From Deepsouth to the Great White North: The Extraterritorial Reach of United States Patent Law After Research in Motion

In the Internet age, complex telecommunications systems are often deployed with little regard for international borders. In NTP, Inc. v. Research in Motion, Ltd., the Federal Circuit determined that one such system infringed several U.S. patents, despite the fact that an essential element of the system was located outside the territorial United States. This iBrief argues that the Federal Circuit erred in invoking the control and beneficial use test, which it culled from the very few prior cases addressing extraterritorial application of U.S. patent law. In doing so, the court disregarded the Supreme Court\u27s direction in Deepsouth Packing Co. v. Laitram Corp. that the United States\u27 patent laws make no claim to extraterritorial effect

Advances in Biomaterials and Medical Devices PanelOrthopaedic disorders of the major joints, specifically, osteoarthritis of the hip and knee joints have an enormous economic and functional impact on our society, affecting millions of patients every day. In the late 1960s and early 1970s, replacement of diseased joints with metal and plastic components was developed as a salvage technique for elderly, and relatively sedentary patients. Now, with an aging and active population that expects to maintain function and mobility, the demand for major joint reconstruction is increasing worldwide. Younger, heavier, and active patients place greater demands on biomaterials and implants. Our collaborative team is focused on developing new biomaterials that can meet the challenge of skeletal repair, and joint replacement, and on exploring tissue-engineered cartilage as a possible biological replacement of diseased and arthritic joints. An interdisciplinary team approach to these goals has resulted in peer-reviewed publications, graduate student education opportunities, and extramural funding. Going forward, a major goal is to leverage our resources to create products that can be positioned profitably in the commercially-attractive orthopaedic device market

Legal Issues: Lawsuit Threatens BlackBerry Shutdown

For over four years a dispute has raged between Research in Motion (RIM), the Ontario, Canada based manufacturer of the BlackBerry, and NTP, a Virginia company which holds several patents covering wireless e-mail technologies. NTP sued RIM claiming that the BlackBerry infringes on eight of NTP’s patents. A trial court agreed and awarded damages to NTP and issued and injunction preventing RIM from continuing to use the patented technology. So far, the injunction has been delayed by the courts. However, following four years of trial and appellate court decisions generally favoring NTP, a federal court in late November denied a proposed settlement. The court also agreed to consider imposing the long delayed injunction, which would prevent RIM from using the patented technology. Such an injunction could shut down the BlackBerry communications network. The lawsuit highlights the incredible complexity of patents governing the technology that we have come to take for granted. It also represents the difficulties associated with applying patent law to those patents

Video Methods: Social Science Research in Motion

    Get PDF
This interdisciplinary collection provides a set of innovative and inventive approaches to the use of video as a research method. Building on the development of visual methods across the social sciences, it highlights a range of possibilities for making and working with video data. The collection showcases different video methods, including video diaries, video go-alongs, time-lapse video, mobile devices, multi-angle video recording, video ethnography, and ethnographic documentary. Each method is presented through a case study, showing how the method can be used in practice. The authors offer pragmatic advice and discuss practical issues, including equipment, techniques and skills, analysis, and presentation. They also show how video methods can be used in a range of different contexts – at train stations, on bicycles, in schools, outdoors, and in museums – to investigate worlds that are visible, audible, tangible, and in motion. In doing so, they illuminate the theoretical possibilities that video methods offer for researching the body, identity, everyday life, affect, time, and space
