La lucha contra la impunidad del crimen de desaparición forzada en el marco de sentencias en contra del Estado colombiano por parte de la Corte Interamericana de Derechos Humanos
25 p.El presente escrito abordará la complejidad del fenómeno de las desapariciones forzadas desde varios enfoques. Primero se estudiarán los instrumentos internacionales, a saber, la Convención internacional para la protección de personas contra la desaparición forzada (en adelante, CIPCDF), la Convención Interamericana contra la desaparición forzada (en adelante, CICDF) y el cumplimiento del Estado colombiano a sus obligaciones internacionales adquiridas con la adopción de dichos textos. En segundo lugar, se revisarán las sentencias de la Corte Interamericana de Derechos Humanos (en adelante, Corte IDH) que condenan al Estado colombiano y lo obligan a tomar medidas de rehabilitación en salud; se examinan, en especial, aquellas en las que se condenó al Estado colombiano por la comisión de desapariciones forzadas, referentes a los casos de diecinueve comerciantes, masacre de Pueblo Bello y Mapiripán. Asimismo, se analizan las dificultades en el cumplimiento de dichas sentencias, en el marco de los procesos de concertación y supervisión. Por último, se precisarán algunas conclusiones y se harán las observaciones pertinentes, a fin de entender mejor un fenómeno que ha pasado inadvertido para la opinión pública y que ha sido poco reconocido por autoridades oficiales, dada su propia naturaleza (Centro Nacional de Memoria Histórica, 2013), lo que contribuye a mantener un statu quo de impunidad propio de América Latina.Libro resultado de investigación denominada “Cumplimiento de las sentencias de la Corte Interamericana de Derechos Humanos: revisión del caso colombiano en perspectiva comparada”. The main objective of this study is to analyze the similarities and differences that arise inside international criminal courts regarding the concept of victim, as opposed to the provisions established by the International Human Rights Law. A qualitative research applied throughout the project concluded that, in spite of the differences in the interpretation that each Court gives to the concept of victim, they strive to grant the victims a position that upholds the law within an established criminal process, approaching what is instituted by the jurisprudence of Regional Human Rights Courts.El objetivo principal del presente estudio se enfoca en analizar las similitudes y divergencias que se presentan al interior de los tribunales penales internacionales respecto al concepto de víctima; lo anterior, en oposición a lo establecido por el Derecho Internacional de los Derechos Humanos. Una investigación de carácter cualitativo aplicada a lo largo del proyecto permitió concluir que a pesar de la interpretación que concede cada tribunal al concepto de víctima, estos se esfuerzan por conceder una posición garantista a esta dentro del proceso penal establecido, que se acerca a lo instituido por la jurisprudencia de cortes regionales de derechos humanos.O principal objetivo deste estudo é analisar as semelhanças e diferenças que surgem dentro de tribunais penais internacionais sobre o conceito de vítima, em oposição às disposições es- tabelecidas pelo Direito Internacional dos Direitos Humanos. A pesquisa qualitativa aplicada em todo o projeto concluiu que, apesar das diferenças na interpretação de que cada tribunal dá ao conceito de vítima, eles se esforçam para conceder as vítimas uma posição que defende a lei dentro de um processo penal estabelecida, aproximando-se o que é instituído pela jurisprudência dos Tribunais regionais de Direitos Humanos
Eficacia del Sistema Interamericano de Derechos Humanos
144 p.El grupo Persona, instituciones y exigencias de justicia, perteneciente al Centro de Investigaciones Sociojurídicas, de la Universidad Católica de Colombia (CISJUC), presenta a la comunidad académica colombiana y latinoamericana este informe sobre el cumplimiento o no del Estado colombiano de las condenas impuestas a él por parte de la Corte Interamericana de Derechos Humanos (CIDH).
Podremos ver cuatro capítulos. En el primero se trata el tema de la eficacia en general de la sentencias de la CIDH en el caso colombiano; en el segundo se detalla cada una de ellas; en el tercero se hace énfasis en las desapariciones forzadas; y en el cuarto se aborda el control de convencionalidad en dos casos concretos.
Este informe muestra una triste realidad: la violación sistemática de derechos humanos por parte de quienes, en razón de la sacralidad de su función dentro del Estado, deberían evitarla. A pesar de lo anterior, hay que reconocer que se han tomado algunos paliativos jurídicos que aligeran el espíritu tanto por la CIDH como por la justicia local colombiana.
No obstante, debemos decir que ha llegado la hora de poner fin a tanta desolación jurídica y moral mediante la concientización del deber moral de la paz: Este deber moral de la paz concierne al Estado y a todos; al Estado, que vive ante todo lo que un pensador colombiano denomina la “justicia judicial”, hoy tan de capa caída y a los ciudadanos, si asumimos lo que Aristóteles llamaba la “justicia legal”, también en crisis, como se observa cuando un ciudadano poco ciudadano de la élite, al ser capturado ebrio por unos policías en cumplimiento de su deber, afirma: “Ustedes no saben quién soy yo”. The Fourteenth Data Release of the Sloan Digital Sky Survey: First Spectroscopic Data from the extended Baryon Oscillation Spectroscopic Survey and from the second phase of the Apache Point Observatory Galactic Evolution Experiment
The fourth generation of the Sloan Digital Sky Survey (SDSS-IV) has been in
operation since July 2014. This paper describes the second data release from
this phase, and the fourteenth from SDSS overall (making this, Data Release
Fourteen or DR14). This release makes public data taken by SDSS-IV in its first
two years of operation (July 2014-2016). Like all previous SDSS releases, DR14
is cumulative, including the most recent reductions and calibrations of all
data taken by SDSS since the first phase began operations in 2000. New in DR14
is the first public release of data from the extended Baryon Oscillation
Spectroscopic Survey (eBOSS); the first data from the second phase of the
Apache Point Observatory (APO) Galactic Evolution Experiment (APOGEE-2),
including stellar parameter estimates from an innovative data driven machine
learning algorithm known as "The Cannon"; and almost twice as many data cubes
from the Mapping Nearby Galaxies at APO (MaNGA) survey as were in the previous
release (N = 2812 in total). This paper describes the location and format of
the publicly available data from SDSS-IV surveys. We provide references to the
important technical papers describing how these data have been taken (both
targeting and observation details) and processed for scientific use. The SDSS
website (www.sdss.org) has been updated for this release, and provides links to
data downloads, as well as tutorials and examples of data use. SDSS-IV is
planning to continue to collect astronomical data until 2020, and will be

