    O contrato promessa sinalizado com entrega de coisa na insolvência

    Com o presente estudo pretende-se analisar a disciplina jurídica aplicável aos efeitos da declaração de insolvência sobre o contrato-promessa sinalizado com entrega de coisa, procurando-se determinar essencialmente em que medida e de que forma o sistema jurídico estabelece o equilíbrio entre o interesse imanente à tutela das expectativas e direitos da contraparte do insolvente, e aquele que é o vértice primacial do regime legal da insolvência: a defesa dos interesses patrimoniais dos credores. Encetaremos assim o nosso trabalho por uma breve incursão no regime geral dos efeitos da declaração de insolvência sobre os negócios em curso, concentrando o nosso estudo no âmbito e regime legal do artigo 102º do Código da Insolvência e da Recuperação de Empresas. Seguidamente, centrar-nos-emos na análise do âmbito concreto desses efeitos no contrato-promessa sinalizada com tradição da coisa, com eficácia real e com eficácia meramente obrigacional. Serão os contratos-promessa com eficácia meramente obrigacional que suscitarão as questões mais relevantes e controversas da nossa exposição, designadamente no que tange ao âmbito e regime do direito indemnizatório do promitente-comprador, bem como às eventuais garantias especificamente o direito de retenção questões estas que têm levantado inúmeras vozes doutrinais e jurisprudenciais dissonantes, perante as quais procuraremos tomar posição. A resposta a estas questões passará ainda pela exegese das normas insolvenciais e civilísticas atinentes ao regime do contrato-promessa, designadamente através da consideração dos interesses que o legislador teve em vista ao dispor sobre aquele regime; bem como pela busca, sempre circunscrita pelo teor daquelas normas, de um equilíbrio na composição justa dos referidos interesses. A nossa reflexão não deixará de assacar as inevitáveis críticas à falta de perceptibilidade e transparência da lei insolvencial no que respeita ao regime dos contratos-promessa em curso, a qual gera escusadas obscuridades interpretativas, potenciadoras de situações de grave injustiça, que urge pugnar por esclarecer, o que se torna ainda mais premente face ao aumento exponencial do número de processos de insolvência ao longo dos últimos anos

    Nos últimos anos, temos vindo a assistir à reforma da Administração Financeira do Estado, marcada pela reforma da contabilidade pública, que se caracteriza pela adopção de três sistemas contabilísticos: orçamental, patrimonial e o analítico, a que se acrescenta a introdução do principio do acréscimo, e ainda a medição da eficiência e eficácia da gestão pública. No âmbito desta reforma, foi publicado o Plano Oficial da Contabilidade Pública, e posteriormente o Plano Oficial de Contabilidade para o Sector da Educação, que definiu normas de consolidação de contas para o Sector de Educação, a alteração ao POCAL ainda se encontra em discussão pública e os trabalhos em curso no seio do Ministério das Finanças. Neste sentido, é propósito desta dissertação apresentar as práticas da consolidação nos municípios e neste contexto verificar se a consolidação de contas será o instrumento que irá permitir a obtenção da informação financeira necessária de forma a traduzir uma imagem verdadeira e apropriada do grupo local

    Gaucher Disease (GD) type 3 is a neurological form of a multisystemic autosomal recessive disorder belonging to the group of lysosomal storage diseases. Causal mutations in the glucocerebrosidase 1 (GBA1) commonly lead to abnormal protein and GD, heterozygosity is a genetic risk factor for Parkinson's disease. This work describes the use of a non-integrative approach using Sendai Virus delivery to establish induced Pluripotent Stem Cells (iPSCs) from fibroblasts from a GD type 3 patient.     Ultrasound as a method for early diagnosis of breast pathology

