Kekuatan Hukum “Derden Verzet” Dalam Suatu Perjanjian

Kedudukan pihak ketiga untuk menuntut haknya dalam suatu ikatan perjanjian dinilai memiliki kedudukan yang lemah sehingga pihak ketiga enggan untuk terlibat dalam suatu sengketa padahal kepentingan ada dalam perjanjian yang dibuat oleh pihak lain, padahal akibat sengketa tersebut dapat menimbulkan kerugian bagi pihak ketiga seperti adanya sita jaminan dan sita eksekusi objek yangh disengketakan. Tujuan dari penulisan ilmiah ini adalah untuk mengungkap apakah yang dijadikan sebagai dasar hukum bagi pihak ketiga untuk menuntut haknya atas sita eksekusi yang memiliki hak atas objek yang disita, dan bagaimana kekuatan hukum“Derden Verzet” dalam suatu perjanjian, penulisan ilmiah ini menggunakan tipe penelitian normatif dengan cara mengupkan berbagai macam peraturan perundang-undangan yang terkait dengan objek pembahasan dengan menggunakan pendekatan kasus (case law). Hasil dari penelitian ini menunjukkan bahwa secara pihak ketiga yang memiliki kepentingan terhadap suatu sengketa memiliki kekuatan hukum yang kuat untuk mempertahankan atau memperoleh haknya

INTERNATIONAL TRADE DISPUTE SETTLEMENT THROUGH DISPUTE SETTLEMENT BODY (DSB) AND INTERNATIONAL ARBITRATION BODY

The current trend in international trade is growing rapidly, along with these developments, the problems occurring in trade transactions are also increasing on the other hand the disputes arising in international trade are also increasing, under such conditions it is necessary to have greater legal role to overcome international trade issues. Several international trade dispute settlement institutions have been established but have not been well known and maximized in resolving international trade disputes whereas dispute settlement institutions play a huge role in the effort to create economic stability and world trade. Dispute resolution agencies that need special attention are Dispute Settlement Body and International Arbitration. In  this article author using the goodfaith theory as the importand principle in the dispute dispute of international business. PEMBUATAN CEMILAN BERBAHAN SAGU OLEH SEKELOMPOK IBU-IBU DARI KELURAHAN YABANSAI KOTA JAYAPURA

Sago is a plant that has high nutritional value if it is processed according to production standards. Sago contains the Glycemic Index so it is very good for health, especially for diabetics. The process of making sago snack production in the form of training conducted in Yabansai Village, Heram District, Jayapura City. The method used was the participatory observation method of the object where the lecturer team implementing the activities and the training participants observe and were directly involved (face to face) in each step of their work. In addition, interviews were conducted with community service supervisors with target fields who were PKK mothers who had spare time and had not yet been used to produce something of added value to their family's economy. The activity began with a lecture related to the health benefits of sago as well as a lecture on the implementation instructions for the process of making sago snacks from the preparation of ingredients to the mixing and frying process of snack ingredients and ending with packaging. The end result of this activity provides benefits for activity participants to know and understand that the sago material consumed can be beneficial for health. Participants were also motivated to make sago snack businesses both individually and in partnership to open jobs, especially for those who have spare time and have been wasted so far. Participants understood that if a business wants to grow, it must have a permit from BPOM and a halal certificate from MUI. The important thing that impacts at least two things, 1) preservation of the source of sago material (sago tree) as a typical plant that is only found in certain areas.2) the use of sago raw materials to become a snack product with high economic value and in turn it can create jobs for the general public. Keywords: Sago; health; snacks; participants; motivated; business uni

THE CONTRIBUTION OF ANXIETY TO ENGLISH TEXT COMPREHENSION ABILITY

This study aims to understand how anxiety as a variable contributes to affecting the ability to comprehend English texts using the ex post facto method, with eleventh grade high school students in Jakarta as the respondents. Students’ anxiety is measured based on behavioral and cognitive characteristics listed on the questionnaire given to respondents along with the English test. The results show that there is indeed a difference in anxiety levels on students in working on the various English text comprehension tests given. The results of the English text comprehension tests are generally influenced by the anxiety variable, although the effect is found to be small. Teachers are recommended to use multiple teaching methods, and to teach and motivate the students to read more. Teachers are also recommended to apply multiple variations of ability evaluation in measuring the students’ English text comprehension by using multiple test modes

