    Regulating a “Pariah” Industry: The Need for a Responsive Approach in Gambling Markets

    Gaming regulators are uniquely positioned state agents, who must consider contradictory goals in their day-to-day actions. They must protect the public (and maintain the legitimacy of government) but are also responsible for ensuring that the gaming industry provides needed revenue to the state. To that end, regulators are not only responsible for promoting the legitimacy of the government but also, to some extent, must consider how they can encourage the legitimization of a previously illegal behavior. Prior research has examined regulators’ attempts to balance such “structural contradictions” through their licensing process, but little research has been done on regulatory responses to licensee violations. The present review suggests that a transparent and “responsive” regulatory response to such violations would benefit regulators, the industry, and the public. I review the contradictions inherent in regulating the gaming industry, describe the “Responsive Regulation” approach, and then detail how “Responsive Regulation” could uniquely benefit gaming. I conclude with a call for more collaboration between regulators, practitioners (including industry participants), and academics

    TESTING THE INFLUENCE OF VARIOUS "LICENSES" IN MOTIVATING CORPORATE ENVIRONMENTAL BEHAVIOR

    In this dissertation, I test a framework of corporate environmental compliance put forth by Gunningham, Kagan, and Thornton in their 2003 book called Shades of Green. However, this dissertation moves beyond a mere test of theory by integrating the corporate-level license framework with the individual-level Rational Choice Theory. In doing so, this integration portrays how individuals within corporations decide to comply or overcomply with environmental regulations while accounting for the organizational context. Specifically, external pressures from the legal, social, and economic domains as well as corporation-wide policies and culture impact individual-level cost-benefit analyses. In turn, these cost-benefit calculations impact the decisions made by corporate managers. I propose five hypotheses based on this integration and test them using an environmental vignette survey of individuals as well as meta-analytical data. The vignette survey provides a randomly-generated hypothetical scenario and asks respondents (here, environmentally-minded business people) to predict their likelihood of offending or overcomplying as the depicted manager in the scenario did. Results provide mixed support for the impact of the external license pressures and more support for the rational choice theory measures. I also compare similarities and differences between the offending and overcompliance models. I conducted a test of the robustness of hypothesis 1 results using meta-analysis of studies collected through 2006. These studies use actual firm-level behaviors as their outcomes and therefore overcame some of the limitations of the vignette study. I found additional support for the relationship between external pressures and offending, although more analysis is needed to assess how effects differ by study methodologies and samples. Overall, this integrated theory is worthy of further empirical testing and has important implications for both theories of corporate crime as well as prevention and control policies. Future research should examine the interactions between factors affecting the corporation, those affecting the individuals in charge of the corporation, and interactions between these factors and levels. The theory proffered here provides a clear, comprehensive, yet fairly parsimonious foundation for doing so

    Communicating through Violence: An Application of Rational Choice Theory to Terrorist Claims of Responsibility

    The present research applied rational choice theory to terrorists' decisions to formally claim responsibility for an attack. Logistic regression is applied to United States' incident characteristics, testing whether claim-making decreases over time and whether post-attack claims are less likely after incidents targeting specific entities. Variables being controlled for include the tactic used, whether the attack was successful, nationality of the target, and number of casualties. A sensitivity analysis of 100 randomly-selected cases examines measurement error in the dependent variable resulting from media attribution of group responsibility as opposed to formal claims from terrorists. Results indicate that striking a specific target does not decrease the likelihood that an attack will be formally claimed by a terrorist group. This research does provide evidence that influential factors in terrorist claim-making decisions change over time. Policy implications are discussed

    An Empirical Assessment of Corporate Environmental Crime-Control Strategies

    Corporate illegality is often attributed to greed by corporate managers and insufficient legal safeguards. Underlying this argument is an explicit critique of corporate crime regulatory systems. Yet there is little systematic investigation of the relative merits of different types or components of crime-control strategies; research comparing more punitive command-and-control strategies with self-regulatory approaches is particularly lacking. In this Article, we assess these crime prevention-and-control mechanisms in the context of individual and situational risk factors that may increase the likelihood of illegal behavior in the environmental arena. We use data drawn from two groups of business managers who participated in a factorial survey (using vignettes) measuring their intentions to participate in two types of environmental offenses. Generally, results show that the most effective regulatory levers are (1) credible legal sanctions and (2) the certainty and severity of informal discovery by significant others in the firm. We conclude by discussing the implications of our findings for regulatory policy and strategy, and for efforts to account for the role of social norms in corporate environmental compliance

