    Practicing Culturally Competent Therapeutic Jurisprudence: A Collaboration Between Social Work and Law

    The Essay will be presented in two parts. Part I lays the theoretical and empirical foundation for the need for an emphasis on lawyers’ cultural competence. Part II then details the substantive content of a culturally competent approach to lawyering. In Part I.A, we define Therapeutic Justice (“TJ”) and discuss some of its current applications. In Part I.B, we identify the commonalities between TJ and the generalist social work model. In Part I.C, we discuss the current thinking and debates on racial and ethnic disparities and discrimination in the criminal justice system from a macro social work perspective. Part I.D describes a TJ approach to lawyering that addresses how TJ might be used to uncover key aspects of racial and ethnic disparities in the legal process. Part I.E presents a discussion of the empirical research that supports the important emphasis on “relationship” in the lawyer-client relationship while arguing that specific attention to racial and ethnic competency is notably missing. In Part II.A, we provide a discussion of the role of race in the lawyer-client relationship using racial identity development theory. Finally, in Part II.B, we present a cultural competency education model that integrates existing approaches in social work and law, and advocates a process that includes recommendations for: institutional change; infusion of diversity content throughout law school curriculum; an exploration of issues of power and oppression; an exploration and challenging of one’s own racial beliefs and biases; and a skill-building component

    Apology in the Criminal Justice Setting: An Update

    Apology has many benefits to offenders and victims. The last 15 years have produced worthwhile quantitative and qualitative studies that have refined our understanding of apology, but have also identified the diversity in what can be said in apology and how it can be received. The apology literature in the last 15 years in social psychology, criminology, and criminal justice is examined, including two and three-way interaction effects and qualitative results that focus on the effectiveness of apology at the contextual and individual levels, and the important role that emotion can play. It is recommended that apology be implemented with a &ldquo;less is more&rdquo; approach for apology to be most effective for youth in juvenile justice; and that a venue is provided for a spontaneous/voluntary apology to occur, or a minimally prepared apology, using only broad prescriptions on how it ought to be carried out. By utilizing appropriate research strategies, knowledge about apology and its effectiveness in legal settings including juvenile justice can continue to build to determine what type of apology works best for whom under what circumstances.Las disculpas tienen numerosos beneficios para v&iacute;ctimas y victimarios. En los &uacute;ltimos 15 a&ntilde;os se han realizado importantes estudios cuantitativos y cualitativos que han mejorado nuestra comprensi&oacute;n sobre las disculpas, pero que tambi&eacute;n han identificado la diversidad de lo que se puede decir al pedir perd&oacute;n y c&oacute;mo se puede recibir. Se analiza la literatura sobre disculpas de los &uacute;ltimos 15 a&ntilde;os en la psicolog&iacute;a social, la criminolog&iacute;a, y la justicia penal, incluyendo efectos de interacci&oacute;n de dos y tres v&iacute;as que se centran en la efectividad de las disculpas en los niveles contextual e individual, y el rol tan importante que puede jugar la emoci&oacute;n.     Bridging the research-practice gap: Concept mapping as a mixed methods strategy in practice-based research and evaluation

    The purpose of this article is to familiarize social work researchers and practitioners with Concept Mapping (Trochim, 1989), a mixed-methods strategy that can be useful in practice- based research. Using two case examples, the steps involved in concept mapping are illustrated. Practice strengths of concept mapping are discussed, including that it is participatory, accessible, permits immediate application of findings, and enhances service effectiveness. Research strengths include that it is a structured mixed-methods approach, the process is flexible, it accommodates cross-cultural applications, and is time- and cost-effective. Ways that concept mapping can be used to advance practice-based research are discussed, including instrument development, needs/resource assessment, theory development, evaluating activities and outcomes, strategic planning and action planning

    Lessons learned from organizing and teaching virtual phylogenetics workshops

    In 2020 and 2021, the COVID-19 pandemic led to an abrupt overhaul of many academic practices, including the transition of scientific events, such as workshops, to a fully virtual format. We describe our experiences organizing and teaching online-only statistical phylogenetics workshops and the lessons we learned along the way. We found that online workshops present some specific challenges, but format choices and rigorous planning can alleviate many of the concerns typically associated with a virtual medium. In addition, online workshops have unique advantages such as the flexibility they offer to participants and instructors and their accessibility to non-traditional and underprivileged audiences. We hope that our experience will encourage workshop organizers to consider online-only events as an integral part of potential training opportunities rather than simply a stop-gap solution for unusual circumstances. In addition, we hope to prompt broader discussion about integrating aspects of online workshops into traditional in-person courses to make training opportunities more flexible and inclusive.This preprint is made available through EcoEvoRxiv Preprints at doi:10.32942/osf.io/kp8sz.