    Introduction: Ultrasound is a non-invasive, low-cost technique that does not use ionising radiation and provides a “real-time” image, and for these reasons, this method is ideal in several situations. Purpose: To demonstrate breast ultrasound evaluation as a first-line diagnostic method and to evaluate the variation of breast characteristics with age. Material and Methods: A total of 105 women with a mean age of 30 years participated and were divided into three age groups: 18–39, 40–59, and 60–79 years, excluding participants subject to mastectomy. After completing the informed consent, all participants answered personal and sociodemographic questions, such as personal and family history, menstrual cycle, pregnancy, ultrasound, and mammography, among others. They were then submitted to a bilateral breast ultrasound examination. Subsequently, all the images and their data were analysed, and a technical report of the examination was given to all the participants. Results: A total of 105 women with a mean age of 30 years participated, 58 of whom underwent the examination for the first time. In 31, changes (of which only 7 were known) were diagnosed. It was verified that, according to age group, the density of the breast stroma varied; older women have less breast density. Conclusions: Ultrasound is a good method for breast evaluation and can be considered important for the early evaluation of breast pathology and follow-up of the pathology.info:eu-repo/semantics/publishedVersio

    The life history and ecology of black scabbardfish (Aphanopus carbo Lowe 1839) in the north-east Atlantic

    The black scabbardfish is a deep water species that supports commercial fisheries across a large area of the NE Atlantic shelf. The life history of black scabbardfish is poorly understood and a major unresolved issue is population structure. In this study it was used a combination of methodologies to get further knowledge in the life history and population structure of A. carbo over its wide distribution range in the Northeast Atlantic. The new knowledge acquired during this study, will increase our ability to better manage this species in the NE Atlantic. It has been postulated that fish caught to the west of the British Isles are pre-adults that migrate further south (to Madeira) for spawning, implying a single panmictic population. In this study, specimens of Aphanopus carbo were sampled between September 2008 and May 2010 from two different areas: NW Scotland (French trawlers and deep water surveys) and Madeira Islands (longliners commercial landings). Geographical differences in reproductive state of scabbardfish were evident, supportive of a north-south migration theory. In the northern area, all specimens found were immature, while in Madeira all maturity stages were observed. In Madeira, spawning occurred during the fourth quarter, with peak maturity in October (males) and in November (females). The age of this species has proven difficult and has led to different and contradictory age and growth estimates. For this study, we used two reading interpretations to determine age and estimate the growth parameters. To the west of the British Isles, specimens reached a lower maximum age and had a higher growth rate than those caught off Madeira. These differences are consistent with the theory of a single population of black scabbardfish in the NE Atlantic, highly segregate, with smaller, immature and younger fish caught to the west of the British Isles and bigger and mature caught in Madeira Islands. The feeding ecology showed strong evidence that the diet of black scabbardfish is associated with the spawning migration of blue whiting, which may support a northerly feeding migration theory for black scabbardfish. The stable isotope analyses in the muscle of black scabbardfish identified that black scabbardfish feeds on species with epipelagic and benthopelagic affinities. Comparison with stable isotope analysis in Madeira samples indicated that black scabbardfish feed at a similar trophic level and has the same trophic niche width in both areas, assuming similar baseline isotope compositions. Otolith stable isotopes (oxygen - δ18O and nitrogen - δ15N) analyses were used as a tool to clarify migratory behaviour. Otolith isotope ratios can provide insight into whether adults caught around Madeira fed in an isotopically depleted northerly ecosystem (NW Scotland) during their pre-adult period and then migrate towards south to spawn. Overall, the results support a south-north migration of pre adult fish from spawning areas around Madeira and a north-south migration from the west of Scotland to the spawning areas. Given its life cycle there is an urgent need that the management process recognizes the existence of a continuous widely distributed stock of black scabbardfish between the west of the British Isles and Madeira. The results highlight large scale dispersal in this species which needs to be treated as a highly migratory species and be managed as a single population

    Liderazgo de opinión de moda, adhesión a la innovación y actitud hacia la publicidad entre los consumidores portugueses

