    Inetianbor and Green: How Two Payday Loan Disputes Illustrate the Integrality Rule’s Incompatibility with the FAA

    The integrality rule is a rule grounded in the analysis of party intent and allows for an arbitration agreement to be vitiated if the selected forum is unavailable and the forum was integral to the agreement. The integrality rule, conceived in 1990, has a short history, and while it is followed by several federal appellate circuits, it is not consistently named or referenced. The Eleventh Circuit applied the rule in Inetianbor v. CashCall, Inc., where the court precluded arbitration due to the integrality rule. This case raises questions of whether the integrality rule contradicts the Federal Arbitration Act (FAA), whether it overrides the parties’ decision to arbitrate their disputes, and whether it runs counter to the Supreme Court’s insistence that courts should not add obstructions to arbitration beyond the FAA

    The purpose of mess in action research: building rigour though a messy turn

    Mess and rigour might appear to be strange bedfellows. This paper argues that the purpose of mess is to facilitate a turn towards new constructions of knowing that lead to transformation in practice (an action turn). Engaging in action research - research that can disturb both individual and communally held notions of knowledge for practice - will be messy. Investigations into the 'messy area', the interface between the known and the nearly known, between knowledge in use and tacit knowledge as yet to be useful, reveal the 'messy area' as a vital element for seeing, disrupting, analysing, learning, knowing and changing. It is the place where long-held views shaped by professional knowledge, practical judgement, experience and intuition are seen through other lenses. It is here that reframing takes place and new knowing, which has both theoretical and practical significance, arises: a 'messy turn' takes place

    A Neuromuscular Training Program Performed on Foam is Accompanied by Improved Balance and Jump Height in Recreational Runners

    Purpose: To assess balance, plyometric performance, and strength of recreational runners completing a neuromuscular training (NMT) program on a novel foam surface. Methods: After baseline testing, participants (n=14) completed 22-minute exercise sessions on foam twice weekly for eight weeks, and a post-training testing battery. Testing included lower quarter Y-balance test (LQYBT), dynamic leap and balance test (DLBT), squat jump and countermovement jump tests, and isometric strength testing of the foot and ankle via handheld dynamometry (HHD). Participants were asked to maintain their normal running routines throughout the study period and report any training missed due to injury. Results: Participants demonstrated significant (pConclusion: This study supports the use of progressive NMT on foam as a feasible intervention for recreational runners as all participants maintained typical running routines and reported no injuries. While further research is needed to directly inform possible effects of NMT on foam on injury risk and running performance, the improvements in single leg dynamic balance, lower body plyometric performance, and some indices of lower extremity strength in the present study suggest the efficacy of NMT performed on foam

    The discourse dynamics approach to metaphor and metaphor-led discourse analysis

    The use of metaphor as a tool to uncover people's ideas, attitudes, and values through analysis of discourse is demonstrated and illustrated with data collected in a social science research project. A 'discourse dynamics' approach to metaphor situated within a complexity/dynamic systems perspective is developed. This approach is turned into a method of 'metaphor-led discourse analysis' which is described in detail, using a focus group discussion to illustrate the procedure: transcription, metaphor identification, coding metaphors and using software, and finding patterns of metaphor use from coded data. The reasoning that justifies decisions at each stage of the procedure is made explicit so that the trustworthiness of the method can be maximized. The method of metaphor-led discourse analysis has been developed through a series of empirical projects to be accessible and relevant to social science researchers as well as to metaphor scholars

    Derivation of High Spatial Resolution Albedo from UAV Digital Imagery:Application over the Greenland Ice Sheet

