La emancipación de hecho desde el artículo 319 del Código Civil

[Resumen] En este trabajo se parte del artículo 319 del Código Civil para analizar la situación del menor de vida independiente. Éste ha de tener dieciséis años cumplidos, disfrutar de una economía separada de la familia y contar con el consentimiento necesario para ser independiente. La patria potestad se suspende, los padres continúan ostentándola, pero están de acuerdo en no ejercerla en tanto consienten que el hijo menor haga vida independiente. Dicha suspensión termina en el instante en el que los padres revocan su consentimiento. El principal efecto es la ampliación de la capacidad de obrar –de la que carecía al ser menor de edad-. Al ser su capacidad como la del emancipado resulta de aplicación el artículo 323 del citado cuerpo legal. Nos encontramos ante una emancipación de hecho y no ante una verdadera emancipación cuyos supuestos se recogen en el artículo 314 del Código Civil.[Abstract] Following the article 319 of the Civil Code we analyze, in this work, the situation of the minor of independent life. The minor must be already sixteen years old, he must have an economy separated from the family and he must possess the necessary assent to be independent. The parental authority is suspended, the parents still have it, but they do not use it while they consent that the minor does independent life. The above mentioned suspension ends when the parents revoke his assent. The main effect is the extension of the aptitude to act - that he was lacking while he was minor-. Therefore, being his capacity like that of the emancipated one it can be applied the article 323 of the Civil Code. Therefore, what we have is an emancipation of fact and not a real emancipation, which rules are gathered in the article 314 of the Civil Code

Disposiciones generales sobre discapacidad y dependencia: la delegación de la mejora en el Código Civil

[Resumen] En nuestro país son muchas las personas que sufren algún tipo de discapacidad. Por ello la legislación debe adaptarse a la realidad social con la intención de conseguir la mejor integración posible de este colectivo. El objeto principal de este estudio es analizar varias de las disposiciones legisla- tivas que tratan de favorecer a los discapacitados y dependientes. Además se hace un especial hincapié en el artículo 831 del Código Civil, el cual ha sido nuevamente modificado a raíz de la Ley 41/2003, de 18 de noviembre, de protec- ción patrimonial de las personas con discapacidad. Con este precepto se pretende que un progenitor, valiéndose de su testamento, delegue en el otro la facultad de mejorar al hijo que resulte más indefenso a consecuencia, por ejemplo, de padecer una discapacidad.[Abstract] In our country there are many people who suffer some type of disability. That is why the legislation must be adapted to the social reality with the intention of getting the best possible integration of this group. The main object of this study is to analyze some of the legislative regulations that treat to favor to the disabled and dependent people. In addition, we make an special support in the article 831 of the Civil Code, which has been again modified due to the Law 41/2003, of November the 18th, about the patrimonial protection of the disabled people. [Resumen] Los discapacitados tienen derecho a trabajar, en igualdad de condiciones que los demás. Solo el juez puede establecer que una persona está incapacitada para trabajar. Actualmente los centros especiales de empleo son la alternativa de empleo más importante. Los enclaves laborales facilitan la transición desde estos centros hasta el empleo ordinario, en donde inicialmente pueden contar con preparadores laborales.[Abstract] The disabled people have right to work, in the same conditions as the other people. Only the judge can establish that a person is disabled to work. Nowadays the special centers of employment are the best alternative to find a job. Treatment with tocilizumab or corticosteroids for COVID-19 patients with hyperinflammatory state: a multicentre cohort study (SAM-COVID-19)

Objectives: The objective of this study was to estimate the association between tocilizumab or corticosteroids and the risk of intubation or death in patients with coronavirus disease 19 (COVID-19) with a hyperinflammatory state according to clinical and laboratory parameters. Methods: A cohort study was performed in 60 Spanish hospitals including 778 patients with COVID-19 and clinical and laboratory data indicative of a hyperinflammatory state. Treatment was mainly with tocilizumab, an intermediate-high dose of corticosteroids (IHDC), a pulse dose of corticosteroids (PDC), combination therapy, or no treatment. Primary outcome was intubation or death; follow-up was 21 days. Propensity score-adjusted estimations using Cox regression (logistic regression if needed) were calculated. Propensity scores were used as confounders, matching variables and for the inverse probability of treatment weights (IPTWs). Results: In all, 88, 117, 78 and 151 patients treated with tocilizumab, IHDC, PDC, and combination therapy, respectively, were compared with 344 untreated patients. The primary endpoint occurred in 10 (11.4%), 27 (23.1%), 12 (15.4%), 40 (25.6%) and 69 (21.1%), respectively. The IPTW-based hazard ratios (odds ratio for combination therapy) for the primary endpoint were 0.32 (95%CI 0.22-0.47; p < 0.001) for tocilizumab, 0.82 (0.71-1.30; p 0.82) for IHDC, 0.61 (0.43-0.86; p 0.006) for PDC, and 1.17 (0.86-1.58; p 0.30) for combination therapy. Other applications of the propensity score provided similar results, but were not significant for PDC. Tocilizumab was also associated with lower hazard of death alone in IPTW analysis (0.07; 0.02-0.17; p < 0.001). Conclusions: Tocilizumab might be useful in COVID-19 patients with a hyperinflammatory state and should be prioritized for randomized trials in this situatio
