    O presente trabalho tem como objeto o regime jurídico da responsabilidade civil dos administradores de instituições financeiras na concessão do crédito. A gestão temerária de instituição financeira representa inobservância aos deveres de conduta provenientes de normas legais e regulatórias, todas voltadas, direta ou indiretamente, à mitigação dos riscos bancários, integridade da instituição e estabilidade do sistema financeiro. Demonstrada a existência de deveres a serem observados pelos administradores na concessão de crédito, em especial potencializados pela especialidade da matéria, serão examinados os efeitos desta violação, em especial sob a ótica de que a responsabilidade civil subjetiva dos administradores com necessária demonstração de culpa se presta para concretização de função preventiva da responsabilidade civil, garantindo estímulo a comportamento zeloso e voltado à mitigação de riscos e estabilidade financeira.This dissertation seeks to analyze the legal regime of the banking institutions directors‟ duties and liabilities during banking loans analysis and approval. The careless management of a banking institution stand for a failure to comply with behavioral duties originated from legal and regulatory standards, all of which are, by directly or indirectly intention, pointed to bank risks management, integrity of the financial institution and financial system‟ stability. Demonstrated the existence of behavioral duties to be observed by the directors and officers during banking loans analysis and approval, potentiated by the specialty of the banking commercial activity, will also be analyzed the effects of those duties inobservance, especially by the optics that the directors‟ liability depending on demonstration of fault offers and preventive function for directors‟ liability, stimulating zealous behavior towards bank risks management and financial stability

    We construct strongly mixing invariant measures with full support for operators on F-spaces which satisfy the Frequent Hypercyclicity Criterion.     A estrutura carcerária brasileira torna o cumprimento de pena um ato ilícito face às violações de direitos humanos. Assim, Resolução da Corte Interamericana de Direitos Humanos (2018) determinou, no caso em análise, o cômputo em dobro do tempo de privação de liberdade cumprido. Criou-se um problema: cabe ao Poder Judiciário determinar o cômputo em dobro do tempo de cumprimento de pena privativa de liberdade para pessoas encarceradas em outros estabelecimentos? Através de pesquisa bibliográfica, abordagem qualitativa e fins exploratórios, conclui-se que a Constituição permite a formação de um “bloco de constitucionalidade” protetor dos direitos humanos, possibilitando esse entendimento

    Malignancy in Guillain-Barré syndrome:A twelve-year single-center study

    The relationship between Guillain-Barré syndrome (GBS) and malignancy is uncertain. We retrospectively analyzed data of 118 consecutive patients admitted with GBS from Birmingham, U.K. (2001 − 2012). We calculated relative cancer risk using different definitions and determined characteristics of malignancy-associated GBS. Malignancy was globally commoner in our GBS cohort compared to the general population (odds ratio: 2.08; CI: 1.06–3.71; p = 0.036). However, this was unconfirmed if paraneoplastic criteria were applied. GBS patients with cancer were significantly more likely to be older (p = 0.043), hyponatremic (p = 0.037) and demonstrate more axonal loss (p < 0.05). Cerebrospinal fluid (CSF) protein levels were lower in the malignancy group (p = 0.002) and neurological improvement less likely (p = 0.023). In-patient mortality was significantly higher in patients with malignancy (p < 0.01). We conclude global cancer risk is higher in GBS than in the general population, although definition-dependent. Malignancy requires consideration in elderly, hyponatremic subjects with normal CSF protein, severe axonal loss, who fail to improve post-treatment

    Modeling Slope Instability as Shear Rupture Propagation in a Saturated Porous Medium

    When a region of intense shear in a slope is much thinner than other relevant geometric lengths, this shear failure may be approximated as localized slip, as in faulting, with strength determined by frictional properties of the sediment and effective stress normal to the failure surface. Peak and residual frictional strengths of submarine sediments indicate critical slope angles well above those of most submarine slopes—in contradiction to abundant failures. Because deformation of sediments is governed by effective stress, processes affecting pore pressures are a means of strength reduction. However, common methods of exami ning slope stability neglect dynamically variable pore pressure during failure. We examine elastic-plastic models of the capped Drucker-Prager type and derive approximate equations governing pore pressure about a slip surface when the adjacent material may deform plastically. In the process we identify an elastic-plastic hydraulic diffusivity with an evolving permeability and plastic storage term analogous to the elastic term of traditional poroelasticity. We also examine their application to a dynamically propagating subsurface rupture and find indications of downslope directivity.Earth and Planetary SciencesEngineering and Applied Science

    Specific requirements of MRFs for the expression of muscle specific microRNAs, miR-1, miR-206 and miR-133

    The expression of three microRNAs, miR-1, miR-206 and miR-133 is restricted to skeletal myoblasts and cardiac tissue during embryo development and muscle cell differentiation, which suggests a regulation by muscle regulatory factors (MRFs). Here we show that inhibition of C2C12 muscle cell differentiation by FGFs, which interferes with the activity of MRFs, suppressed the expression of miR-1, miR-206 and miR-133. To further investigate the role of myogenic regulators (MRFs), Myf5, MyoD, Myogenin and MRF4 in the regulation of muscle specific microRNAs we performed gain and loss-of-function experiments in vivo, in chicken and mouse embryos. We found that directed expression of MRFs in the neural tube of chicken embryos induced ectopic expression of miR-1 and miR-206. Conversely, the lack of Myf5 but not of MyoD resulted in a loss of miR-1 and miR-206 expression. Taken together our results demonstrate differential requirements of distinct MRFs for the induction of microRNA gene expression during skeletal myogenesis

    Weak redshift discretisation in the Local Group of Galaxies?

    We discuss the distribution of radial velocities of galaxies belonging to the Local Group. Two independent samples of galaxies as well as several methods of reduction from the heliocentric to the galactocentric radial velocities are explored. We applied the power spectrum analysis using the Hann function as a weighting method, together with the jackknife error estimation. We performed a detailed analysis of this approach. The distribution of galaxy redshifts seems to be non-random. An excess of galaxies with radial velocities of 24kms1\sim 24 {km} \cdot {s}^{-1} and 36kms1\sim 36 {km} \cdot {s}^{-1} is detected, but the effect is statistically weak. Only one peak for radial velocities of 24kms1\sim 24 {km} \cdot {s}^{-1} seems to be confirmed at the confidence level of 95%.Comment: 23 pages 7 figures Astronomische Nachrichten accepte
