Cavanaugh, the U.S. Court of Appeals for the Eighth Circuit held that prior, uncounseled tribal court convictions could be used to establish an element of a subsequent federal offense.     Conditioned emergence: a dissipative structures approach to transformation

    This paper presents a novel framework for the management of organisational transformation, defined here as a relatively rapid transition from one archetype to another. The concept of dissipative structures, from the field of complexity theory, is used to develop and explain a specific sequence of activities which underpin effective transformation. This sequence integrates selected concepts from the literatures on strategic change, organisational learning and business processes; in so doing, it introduces a degree of prescriptiveness which differentiates it from other managerial interpretations of complexity theory. Specifically, it proposes a three-stage process: first, the organisation conditions the outcome of the transformation process by articulating and reconfiguring the rules which underpin its deep structure; second, it takes steps to move from its current equilibrium and, finally, it moves into a period where positive and negative feedback loops become the focus of managerial attention. The paper argues that by managing at the level of deep structure in social systems, organisations can gain some influence over self-organising processes which are typically regarded as unpredictable in the natural sciences. However, the paper further argues that this influence is limited to archetypal features and that detailed forms and behaviours are emergent properties of the system. Two illustrative case-vignettes are presented to give an insight into the practical application of the model before conclusions are reached which speculate on the implications of this approach for strategy research

    Pertambahan penduduk, perkembangan wilayah, dan pertumbuhan ekonomi membawa dampak padapertumbuhan sarana dan prasarana transportasi. Sarana transportasi yaitu kendaraan bermotor berfungsisebagai alat pergerakan dan mobilitas manusia. Prasarana transportasi yaitu jalan raya berfungsi sebagaitempat berlalu lalangnya kendaraan bermotor. Kondisi pertumbuhan sarana dan prasarana transportasi inijuga terjadi di Kabupaten Malang.Hanya pertumbuhan antara keduanya terjadi tidak seimbang, pertumbuhankendaraan bermotor sangat tinggi sementara pertumbuhan jalan sangat rendah sehingga menimbulkankemacetan dan tundaan-tundaan di persimpangan jalan. Untuk itu maka tujuan dari penelitian ini adalahuntuk mengetahui kondisi dan prediksi kepadatan lalu lintas di Kabupaten Malang dan mempersiapkanlangkah-langkah kebijakannya. Dengan menggunakan alat analisis statistik deskriptif, analisis VCR, LoS,dan regresi linier sederhana hasil penelitian menunjukkan, bahwa kondisi kepadatan lalu lintas di KabupatenMalang didominasi oleh jumlah kendaraan bermotor roda dua, yaitu 87,85 %. Sebagai alternatif disarankanagar Pemerintah Kabupaten Malang membenahi layanan transportasi online menjadi lebih professionalagar masyarakat meninggalkan angkutan pribadinya untuk mengurangi pertumbuhan kendaraan bermotor.Selanjutnya terkait dengan kinerja jaringan jalan di Kabupaten Malang diprediksi dalam kurun waktu 10sampai 15 tahun kedepan akan mengalami kemacetan parah. Solusinya jalan Tol Surabaya – Malang agarsegera direalisasikan karena jalan tol tersebut diprediksi bisa membantu mengurai kemacetan lalu lintas diwilayah Kabupaten Malang

    For decades, the field of gender, sex, and sexualities has been a focal point of increasing interest. This inquiry has been ignited by successive waves of dramatic social change, chief among them: the re-emergence of feminist movements in the U.S. and Europe in the late 1960s; the sustained (and increasingly successful) bids for legal, social, and religious acceptance of non-heterosexual sexualities in many parts of the world; and the burgeoning number of people (whether cisgendered, gender-variant, trans, or questioning) whose individual and collective experiences of gender and sexuality warrant deeper understanding and further progress toward a fuller realization of human potential and civil rights. In psychology, the intellectual project of understanding gender, sex, and sexualities encompasses a variety of subfields spanning neuroscience and developmental, cognitive, social, and cultural psychology, as well as critical theory. As such, these approaches have inspired new and different psychological questions, as well as increased interest in previously unfamiliar topics of investigation. Edited by Nancy K.     A review of climate change in South East Asian Countries and human health: Impacts, vulnerability, adaptation, and mitigation

    Climate Change (CC) is one of the most significant global environmental challenges humanity has faced. The most dominant causative factors due to human activity are emissions of greenhouse-gasses (GHG) from the combustion of fossil fuels and deforestation of natural rain forests. Although CC has a global impact, developing countries in the South East Asian Region (SEAR) would be more vulnerable to the effects as growth, development, poverty and health of these countries will be severely affected. The key ill-effects include increasing global average temperatures, the rise in sea levels, changes in eco-systems, and adverse impacts on human health. Rising sea levels threatens coastal cities; changes to the monsoon rainfall and a significant reduction in agricultural output are among some of the climate risks these countries will have to face. CC would compromise the essential prerequisites for good health; safe water, secure shelter, and food security and aggravate health risk through emerging and re-emerging diseases and spread of infectious diseases. Health-focused investments in climate actions remain weak and countries should focus on implementing health systems, while targeting for universal health coverage. The growth rate for Asian economies has risen over the past decade and this has led to steady emission increase. India and Indonesia are amongst the top ten emitters while others remain small emitters. Efforts are needed to limit the temperature increase to minimize adverse effects, which will require deep de-carbonization by both developed and developing countries, through an integrated portfolio of mitigation and adaptive strategies, which will be abide by UNFCCC common but differentiated approach