Working as a teacher must be able to adjust, adapt oneself well to show strong performance as a professional teacher eventhough the situation and learning model have changed like in this pandemic period which previously were face to face directly turned into distance learning with an online system. This is a consideration of the various requirements that must be met by someone who wants to enter and serve himself in the world of education as a professional teacher. AN ANALYSIS OF POLITENESS AND MAXIM VIOLATED IN “BLADE RUNNER 2049” FILM

Politeness strategy is a strategy that is done by someone to make his speech more politely. The politeness strategy can be found in daily conversation, a speech, debating events or from literary works, for instance films or novels. One of the literary works of concerning for this study is “Blade Runner 20489” film. The purpose of this paper is to describe the politeness strategies used in the film which can be found in the conversation between the characters. This research uses the theory of politeness strategy proposed by Lakoff (1973) and the theory of Maxim which proposed by Grice (1975). Lakoff classifies politeness strategies into three types: don’t impose, give options and be friendly. While, Grice proposed the theory of maxim into four types namely, maxim of quantity, maxim of quality, maxim of manner and maxim of relevance. The finding of this study indicates that the characters in Blade Runner 2049 employed all types of politeness strategies in relation to the maxim. It can be concluded that the used of politeness strategies in relation to the maxim can be found in this film

The purpose of the study is to provide an overview of the efforts or steps - steps taken by the Department of Tourism and Cultural Arts, in order to develop a strategy of tourism development in Ponorogo regency in order to have an attraction for tourists. The research is analysis of successful competency (competency standard andbasic competence) Physics in National Examination. This research is descriptive method ofex post facto. This study population is 2 high schools and one private school Pasuruan,Pasuruan and Probolinggo regency. The respondents of this study are physics teachers andstudents. Students in the study were students who graduated in 2008, 2009 and 2010.Measuring achievement of competence using analysis calculating the average of successfulcompetencies, whereas to determine the factors of successful and unsuccessful in thisresearch use questionnaire and interview. Scientific reasoning is an ability to argue the concept of knowledge using scientific principles to build a deep understanding. Scientific reasoning is one of the essential skills in the 21st century as a provision in facing global challenges. Scientific reasoning is also one of the skills needed in learning physics because, in essence, physics learning requires a deep understanding of concepts. The fact shows that the scientific reasoning skills of students are still low. Students tend to solve problems without recognizing ideas and have a tendency to plug and chug as much as they remember, so learning is needed that can improve scientific reasoning skills. This scientific reasoning skill can be applied by combining guided inquiry learning models with multidimensional thinking diagram aids that are packaged in the form of student worksheets. Implementing the guided inquiry learning model will help students in the reasoning process because each process directs students to follow several methods and practices that are similar to scientists in building knowledge. Multidimensional thinking diagrams can help students in each inquiry process and assist students in analyzing and solving problems. Ganti Kerugian Berdasarkan Perjanjian Antara Pengembang Perumahan dengan Konsumen di Atas Tanah Rawan Banjir

The purpose of this study is to give critical thinking to the housing developers who build housing in a flood area that impacts the consumer. The study is based on the incidence of residential land that has flooded in the rainy season, the study was peeled with the prevailing regulatory approach. Results show that the developer's obligation has not been included to compensate the consumer in agreement between the developer and the consumer in case of flooding in residential prone to flood so consumers suffer losses, it is not a state of force (force majeur) because to be said in a state of forced (force majeur) must fulfill the elements of article 1244 Civil Code. To provide the protection of the law for consumers, from the beginning of the agreement must be stated that the housing purchased by consumers is in a safe location of flooding, so that if there is a flood of consumers have a strong legal basis to demand developers.
