    Riding on the Coat-Tails of Traditional Cultural Expressions

    Matters related to the protection of traditional cultural expressions (‘TCEs’) or expressions of folklore (‘EoFs’) are sensitive and intricate as a blend of legal, economic, philosophical and anthropological considerations jostle to capture their core features. This results in disparate views surrounding what should qualify as TCEs or EoFs, who should be considered their ‘owner’ (assuming that ownership per se is conceptually compatible with these items), which is the most appropriate legal protection regime and how broad their scope of protection should be. Drawing from these various accounts on TCEs, this article focuses on the interaction between TCEs and EoFs originating on the European continent and the European Union (‘EU’) trade mark legislation. Specifically, this article examines whether the limitations of the effects of trade mark rights and of the absolute grounds of refusal, as developed by the case law of the Court of Justice of the European Union, are effective in preserving the cohesion of TCEs. This article advances the thesis that registration of TCEs and EoFs as trade marks generates an imbalance between the rights of the trade mark owner and the defences available to others under the EU trade mark law framework. Furthermore, such an imbalance is likely to hinder the unfettered circulation of TCEs and undermine their original meaning. Lastly, in some cases, trade mark registration of TCEs contributes to their appropriation and misappropriation. The article concludes that, de lege ferenda, the direct exclusion of TCEs as eligible subject matter for trade mark registration is preferable to seeking a post factum remedy

    Establishing usability heuristics for heuristics evaluation in a specific domain: is there a consensus?

    Heuristics evaluation is frequently employed to evaluate usability. While general heuristics are suitable to evaluate most user interfaces, there is still a need to establish heuristics for specific domains to ensure that their specific usability issues are identified. This paper presents a comprehensive review of 70 studies related to usability heuristics for specific domains. The aim of this paper is to review the processes that were applied to establish heuristics in specific domains and identify gaps in order to provide recommendations for future research and area of improvements. The most urgent issue found is the deficiency of validation effort following heuristics proposition and the lack of robustness and rigour of validation method adopted. Whether domain specific heuristics perform better or worse than general ones is inconclusive due to lack of validation quality and clarity on how to assess the effectiveness of heuristics for specific domains. The lack of validation quality also affects effort in improving existing heuristics for specific domain as their weaknesses are not addressed

    Tuberculosis is associated with expansion of a motile, permissive and immunomodulatory CD16(+) monocyte population via the IL-10/STAT3 axis

    The human CD14+ monocyte compartment is composed by two subsets based on CD16 expression. We previously reported that this compartment is perturbed in tuberculosis (TB) patients, as reflected by the expansion of CD16+ monocytes along with disease severity. Whether this unbalance is beneficial or detrimental to host defense remains to be elucidated. Here in the context of active TB, we demonstrate that human monocytes are predisposed to differentiate towards an anti-inflammatory (M2-like) macrophage activation program characterized by theCD16+CD163+MerTK+pSTAT3+ phenotype and functional properties such as enhanced protease-dependent motility, pathogen permissivity and immunomodulation. This process is dependent on STAT3 activation, and loss-of-function experiments point towards a detrimental role in host defense against TB. Importantly, we provide a critical correlation between the abundance of the CD16+CD163+MerTK+pSTAT3+ cells and the progression of the disease either at the local level in a non-human primate tuberculous granuloma context, or at the systemic level through the detection of the soluble form of CD163 in human sera. Collectively, this study argues for the pathogenic role of the CD16+CD163+MerTK+pSTAT3+ monocyte-to-macrophage differentiation program and its potential as a target for TB therapy,and promotes the detection of circulating CD163 as a potential biomarker for disease progression and monitoringof treatment efficacy.Fil: Lastrucci, Claire.     Information, Advocacy and Signposting as a Low-Level Support for Adults with High-Functioning Autism Spectrum Disorder: An Example from the UK

    ‘Low-level’ support is championed to support adults with high functioning autism spectrum disorder (HFASD) to achieve good quality health and social care, yet research in the area is sparse. Drawing on semi-structured interview data, this paper considers the efficacy of an intervention to provide low-level support to adults with HFASD with little or no funded support. The intervention led to a number of perceived positive outcomes for adults with HFASD, their families, and service providers in the city, including increased access to education, volunteering, support and information, socialising, improved health and wellbeing, and managing day-to-day. Although many of life’s difficulties still persisted, the intervention helped service users overcome barriers to availing further support, possibly leading to beneficial outcomes down the line

    Context. Dark nebulae display a surface brightness because dust grains scatter light of the general interstellar radiation field (ISRF). High- galactic-latitudes dark nebulae are seen as bright nebulae when surrounded by transparent areas which have less scattered light from the general galactic dust layer. Aims: Photometry of the bright dark nebulae LDN 1780, LDN 1642, and LBN 406 shall be used to derive scattering properties of dust and to investigate the presence of UV fluorescence emission by molecular hydrogen and the extended red emission (ERE). Methods: We used multi-wavelength optical photometry and imaging at ground-based telescopes and archival imaging and spectroscopic UV data from the spaceborn GALEX and SPEAR/FIMS instruments. In the analysis we used Monte Carlo RT and both observational data and synthetic models for the ISRF in the solar neighbourhood. The line-of-sight extinctions through the clouds have been determined using near infrared excesses of background stars and the 200/250 ÎŒm far infrared emission by dust as measured using the ISO and Herschel space observatories. Results: The optical surface brightness of the three target clouds can be explained in terms of scattered light. The dust albedo ranges from 0.58 at 3500 Å to 0.72 at 7500 Å. The spectral energy distribution of LDN 1780 is explained in terms of optical depth and background scattered light effects instead of the original published suggestion in terms of ERE. The far-ultraviolet surface brightness of LDN 1780 cannot be explained by scattered light only. In LDN 1780, H2 fluorescent emission in the wavelength range 1400-1700 Å has been detected and analysed. Conclusions: Our albedo values are in good agreement with the predictions of the dust model of Weingartner and Draine and with the THEMIS CMM model for evolved core-mantle grains. The distribution of H2 fluorescent emission in LDN 1780 shows a pronounced dichotomy with a strong preference for its southern side where enhanced illumination is impinging from the Sco OB2 association and the O star ζ Oph. A good correlation is found between the H2 fluorescence and a previously mapped 21-cm excess emission. The H2 fluorescence emission in LDN 1780 has been modelled using a PDR code; the resulting values for H2 column density and the total gas density are consistent with the estimates derived from CO observations and optical extinction along the line of sight.
