    El delito de negociaciones prohibidas a los funcionarios públicos en el ordenamiento jurídico español

    This study aims to assess the criminal concept of negotiations and activities prohibited to public officials as it is established in article 439 of the Spanish Criminal Code. It constitutes a criminal offence against the public administration that has hardly been investigated by the doctrine and upon which our courts have not ruled on. This contrasts with the usualness ofthese behaviours in practice, as the media often reports on the economic improvement experienced by certain family-owned businesses whose shareholders include elected representatives (mayors, town councillors…) or other types of abuse of office that could easily fit into this offence. That is why we will analyse its characteristics in depth and will give special attention to the recent reforms passed in 2010, in order to provide interpretative and criminal justice policy answers that can solve the problem.Este trabajo tiene por objeto analizar el tipo delictivo de negociaciones prohibidas a los funcionarios públicos de que trata el artículo 439 del Código Penal español, un delito contra la Administración Pública que prácticamente no ha sido investigado por la doctrina y sobre el que nuestros tribunales tampoco se han pronunciado, lo cual contrasta con lo habitual de estas conductas en la práctica, pues los medios de comunicación denuncian frecuentemente la mejora económica que experimentan determinadas empresas familiares cuyos representantes, elegidos para cargos públicos (alcaldes, concejales…), cometen ciertos abusos del cargo que podrían encuadrarse en este delito. Es por ello que a lo largo de este escrito se analizarán en profundidad los elementos típicos del delito en cuestión, con especial atención a los elementos modificados tras la reciente Reforma operada en 2010, y se propondrán soluciones interpretativas y político-criminales al respecto

    Degradación del ácido ascórbico en néctar de durazno enriquecido

    The objective of this work was to evaluate the effect of processing and storage conditions on the content of ascorbic acid (AA) in a commercial peach nectar, enriched with vitamin C. The total loss of AA during processing was 54.15%, occurring mainly during pasteurization and subsequent cooling. During storage, it was found that AA degradation is dependent on temperature and light exposure. Values of -0.0066, -0.0118 and -0.0171 day-1 were found for the degradation rate constant (k) for storage at 22 °C, without exposure to light; 22 °C, with exposure to light and 45 °C, without exposure to light, respectively.El objetivo de este trabajo fue evaluar el efecto del procesamiento y condiciones de almacenamiento sobre el contenido de ácido ascórbico (AA) en un néctar de durazno comercial, enriquecido con vitamina C. La pérdida total de AA durante el procesamiento fue de 54.15 %, ocurriendo principalmente durante la pasteurización y posterior enfriamiento. Durante el almacenamiento se comprobó que la degradación de AA es dependiente de la temperatura y exposición a la luz. Se encontraron valores para la constante de velocidad de degradación (k) de -0.0066, -0.0118 y -0.0171 dia-1 para el almacenamiento a 22 oC, sin exposición a la luz; 22 oC, con exposición a la luz y 45 oC, sin exposición a la luz, respectivamente

    Air pollution is a worldwide health problem, and metals are one of the various air pollutants to which living creatures are exposed. The pollution by metals such as: lead, cadmium, manganese, and vanadium have a common mechanism of action: the production of oxidative stress in the cell. Oxidative stress favors the production of free radicals, which damage biomolecules such as: DNA, proteins, lipids, and carbohydrates; these free radicals produce changes that are observed in different organs and systems. Vanadium is a transition element delivered into the atmosphere by the combustion of fossil fuels as oxides and adhered to the PM enters into the respiratory system, then crosses the alveolar wall and enters into the systemic circulation. In this chapter, we will review the oxidative stress induced by vanadium—as a common mechanism of metal pollutants—; in addition, we will review the protective effect of the antioxidants (carnosine and ascorbate)

    SummaryOrchids constitute one of the most spectacular radiations of flowering plants. However, their origin, spread across the globe, and hotspots of speciation remain uncertain due to the lack of an up-to-date phylogeographic analysis.We present a new Orchidaceae phylogeny based on combined high-throughput and Sanger sequencing data, covering all five subfamilies, 17/22 tribes, 40/49 subtribes, 285/736 genera, and c. 7% (1921) of the 29 524 accepted species, and use it to infer geographic range evolution, diversity, and speciation patterns by adding curated geographical distributions from the World Checklist of Vascular Plants.The orchids' most recent common ancestor is inferred to have lived in Late Cretaceous Laurasia. The modern range of Apostasioideae, which comprises two genera with 16 species from India to northern Australia, is interpreted as relictual, similar to that of numerous other groups that went extinct at higher latitudes following the global climate cooling during the Oligocene. Despite their ancient origin, modern orchid species diversity mainly originated over the last 5 Ma, with the highest speciation rates in Panama and Costa Rica.These results alter our understanding of the geographic origin of orchids, previously proposed as Australian, and pinpoint Central America as a region of recent, explosive speciation

    Role of age and comorbidities in mortality of patients with infective endocarditis

