    The Unity of Constitutional Values: A Comment on Ernest Caldwell\u27s Horizontal Rights and Chinese Constitutionalism: Judicialization through Labor Disputes

    Ernest Caldwell wants to defend Chinese constitutionalism from criticism, mainly from Western constitutional scholars or scholars who hold up Western constitutional patterns as an ideal. Caldwell makes both a \u27comparative\u27 claim and a \u27value\u27 claim. The comparative claim is that Chinese constitutional law must be understood on its own terms and that on these terms it does protect rights, even if it does not do so in the same way as Western constitutional law. The value claim is that the procedures in China\u27s legal system satisfy value concerns captured in the term \u27constitutionalism\u27 because they show how that system respects the supremacy of constitutional norms in a way that, though different from, is not inferior to Western constitutionalism. I take up and challenge both the comparative and the value claims. In particular, I argue, first, that one need not adopt the perspective that Chinese constitutional law must be seen entirely on its own terms and in a way that cannot be compared with Western models without generating misunderstanding. Second, I argue that Caldwell is mistaken in thinking that the value of judicial review can be satisfied by the horizontal rights review he finds in Chinese constitutional law

    One effort to increase maize productivity is by using marginal land for maize plantation. The marginal land that can be used is acid soil, but the problem are Al toxicity and low pH. To cope with these problems, cultivars having tolerance to Al toxicity and low pH are needed. Plant material used in this research were two maize varieties (Pioneer and Srikandi). Media selection is used there are 4 doses treatment aluminium (0, 250, 500 and 750 ppm AlCl3). All variables were observed except at the variable width of the leaf in this results showed that the treatment of aluminium (AlCl3) would not influence. Treatment combination Variety Srikandi and 250 ppm AlCl3 produces plant height, leaf length and leaf width is the shortest compared to other treatments. Variety Pioneer and Srikandi are suspected of varieties resistant aluminum and low pH values based on relative root length

    Novel Marine Compounds: Anticancer or Genotoxic?

    In the past several decades, marine organisms have generously gifted to the pharmaceutical industries numerous naturally bioactive compounds with antiviral, antibacterial, antimalarial, anti-inflammatory, antioxidant, and anticancer potentials. But till date only few anticancer drugs (cytarabine, vidarabine) have been commercially developed from marine compounds while several others are currently in different clinical trials. Majority of these compounds were tested in the tumor xenograft models, however, lack of anticancer potential data in the chemical- and/or oncogene-induced pre-initiation animal carcinogenesis models might have cost some of the marine anticancer compounds an early exit from the clinical trials. This review critically discusses importance of preclinical evaluation, failure of human clinical trials with certain potential anticancer agents, the screening tests used, and choice of biomarkers

Penyebabnya adalah kurangnya pemahaman ahli waris/ pihak-pihak yang terkait mengenai ilmu faraidh (Ilmu Waris). Teknologi informasi yang berkembang pesat idealnya mampu memberikan kontribusi kepada masyarakat Muslim untuk memudahkan dalam menghitung pembagian waris. Dalam penelitian ini, dibuat Perancangan Software aplikasi berorientasi objek untuk perhitungan bagian waris berdasarkan hukum waris Islam. Di dalam pemrograman berorientasi objek terdapat beberapa fitur berikut: Enkapsulasi (Encapsulation); Abstraksi (Abstraction); Pewarisan (Inheritance); dan Polimorfisme (Polymorphism). Abstract – The division an inheritance in the family is crucial, and has a potential to trigger conflicts in the family. The cause is a lack of understanding of the heir / related parties regarding the science of faraidh (the science of inheritance). Rapid development of information technology, ideally should be able to contribute to the Muslim community in calculating the division of inheritance. In this study, we designed an object-oriented application software to calculate inheritance based on the Islamic law. In the object-oriented programming are the following features: Encapsulation (Encapsulation); Abstraction, inheritance and polymorphism.     Linguistic Features and Bi-LSTM for Identification of Fake News

    With the spread of Internet technologies, the use of social media has increased exponentially. Although social media has many benefits, it has become the primary source of disinformation or fake news. The spread of fake news is creating many societal and economic issues. It has become very critical to develop an effective method to detect fake news so that it can be stopped, removed or flagged before spreading. To address the challenge of accurately detecting fake news, this paper proposes a solution called Statistical Word Embedding over Linguistic Features via Deep Learning (SWELDL Fake), which utilizes deep learning techniques to improve accuracy. The proposed model implements a statistical method called “principal component analysis” (PCA) on fake news textual representations to identify significant features that can help identify fake news. In addition, word embedding is employed to comprehend linguistic features and Bidirectional Long Short-Term Memory (Bi-LSTM) is utilized to classify news as true or fake. We used a benchmark dataset called SWELDL Fake to validate our proposed model, which has about 72,000 news articles collected from different benchmark datasets. Our model achieved a classification accuracy of 98.52% on fake news, surpassing the performance of state-of-the-art deep learning and machine learning models