    Corporate Crime Deterrence: A Systematic Review

    Corporate crime is a poorly understood problem with little known about effective strategies to prevent and control it. Competing definitions of corporate crime affect how the phenomenon is studied and implications for reducing it. Therefore, in this review, we use John Braithwaite’s definition (1984: 6) which specifies that corporate crime is “the conduct of a corporation, or of employees acting on behalf of a corporation, which is proscribed and punishable by law.” Consistent with this approach, this review focuses on various legal strategies aimed at companies and their officials/managers to curtail corporate crime. Interventions may be punitive or cooperative, but the goal is to prevent offending and increase levels of corporate compliance. Our overall objective is to identify and synthesize published and unpublished studies on formal legal and administrative prevention and control strategies—i.e., the actions and programs of government law enforcement agencies, legislative bodies, and regulatory agencies on corporate crime. We then assess the impact of these strategies on individual and company offending. Included are legal and administrative interventions such as new laws or changes in laws, inspections by regulatory agencies, punitive sanctions and non-punitive interventions aimed at deterring or controlling illegal behaviors

    MUSiC : a model-unspecific search for new physics in proton-proton collisions at root s=13TeV

    Results of the Model Unspecific Search in CMS (MUSiC), using proton-proton collision data recorded at the LHC at a centre-of-mass energy of 13 TeV, corresponding to an integrated luminosity of 35.9 fb(-1), are presented. The MUSiC analysis searches for anomalies that could be signatures of physics beyond the standard model. The analysis is based on the comparison of observed data with the standard model prediction, as determined from simulation, in several hundred final states and multiple kinematic distributions. Events containing at least one electron or muon are classified based on their final state topology, and an automated search algorithm surveys the observed data for deviations from the prediction. The sensitivity of the search is validated using multiple methods. No significant deviations from the predictions have been observed. For a wide range of final state topologies, agreement is found between the data and the standard model simulation. This analysis complements dedicated search analyses by significantly expanding the range of final states covered using a model independent approach with the largest data set to date to probe phase space regions beyond the reach of previous general searches.Peer reviewe

    Measurement of prompt open-charm production cross sections in proton-proton collisions at root s=13 TeV

    The production cross sections for prompt open-charm mesons in proton-proton collisions at a center-of-mass energy of 13TeV are reported. The measurement is performed using a data sample collected by the CMS experiment corresponding to an integrated luminosity of 29 nb(-1). The differential production cross sections of the D*(+/-), D-+/-, and D-0 ((D) over bar (0)) mesons are presented in ranges of transverse momentum and pseudorapidity 4 < p(T) < 100 GeV and vertical bar eta vertical bar < 2.1, respectively. The results are compared to several theoretical calculations and to previous measurements.Peer reviewe

    Development and validation of HERWIG 7 tunes from CMS underlying-event measurements

    This paper presents new sets of parameters (“tunes”) for the underlying-event model of the HERWIG7 event generator. These parameters control the description of multiple-parton interactions (MPI) and colour reconnection in HERWIG7, and are obtained from a fit to minimum-bias data collected by the CMS experiment at s=0.9, 7, and 13Te. The tunes are based on the NNPDF 3.1 next-to-next-to-leading-order parton distribution function (PDF) set for the parton shower, and either a leading-order or next-to-next-to-leading-order PDF set for the simulation of MPI and the beam remnants. Predictions utilizing the tunes are produced for event shape observables in electron-positron collisions, and for minimum-bias, inclusive jet, top quark pair, and Z and W boson events in proton-proton collisions, and are compared with data. Each of the new tunes describes the data at a reasonable level, and the tunes using a leading-order PDF for the simulation of MPI provide the best description of the dat

    Observation of the Production of Three Massive Gauge Bosons at root s=13 TeV

    The first observation is reported of the combined production of three massive gauge bosons (VVV with V = W, Z) in proton-proton collisions at a center-of-mass energy of 13 TeV. The analysis is based on a data sample recorded by the CMS experiment at the CERN LHC corresponding to an integrated luminosity of 137 fb(-1). The searches for individualWWW, WWZ, WZZ, and ZZZ production are performed in final states with three, four, five, and six leptons (electrons or muons), or with two same-sign leptons plus one or two jets. The observed (expected) significance of the combinedVVV production signal is 5.7 (5.9) standard deviations and the corresponding measured cross section relative to the standard model prediction is 1.02(-0.23)(+0.26). The significances of the individual WWW and WWZ production are 3.3 and 3.4 standard deviations, respectively. Measured production cross sections for the individual triboson processes are also reported