Measurement of the cosmic ray spectrum above eV using inclined events detected with the Pierre Auger Observatory
A measurement of the cosmic-ray spectrum for energies exceeding
eV is presented, which is based on the analysis of showers
with zenith angles greater than detected with the Pierre Auger
Observatory between 1 January 2004 and 31 December 2013. The measured spectrum
confirms a flux suppression at the highest energies. Above
eV, the "ankle", the flux can be described by a power law with
index followed by
a smooth suppression region. For the energy () at which the
spectral flux has fallen to one-half of its extrapolated value in the absence
of suppression, we find

Energy Estimation of Cosmic Rays with the Engineering Radio Array of the Pierre Auger Observatory
The Auger Engineering Radio Array (AERA) is part of the Pierre Auger
Observatory and is used to detect the radio emission of cosmic-ray air showers.
These observations are compared to the data of the surface detector stations of
the Observatory, which provide well-calibrated information on the cosmic-ray
energies and arrival directions. The response of the radio stations in the 30
to 80 MHz regime has been thoroughly calibrated to enable the reconstruction of
the incoming electric field. For the latter, the energy deposit per area is
determined from the radio pulses at each observer position and is interpolated
using a two-dimensional function that takes into account signal asymmetries due
to interference between the geomagnetic and charge-excess emission components.
The spatial integral over the signal distribution gives a direct measurement of
the energy transferred from the primary cosmic ray into radio emission in the
AERA frequency range. We measure 15.8 MeV of radiation energy for a 1 EeV air
shower arriving perpendicularly to the geomagnetic field. This radiation energy
-- corrected for geometrical effects -- is used as a cosmic-ray energy
estimator. Performing an absolute energy calibration against the
surface-detector information, we observe that this radio-energy estimator
scales quadratically with the cosmic-ray energy as expected for coherent
emission. We find an energy resolution of the radio reconstruction of 22% for
the data set and 17% for a high-quality subset containing only events with at

Measurement of the Radiation Energy in the Radio Signal of Extensive Air Showers as a Universal Estimator of Cosmic-Ray Energy
We measure the energy emitted by extensive air showers in the form of radio
emission in the frequency range from 30 to 80 MHz. Exploiting the accurate
energy scale of the Pierre Auger Observatory, we obtain a radiation energy of
15.8 \pm 0.7 (stat) \pm 6.7 (sys) MeV for cosmic rays with an energy of 1 EeV
arriving perpendicularly to a geomagnetic field of 0.24 G, scaling
quadratically with the cosmic-ray energy. A comparison with predictions from
state-of-the-art first-principle calculations shows agreement with our
measurement. The radiation energy provides direct access to the calorimetric
energy in the electromagnetic cascade of extensive air showers. Comparison with
our result thus allows the direct calibration of any cosmic-ray radio detector
against the well-established energy scale of the Pierre Auger Observatory.Comment: Replaced with published version. Added journal reference and DOI.

Sloan Digital Sky Survey IV: mapping the Milky Way, nearby galaxies, and the distant universe
We describe the Sloan Digital Sky Survey IV (SDSS-IV), a project encompassing three major spectroscopic programs. The Apache Point Observatory Galactic Evolution Experiment 2 (APOGEE-2) is observing hundreds of thousands of Milky Way stars at high resolution and high signal-to-noise ratios in the near-infrared. The Mapping Nearby Galaxies at Apache Point Observatory (MaNGA) survey is obtaining spatially resolved spectroscopy for thousands of nearby galaxies (median ). The extended Baryon Oscillation Spectroscopic Survey (eBOSS) is mapping the galaxy, quasar, and neutral gas distributions between and 3.5 to constrain cosmology using baryon acoustic oscillations, redshift space distortions, and the shape of the power spectrum. Within eBOSS, we are conducting two major subprograms: the SPectroscopic IDentification of eROSITA Sources (SPIDERS), investigating X-ray AGNs and galaxies in X-ray clusters, and the Time Domain Spectroscopic Survey (TDSS), obtaining spectra of variable sources. All programs use the 2.5 m Sloan Foundation Telescope at the Apache Point Observatory; observations there began in Summer 2014. APOGEE-2 also operates a second near-infrared spectrograph at the 2.5 m du Pont Telescope at Las Campanas Observatory, with observations beginning in early 2017. Observations at both facilities are scheduled to continue through 2020. In keeping with previous SDSS policy, SDSS-IV provides regularly scheduled public data releases; the first one, Data Release 13, was made available in 2016 July