    In the context of the fashion market, this study aims to analyze opinion leadership and, specifically, to verify the correlation that may exist between opinion leadership, fashion innovativeness and attitude towards fashion advertising. It is also intended to identify two different consumer groups: opinion leaders and fashion followers based on “opinion leadership” construct. Data collection was done through a self-administered questionnaire with a convenience sample of 203 graduate and postgraduate students of two universities of Porto, the second major city of Portugal. Results show a positive correlation between fashion innovativeness, fashion opinion leadership, and attitude towards fashion advertising. It was possible to identify two groups of consumers: fashion influencers, who exhibit a moderate sense of innovativeness and a positive attitude towards fashion advertising; and fashion followers who don’t consider themselves neither innovators nor opinion leaders, but have a moderate positive attitude towards fashion advertising.Este estudio tiene como principal objetivo analizar el liderazgo de opinión en el contexto del mercado de la moda, más concretamente, verificar si existe una correlación entre las variables liderazgo de opinión, adhesión a la innovación en la moda y actitud hacia la publicidad de la moda. A partir de la variable liderazgo de opinión, se pretende también identificar dos grupos diferentes de consumidores: los líderes de opinión y los seguidores en el mercado de la moda. Se seleccionaron 203 estudiantes de tercer ciclo y de postgrado de dos universidades de Oporto, la segunda ciudad más grande de Portugal. Fue solicitado a los participantes que rellenasen un cuestionario sobre actitudes y comportamientos sobre moda. Los resultados muestran que existe una correlación positiva entre la adhesión a la innovación, el liderazgo de opinión y la actitud hacia la publicidad. Fue posible identificar dos grupos de consumidores. Por un lado, “los influyentes”, que puntúan moderadamente en la variable adhesión a la innovación y presentan una actitud positiva hacia la publicidad de la moda, y por otro, “los seguidores”, que no se consideran ni innovadores ni líderes de opinión, pero mantienen una actitud positiva moderada hacia la publicidad de la moda

    Psicose Orgânica em Doente com Tumor Carcinoide Atípico do Pulmão

    Psychiatric manifestations are present in at least one third of cancer patients. Notwithstanding, less than 50% are properly followed‐up. This article contributes to the scarce existing literature on psychotic symptoms in patients with neuroendocrine tumors ‐ a rare presentation of a rare disease. It emphasizes a possible association between carcinoid tumor of the lung and psychotic symptoms, discusses the differential diagnosis and presents an effective psychopharmacological therapeutic option, never published before, to the best of our knowledge. We report the case of a female 69‐year‐old patient with an atypical carcinoid tumor of the lung and no previous psychiatric history. The clinical picture was characterized by paranoid and reference delusional ideas, with acoustic‐verbal hallucinatory activity, with secondary depressive mood and extreme anxiety. An organic psychosis was admitted with probable relationship with her neoplastic disease and was treated with aripiprazole, with good response and tolerance.Manifestações psiquiátricas estão presentes em pelo menos um terço dos doentes com cancro. Apesar disso, menos de 50% são devidamente acompanhados. Este artigo contribui para a escassa literatura existente sobre sintomas psicóticos em doentes com tumores neuroendócrinos ‐ uma apresentação rara de uma doença rara. Enfatiza uma possível associação entre tumor carcinoide do pulmão e sintomas psicóticos, discute o diagnóstico diferencial e apresenta uma opção terapêutica psicofarmacológica eficaz, nunca publicada, até onde sabemos. Relatamos o caso de uma doente de 69 anos com um tumor carcinoide atípico do pulmão, sem história psiquiátrica prévia. O quadro clínico caracterizou‐se por ideias delirantes paranoides e autoreferenciais, atividade alucinatória acústico‐verbal, humor depressivo e ansiedade extrema secundários. Foi admitida uma psicose orgânica em provável relação com a sua doença neoplásica, que foi tratada com aripiprazol, com boa resposta e tolerância
