Теоретико-правовий аналіз понятійно-категоріального апарату у сфері обмеження прав людини: відмінності між суміжними поняттями
У статті здійснено дослідження співвідношення понять «обмеження прав людини» і «дискримінація». Констатовано, що вивчення відмінностей у сутності наведених понять надзвичайно важливе в контексті правотворчих та правореалізаційних концептів сучасного суспільства.
Проаналізовано стан наукового дослідження теми та найбільш поширені підходи до інтерпретації понять «обмеження прав людини» і «дискримінація». Розкрито їх доктринальне розуміння та вказано на основні юридичні ознаки.
З'ясовано, що обмеження прав може виникати у вигляді необхідних обмежень для забезпечення загального благополуччя чи національної безпеки та інших затребуваних суспільних цінностей, в той час як дискримінація спрямована на порушення рівності та гідності особи, за певними ознаками, з метою ослаблення правового становища певних соціальних груп. Виявлено два підходи до визначення поняття «обмеження прав людини». Згідно з першим - обмеження прав людини, характеризується розумінням такого обмеження як звуження, зменшення можливості користуватись певними соціальними благами, з метою забезпечення реалізації прав інших людей, охорони здоров'я та захисту територіальної цілісності держави. Відповідно до другого підходу, - обмеження прав розглядається як встановлення певних рамок, заборон, відповідальності, накладення додаткових обов'язків з метою забезпечення необхідного балансу між суспільними та приватними інтересами. Виявлено два підходи до визначення поняття «дискримінація». Представники першого підходу визначають дискримінацію через дії, що порушують принцип рівності та зачіпають людську гідність, представники другої зводять дискримінацію до розрізнення у правах та свободах людини.
Констатовано, що «обмеження прав» є механізмом, за допомогою якого держава може регулювати поведінку громадян в інтересах національної безпеки, громадського порядку чи забезпечення безпеки інших людей, що може включати встановлення додаткових обов'язків, заборон, відповідальності тощо. Навпаки, «дискримінація» спрямована на певні соціальні групи і полягає в порушенні їхньої рівності та гідності, що проявляється у обмеженнях доступу до різних можливостей, послуг чи ресурсів на підставі особистих характеристик
TRENDS AND PROSPECTS FOR THE IMPLEMENTATION OF CROWDFUNDING AS A WAY OF FINANCING INVESTMENT PROJECTS IN RUSSIA
With the rapid development of the digital economy and business transformation, modern financial technology tools are becoming more and more in demand. This article explores and reflects the main aspects of crowdfunding financing in the Russian Federation. The significance of crowdfunding in the implementation of projects, in particular in the social sphere, has been determined. The analysis has been presented and statistics of the most popular crowdfunding services has been displayed. The structure of crowdfunding financing by areas, country of ownership of users of the investment platform Planeta.ru has been considered. The factors have been reflected and the main vectors of the development of crowdfunding as a full-fledged financing mechanism in modern conditions have been formulated
(De)marketing to Manage Consumer Quality Inferences
Savvy consumers attribute a product’s market performance to its intrinsic quality as well as the seller’s marketing push. The authors study how sellers should optimize their marketing decisions in response. They find that a seller can benefit from “demarketing” its product, meaning visibly toning down its marketing efforts. Demarketing lowers expected sales ex ante but improves product quality image ex post, as consumers attribute good sales to superior quality and lackluster sales to insufficient marketing. The authors derive conditions under which demarketing can be a recommendable business strategy. A series of experiments confirm these prediction

Managing brands in the social media environment
The dynamic, ubiquitous, and often real-time interaction enabled by social media significantly changes the landscape for brand management. A deep understanding of this change is critical since it may affect a brand's performance substantially. Literature about social media's impact on brands is evolving, but lacks a systematic identification of key challenges related to managing brands in this new environment. This paper reviews existing research and introduces a framework of social media's impact on brand management. It argues that consumers are becoming pivotal authors of brand stories due to new dynamic networks of consumers and brands formed through social media and the easy sharing of brand experiences in such networks. Consumer Shopping Costs as a Cause of Slotting Fees: A Rent-Shifting Mechanism
Analyzing a sequential bargaining framework with one retailer and two suppliers of substitutable goods, we show that slotting fees may emerge as a result of a rent-shifting mechanism when consumer shopping costs are taken into account. If consumers economize on their shopping costs by bundling their purchases, their buying decision depends rather on the price for the whole shopping basket than on individual product prices. This induces complementarities between the goods offered at a retail outlet. If the complementarity effect resulting from shopping costs dominates the original substitution effect, the wholesale price negotiated with the first supplier is upward distorted in order to shift rent from the second supplier. As long as the first supplier has only little bargaining power, she compensates the retailer for the upward distorted wholesale price by paying a slotting fee.
