    Introduction: Legitimacy and International Courts

    Legitimacy and International Courts examines the underpinnings of legitimacy, or the justification of the authority, of international courts and tribunals. It brings together an esteemed group of authors, noted for both their expertise in individual courts, tribunals, or other adjudicatory bodies, and their work on legitimacy, effectiveness, and governance more broadly, to consider the legitimacy of international courts from a comparative perspective. Authors explore what strengthens and weakens the legitimacy of various different international courts, while also considering broader theories of international court legitimacy. Some chapters highlight the sociological or normative legitimacy of specific courts or tribunals, while others address cross-cutting issues such as representation, democracy, independence and effectiveness. This Introduction surveys some of the key contributions of this volume and distills some of the lessons of its varied chapters for the legitimacy of international courts. Parts II and III are largely conceptual in approach, exploring what legitimacy means for each and all of the courts. Part IV takes a more functional approach, exploring how various factors internal or external to particular courts have contributed to those courts’ normative or sociological legitimacy. Part V provides thumbnail summaries of each the chapters that follow

    A Principle of Subsidiarity regulates the allocation and/or use of authority within a political order where authority is dispersed between a centre and various sub-units. Section 1 sketches the role of such principle of subsidiarity in the EU, and some of its significance in Canada. Section 2 presents some conceptions of subsidiarity that indicate the range of alternatives. Section 3 considers some areas where such conceptions might add value to constitutional and political deliberations in Canada. Section 4 concludes with some reminders of crucial contested issues not fully resolved by appeals to subsidiarity alone, exemplified by the protection of human rights.Un principe de subsidiarité réglemente la répartition et/ou l’usage de l’autorité au sein d’un ordre politique où l’autorité est dispersée entre un centre et des sous-unités variées. La section 1 de cet article montre le rôle d’un tel principe de subsidiarité dans l’Union européenne, et certaines de ses implications au Canada. La section 2 présente des conceptions de la subsidiarité qui indiquent un éventail d’alternatives.     No exit from the euro-rescuing trap?

    This paper attempts a normative assessment of the input and output-oriented legitimacy of the present euro-rescuing regime on the basis of policy analyses examining the causes of present crises, the available policy options, and the impact of the policies actually chosen. Concluding that the regime lacks input-oriented legitimacy and that its claim to output-oriented legitimacy is ambivalent at best, the paper explores potential – majoritarian or unilateral – exits from the present institutional constellation that is characterized by the synthesis of a non-democratic expertocracy and an extremely asymmetric intergovernmental bargaining system.Die hier präsentierte normative Bewertung der input- und outputorientierten Legitimität des gegenwärtigen Euro-Rettungs-Regimes stützt sich auf empirisch fundierte Aussagen zu den Ursachen der Eurokrise, den prinzipiell verfügbaren Politik-Optionen und den Wirkungen der gewählten Politik. Im Ergebnis wird eine inputorientierte Legitimation verneint, während die outputorientierte Bewertung höchst ambivalent erscheint.     Supporting the role of small farms in the European regional food systems: What role for the science-policy interface?

    [EN] Small farms dominate the European agricultural landscape, but they are much less represented in agricultural decision-making structures than larger farms. The weak political representation of small farms diminishes the degree to which their needs are addressed in public agricultural policies and support measures. This under representation has been constraining small farms? contribution to food and nutrition security and sustainability. This paper explores the science ? policy interface as boundary networks between researchers and policy-makers, to generate policies that are better-informed and better tailored to small farms? situations. It gathers researchers? experiences, from the Horizon 2020 project SALSA, through a range of project-generated activities and knowledge, of their engagement in the policy process. From the case studies analyzed, three types of SPI emerge: expert advice, networking platform and collaborative governance.