    This review essay explores how Amartya Sen’s recent book, The Idea of Justice, is relevant and important for the development and assessment of transnational theories and applications to transnational justice and legal education programs. The essay captures a trans-jural dialogue of multinational scholars and teachers, discussing Sen’s contributions to moral justice theory (criticizing programs for “transcendental institutionalism” (like Rawlsian theory) and instead focusing on “comparative broadening” including empirical, relative, and comparative assessments of programs to ameliorate injustice in the world in its comparative concreteness (as in Indian social justice theory and Adam Smith’s Theory of Moral Sentiments and related work). The authors are professors in the transnational legal education program, the Center for Transnational Legal Studies, sponsored by over 25 different law schools, located in London. They teach courses in a wide variety of subjects, including comparative legal theory, constitutional law, business and legal ethics, moral and legal philosophy, international and comparative law, capital markets and business law, emergency powers, international dispute resolution and a variety of other common and civil law subjects

    Antimicrobial resistance among migrants in Europe: a systematic review and meta-analysis

    BACKGROUND: Rates of antimicrobial resistance (AMR) are rising globally and there is concern that increased migration is contributing to the burden of antibiotic resistance in Europe. However, the effect of migration on the burden of AMR in Europe has not yet been comprehensively examined. Therefore, we did a systematic review and meta-analysis to identify and synthesise data for AMR carriage or infection in migrants to Europe to examine differences in patterns of AMR across migrant groups and in different settings. METHODS: For this systematic review and meta-analysis, we searched MEDLINE, Embase, PubMed, and Scopus with no language restrictions from Jan 1, 2000, to Jan 18, 2017, for primary data from observational studies reporting antibacterial resistance in common bacterial pathogens among migrants to 21 European Union-15 and European Economic Area countries. To be eligible for inclusion, studies had to report data on carriage or infection with laboratory-confirmed antibiotic-resistant organisms in migrant populations. We extracted data from eligible studies and assessed quality using piloted, standardised forms. We did not examine drug resistance in tuberculosis and excluded articles solely reporting on this parameter. We also excluded articles in which migrant status was determined by ethnicity, country of birth of participants' parents, or was not defined, and articles in which data were not disaggregated by migrant status. Outcomes were carriage of or infection with antibiotic-resistant organisms. We used random-effects models to calculate the pooled prevalence of each outcome. The study protocol is registered with PROSPERO, number CRD42016043681. FINDINGS: We identified 2274 articles, of which 23 observational studies reporting on antibiotic resistance in 2319 migrants were included. The pooled prevalence of any AMR carriage or AMR infection in migrants was 25·4% (95% CI 19·1-31·8; I2 =98%), including meticillin-resistant Staphylococcus aureus (7·8%, 4·8-10·7; I2 =92%) and antibiotic-resistant Gram-negative bacteria (27·2%, 17·6-36·8; I2 =94%). The pooled prevalence of any AMR carriage or infection was higher in refugees and asylum seekers (33·0%, 18·3-47·6; I2 =98%) than in other migrant groups (6·6%, 1·8-11·3; I2 =92%). The pooled prevalence of antibiotic-resistant organisms was slightly higher in high-migrant community settings (33·1%, 11·1-55·1; I2 =96%) than in migrants in hospitals (24·3%, 16·1-32·6; I2 =98%). We did not find evidence of high rates of transmission of AMR from migrant to host populations. INTERPRETATION: Migrants are exposed to conditions favouring the emergence of drug resistance during transit and in host countries in Europe. Increased antibiotic resistance among refugees and asylum seekers and in high-migrant community settings (such as refugee camps and detention facilities) highlights the need for improved living conditions, access to health care, and initiatives to facilitate detection of and appropriate high-quality treatment for antibiotic-resistant infections during transit and in host countries. Protocols for the prevention and control of infection and for antibiotic surveillance need to be integrated in all aspects of health care, which should be accessible for all migrant groups, and should target determinants of AMR before, during, and after migration.     Prognostic model to predict postoperative acute kidney injury in patients undergoing major gastrointestinal surgery based on a national prospective observational cohort study.

    Background: Acute illness, existing co-morbidities and surgical stress response can all contribute to postoperative acute kidney injury (AKI) in patients undergoing major gastrointestinal surgery. The aim of this study was prospectively to develop a pragmatic prognostic model to stratify patients according to risk of developing AKI after major gastrointestinal surgery. Methods: This prospective multicentre cohort study included consecutive adults undergoing elective or emergency gastrointestinal resection, liver resection or stoma reversal in 2-week blocks over a continuous 3-month period. The primary outcome was the rate of AKI within 7 days of surgery. Bootstrap stability was used to select clinically plausible risk factors into the model. Internal model validation was carried out by bootstrap validation. Results: A total of 4544 patients were included across 173 centres in the UK and Ireland. The overall rate of AKI was 14·2 per cent (646 of 4544) and the 30-day mortality rate was 1·8 per cent (84 of 4544). Stage 1 AKI was significantly associated with 30-day mortality (unadjusted odds ratio 7·61, 95 per cent c.i. 4·49 to 12·90; P < 0·001), with increasing odds of death with each AKI stage. Six variables were selected for inclusion in the prognostic model: age, sex, ASA grade, preoperative estimated glomerular filtration rate, planned open surgery and preoperative use of either an angiotensin-converting enzyme inhibitor or an angiotensin receptor blocker. Internal validation demonstrated good model discrimination (c-statistic 0·65). Discussion: Following major gastrointestinal surgery, AKI occurred in one in seven patients. This preoperative prognostic model identified patients at high risk of postoperative AKI. Validation in an independent data set is required to ensure generalizability
