La realidad jurídica de la tenencia compartida en el Perú

La tenencia y custodia del menor, es una institución jurídica de suma importancia en el Derecho de Familia. Por ello, la legislación peruana, en concordancia con lo dispuesto por la Convención Americana de Derechos Humanos y la Constitución Política del Perú, recoge esta figura jurídica a fin de salvaguardar el desarrollo físico y emocional de los hijos. La presente investigación contenida en nuestro Trabajo de Suficiencia Profesional abordará en específico el tema de la Tenencia Compartida. Es menester señalar que se ha generado polémica en la realidad jurídica, toda vez que la Ley 31590 ‘‘Ley que regula la tenencia compartida’’ ha modificado los artículos 81, 82, 83 y 84 del Código de los Niños y Adolescentes. Ello significa que se aplica como regla general y no como una excepción. Bajo esta premisa, el presente trabajo no tiene énfasis en disquisiciones exclusivamente normativas pues en la realidad jurídica muchas veces no solo basta con la aplicación de la norma, ya que cada situación es particular y su implementación debe estar acorde a cada circunstancia para el correcto funcionamiento práctico-jurídico de la tenencia compartida. Finalmente, el enfoque en este trabajo ha de ser integral y requiere realizar un análisis jurídico-realista de lo que está suscitando en la realidad jurídica sobre el tema. Por ello, se evaluará el funcionamiento de la institución desde una perspectiva casuística; razón por la cual fue escogida la Sentencia Casatoria 3425-2022 Lambayeque.The possession and custody of minors is a legal institution of utmost importance in Family Law. Estimating the global conservation status of more than 15,000 Amazonian tree species

Estimates of extinction risk for Amazonian plant and animal species are rare and not often incorporated into land-use policy and conservation planning. We overlay spatial distribution models with historical and projected deforestation to show that at least 36% and up to 57% of all Amazonian tree species are likely to qualify as globally threatened under International Union for Conservation of Nature (IUCN) Red List criteria. If confirmed, these results would increase the number of threatened plant species on Earth by 22%. We show that the trends observed in Amazonia apply to trees throughout the tropics, and we predict thatmost of the world’s >40,000 tropical tree species now qualify as globally threatened. A gap analysis suggests that existing Amazonian protected areas and indigenous territories will protect viable populations of most threatened species if these areas suffer no further degradation, highlighting the key roles that protected areas, indigenous peoples, and improved governance can play in preventing large-scale extinctions in the tropics in this century
