Accepted for publication in MNRA