    Measurements of albedo are a prerequisite for modeling surface melt across the Earth's cryosphere, yet available satellite products are limited in spatial and/or temporal resolution. Here, we present a practical methodology to obtain centimeter resolution albedo products with accuracies of ?5% using consumer-grade digital camera and unmanned aerial vehicle (UAV) technologies. Our method comprises a workflow for processing, correcting and calibrating raw digital images using a white reference target, and upward and downward shortwave radiation measurements from broadband silicon pyranometers. We demonstrate the method with a set of UAV sorties over the western, K-sector of the Greenland Ice Sheet. The resulting albedo product, UAV10A1, covers 280 km2, at a resolution of 20 cm per pixel and has a root-mean-square difference of 3.7% compared to MOD10A1 and 4.9% compared to ground-based broadband pyranometer measurements. By continuously measuring downward solar irradiance, the technique overcomes previous limitations due to variable illumination conditions during and between surveys over glaciated terrain. The current miniaturization of multispectral sensors and incorporation of upward facing radiation sensors on UAV packages means that this technique could become increasingly common in field studies and used for a wide range of applications.     Behavioural activation therapy for depression after stroke (BEADS): a study protocol for a feasibility randomised controlled pilot trial of a psychological intervention for post-stroke depression

    Background There is currently insufficient evidence for the clinical and cost-effectiveness of psychological therapies for treating post-stroke depression. Methods/Design BEADS is a parallel group feasibility multicentre randomised controlled trial with nested qualitative research and economic evaluation. The aim is to evaluate the feasibility of undertaking a full trial comparing behavioural activation (BA) to usual stroke care for 4 months for patients with post-stroke depression. We aim to recruit 72 patients with post-stroke depression over 12 months at three centres, with patients identified from the National Health Service (NHS) community and acute services and from the voluntary sector. They will be randomly allocated to receive behavioural activation in addition to usual care or usual care alone. Outcomes will be measured at 6 months after randomisation for both participants and their carers, to determine their effectiveness. The primary clinical outcome measure for the full trial will be the Patient Health Questionnaire-9 (PHQ-9). Rates of consent, recruitment and follow-up by centre and randomised group will be reported. The acceptability of the intervention to patients, their carers and therapists will also be assessed using qualitative interviews. The economic evaluation will be undertaken from the National Health Service and personal social service perspective, with a supplementary analysis from the societal perspective. A value of information analysis will be completed to identify the areas in which future research will be most valuable. Discussion The feasibility outcomes from this trial will provide the data needed to inform the design of a definitive multicentre randomised controlled trial evaluating the clinical and cost-effectiveness of behavioural activation for treating post-stroke depression

    Using the framework method for the analysis of qualitative data in multi-disciplinary health research

    Background: The Framework Method is becoming an increasingly popular approach to the management and analysis of qualitative data in health research. However, there is confusion about its potential application and limitations. Discussion. The article discusses when it is appropriate to adopt the Framework Method and explains the procedure for using it in multi-disciplinary health research teams, or those that involve clinicians, patients and lay people. The stages of the method are illustrated using examples from a published study. Summary. Used effectively, with the leadership of an experienced qualitative researcher, the Framework Method is a systematic and flexible approach to analysing qualitative data and is appropriate for use in research teams even where not all members have previous experience of conducting qualitative research

    Searches for new resonances in the diphoton final state, with spin 0 as predicted by theories with an extended Higgs sector and with spin 2 using a warped extra-dimension benchmark model, are presented using 139 fb−1 of √ s =13 TeV pp collision data collected by the ATLAS experiment at the LHC. No significant deviation from the Standard Model is observed and upper limits are placed on the production cross-section times branching ratio to two photons as a function of the resonance mass.publishedVersio

    Developing mixed methods research in sport and exercise psychology: Critical reflections on five points of controversy

Objectives: To stimulate debate in sport and exercise psychology about the nature of mixed methods research as currently practiced and how this approach might develop in the future. Design: An exploration of five points of controversy relating to mixed methods research. Method: A presentation of critical reflections on the following. (1) Mixing methods as a non-debate, (2) Purists, pragmatists and mixing paradigms, (3) Integrating findings and representational forms, (4) Judgment criteria and mixed methods research, and (5) Power, politics and what counts in mixed methods research. Results: The examples provided of mixed methods research in action indicate that a number of problematic issues regarding both process and product have been neglected. Conclusions: Mixed methods research offers a number of conceptual, practical and pedagogical challenges that need to be addressed if this form of inquiry is to develop its full potential in sport and exercise psychology