    [Purpose]: The aim of this study was to analyse the characteristics of patients with IE in three groups of age and to assess the ability of age and the Charlson Comorbidity Index (CCI) to predict mortality. [Methods]: Prospective cohort study of all patients with IE included in the GAMES Spanish database between 2008 and 2015.Patients were stratified into three age groups:<65 years,65 to 80 years,and ≥ 80 years.The area under the receiver-operating characteristic (AUROC) curve was calculated to quantify the diagnostic accuracy of the CCI to predict mortality risk. [Results]: A total of 3120 patients with IE (1327 < 65 years;1291 65-80 years;502 ≥ 80 years) were enrolled.Fever and heart failure were the most common presentations of IE, with no differences among age groups.Patients ≥80 years who underwent surgery were significantly lower compared with other age groups (14.3%,65 years; 20.5%,65-79 years; 31.3%,≥80 years). In-hospital mortality was lower in the <65-year group (20.3%,<65 years;30.1%,65-79 years;34.7%,≥80 years;p < 0.001) as well as 1-year mortality (3.2%, <65 years; 5.5%, 65-80 years;7.6%,≥80 years; p = 0.003).Independent predictors of mortality were age ≥ 80 years (hazard ratio [HR]:2.78;95% confidence interval [CI]:2.32–3.34), CCI ≥ 3 (HR:1.62; 95% CI:1.39–1.88),and non-performed surgery (HR:1.64;95% CI:11.16–1.58).When the three age groups were compared,the AUROC curve for CCI was significantly larger for patients aged <65 years(p < 0.001) for both in-hospital and 1-year mortality. [Conclusion]: There were no differences in the clinical presentation of IE between the groups. Age ≥ 80 years, high comorbidity (measured by CCI),and non-performance of surgery were independent predictors of mortality in patients with IE.CCI could help to identify those patients with IE and surgical indication who present a lower risk of in-hospital and 1-year mortality after surgery, especially in the <65-year group

    Search for new particles in events with energetic jets and large missing transverse momentum in proton-proton collisions at root s=13 TeV

    A search is presented for new particles produced at the LHC in proton-proton collisions at root s = 13 TeV, using events with energetic jets and large missing transverse momentum. The analysis is based on a data sample corresponding to an integrated luminosity of 101 fb(-1), collected in 2017-2018 with the CMS detector. Machine learning techniques are used to define separate categories for events with narrow jets from initial-state radiation and events with large-radius jets consistent with a hadronic decay of a W or Z boson. A statistical combination is made with an earlier search based on a data sample of 36 fb(-1), collected in 2016. No significant excess of events is observed with respect to the standard model background expectation determined from control samples in data. The results are interpreted in terms of limits on the branching fraction of an invisible decay of the Higgs boson, as well as constraints on simplified models of dark matter, on first-generation scalar leptoquarks decaying to quarks and neutrinos, and on models with large extra dimensions. Several of the new limits, specifically for spin-1 dark matter mediators, pseudoscalar mediators, colored mediators, and leptoquarks, are the most restrictive to date.Peer reviewe

    Combined searches for the production of supersymmetric top quark partners in proton-proton collisions at root s=13 TeV

    A combination of searches for top squark pair production using proton-proton collision data at a center-of-mass energy of 13 TeV at the CERN LHC, corresponding to an integrated luminosity of 137 fb(-1) collected by the CMS experiment, is presented. Signatures with at least 2 jets and large missing transverse momentum are categorized into events with 0, 1, or 2 leptons. New results for regions of parameter space where the kinematical properties of top squark pair production and top quark pair production are very similar are presented. Depending on themodel, the combined result excludes a top squarkmass up to 1325 GeV for amassless neutralino, and a neutralinomass up to 700 GeV for a top squarkmass of 1150 GeV. Top squarks with masses from 145 to 295 GeV, for neutralino masses from 0 to 100 GeV, with a mass difference between the top squark and the neutralino in a window of 30 GeV around the mass of the top quark, are excluded for the first time with CMS data. The results of theses searches are also interpreted in an alternative signal model of dark matter production via a spin-0 mediator in association with a top quark pair. Upper limits are set on the cross section for mediator particle masses of up to 420 GeV

    Ante escenarios complejos, patriarcales y desoladores que dejan ver el neoliberalismo, la globalización agroalimentaria, el calentamiento global y las contaminaciones de granos nativos por la imposición de transgénicos, nos cuestionamos si existen algunas alternativas para preservar el maíz nativo como un recurso multiestratégico (alimentario, económico, cultural, ecológico y tecnológico) tomando en cuenta las condiciones actuales de desigualdades sociales de género, etnia, clases y edad que predominan en el campo mexicano. Para responder a algunos cuestionamientos, este libro presenta algunas alternativas a través de diversas experiencias femeninas y de relaciones de género en torno al maíz y la alimentación. Todas ellas muestran que es posible construir una masa crítica para salvaguardar el maíz nativo bajo esas condiciones desoladoras, pero siempre y cuando se “voltee la tortilla”, metáfora que da pie al inicio de otra realidad humanizada y en sincronía con la naturaleza.Proyecto realizado con financiamiento Conacy
