The principle of Contradictority and Its Application in Criminal Proceedings

Předmětem této diplomové práce je zásada kontradiktornosti trestního řízení a způsob, jakým je v současné době uplatňována. Práce se skládá z šesti základních kapitol. Po stručném úvodu v první kapitole se kapitola druhá zaměřuje na koncept kontradiktorního trestního řízení v soudobé teorii a představuje možné přístupy k tomu, co kontradiktornost trestního řízení je nebo by měla být. Zároveň se dotýká terminologického problému, který spočívá v překladu anglického výrazu adversarial proceedings vyskytujícího se v judikatuře Evropského soudu pro lidská práva, který pojem kontradiktorního trestního řízení ve smyslu, v jakém je používán v této práci, vyložil. Tento anglický výraz je v originálním znění problematický, neboť může vést k záměně adverzárního trestního řízení typického pro země s angloamerickou právní kulturou a kontradiktorního řízení, které definoval právě Evropský soud pro lidská práva a které může být (a ve skutečnosti je) uplatňováno v rámci trestního řízení jak v zemích s angloamerickou, tak v zemích s kontinentální právní kulturou. Třetí...The purpose of my thesis is to provide an analysis of the principle of contradictority and its application in criminal proceedings. I have decided to use the term "contradictory proceedings" even though The European Court of Human Rights that developed the concept usually uses the term "adversarial proceedings". The reason consists in the difference between adversarial proceedings as a special kind of criminal proceedings which is typical for countries within the Anglo-American legal culture and adversarial/contradictory proceedings as a wider concept of proceedings which is based on a respect for the rights of people charged with criminal offences and which can be (and actually is) used both within the Anglo-American legal system and the legal system of the countries in the continental Europe. In this sense, the correct translation into Czech language is "kontradiktorní řízení". The thesis is composed of six basic chapters. Chapters One and Two provide introduction, presenting some theoretical approaches to what contradictory proceedings could or should be. Chapter Three is subdivided into three subchapters. Evaluation of the Company´s Financial Performance using Benchmarking Approach

Tato diplomová práce se zabývá zhodnocením obchodní a finanční výkonnosti společnosti Zemědělské družstvo Hodonice pomocí metody Benchmarking. První část se zaměřuje na teoretická východiska nezbytná pro řešení dané problematiky. V druhé části je charakterizována zkoumaná společnost, která je doplněna o strategickou analýzu společnosti. Následující část je věnována stěžejní části diplomové práce, kterou je benchmarking společnosti se zvolenými konkurenčními společnostmi. V poslední části jsou navržena opatření ke zlepšení finanční a obchodní výkonnosti společnosti.This diploma thesis deals with the evaluation of business and financial performance of the company Zemědělské družstvo Hodonice using the method of Benchmarking. The first part focuses on the theoretical basis necessary to solution the issue. In the second part the selected company is characterized, which is completed by a strategic analysis of the company. The following part is devoted to the main part of the thesis, which is the benchmarking of the company with selected competitors. The last part proposes measures to improve the financial and business performance of the company.

Analysis of Impacts on Land Prices Determined by Planning for Residential Housing in the Area of the Moravian Karst

Diplomová práce se zabývá vlivy, které působí na cenu stavebních pozemků určených územním plánem pro bydlení v CHKO Moravský kras. V rešeršní části práce jsou definovány základní pojmy týkající se dané problematiky a popsány vlivy, které působí na cenu stavebních pozemků dle dostupné literatury. V analytické části práce je na základě dlouhodobého průzkumu provedena analýza realitního trhu daného segmentu. Dále jsou zkoumány a statisticky vyhodnocovány vlivy působící na cenu stavebních pozemků dle sestaveného modelu vícerozměrné lineární regrese ve statistickém programu gretl. Vlivy jsou vyhodnocovány jak v rozsahu celé oblasti, tak i v rozsahu vybraných obcí. V diskuzní části práce je zodpovězeno na vyslovené otázky, ověřena platnost stanovených hypotéz a dosažené výsledky jsou porovnány s poznatky získanými při tvorbě rešeršní části.This master‘s thesis deals with impacts on prices of sites which are meant by planning for residential housing in the landscape park Moravian Karst. In the research section of the thesis, there are defined fundamental concepts that concern themselves with the given issues and there are portrayed impacts on prices of sites according to the accessible literature. In the analytical section of the thesis, there is conducted an analysis of the real estate market of the given segment. Furthermore, there are examined and statistically evaluated impacts on prices of sites based on a multiple linear regression modelled in a statistical tool gretl. Impacts are evaluated both within a scope of the whole area and within particular municipalities. In the discussion section of the thesis, the manifested questions are answered, the stated hypotheses are tested and the obtained results are compared to the findings that were described in the research section.

Management development project

Diplomová práce si klade za cíl zmapovat proces plánování a realizace developerského projektu. Zaměřuje se zejména na popis a analýzu jednotlivých fází projektu a to především z hlediska jejich řízení a eliminace potencionálních rizik. První část diplomové práce se věnuje hlavně teoretickému uvedení do problematiky a definici základních pojmů a metod. Druhá část práce se pak snaží zmapovat již konkrétní developerský projekt a provést analýzu jeho reálného průběhu. V této části jsou navrženy i jiné možné přístupy k řešení některých konkrétních úkolů v rámci jednotlivých etap a tím případná eliminace rizik, která se v projektu reálně vyskytla, včetně navržení optimálního postupu pro řízení developerského projektu.Master’s thesis aims at understanding the process of planning and implementation of development project. It focuses in particular on the description and analysis of various stages of the project, especially in terms of their management and elimination of potential risks. The first part of the thesis deals mainly with theoretical introduction of the topic and definition of basic concepts and methods. The second part of the work is already trying to map a specific development project and to analyze its real progress. This section also proposed other possible approaches to addressing certain specific tasks within the individual phases and the elimination of potential risks that the project actually occurred, including the proposal of optimal process for managing development project.
