Acesso Negado: Transidentidades e Acesso à Justiça no Estado do Maranhão

This paper analyzes the effectiveness of the right to justice when the users of this service are travesties and transsexuals in Maranhão. The research methods used are data analysis and structured interviews with the representatives of the state section of the Order of Attorneys of Brazil and Public Defender’s Office. The conclusion is that regardless of the fact that there are institutions that offer free legal aid in Maranhão, there are other factors interfering with the effectiveness of the service regarding trans people, such as marginalization, symbolic violence and the state of vulnerability and precariousness in which these groups live.O presente trabalho tem como objetivo analisar a efetividade do direito ao acesso à justiça de travestis e transexuais no Estado do Maranhão. Como técnicas de pesquisa utilizamos entrevistas estruturadas com representantes da seccional da Ordem dos Advogados do Brasil e da Defensoria pública do Estado do Maranhão, além de análise de dados. Concluímos que apesar de existirem instituições que oferecem gratuitamente serviço assistência judiciária no Estado do Maranhão, outros fatores interferem na efetividade de acesso à justiça de pessoas trans, como a marginalização, violências simbólicas e o estado de vulnerabilidade e precariedade em que vivem

TRANSFOBIA MATA! HOMICÍDIO E VIOLÊNCIA NA EXPERIÊNCIA TRANS

A transexualidade e a travestilidade são experiências identitárias socialmente construídas, da mesma forma que a identidade de homens e mulheres. Entretanto, ao serem formadas em resistência às normas de gênero, são socialmente marginalizadas e acabam ficando vulneráveis a violências físicas e simbólicas. Analisam-se, nesse estudo, dados acerca da violência letal contra a identidade trans proveniente do ódio transfóbico. Busca-secompreender em que contexto essas agressões se materializam e como algunsorganismos internacionais de proteção a direitos humanoslidam com esses casos.Teoricamente, o trabalho pauta-se nos estudos de Butler (2003), nos entendimentos que os organismos de direitos humanos tem sobre a identidade de gênero, e na noção de discurso proposta por Michel Foucault (2010 ; 2009). Os resultados da pesquisa demonstram que transgêneros possuem grande vulnerabilidade para violência letal, fato que tem chamado atenção das instituições de proteção aos direitos humanos.Palavras-chave: Transexualidade. Homicídio. Direitos humanos.AbstractThe transsexuality and the travesty experience are identity kinds of experiences. Both are socially constructed in the exact same way the identity of men and women are. However, as they are formed in resistance to the gender norm, they are socially marginalized and end up becoming vulnerable to physical and symbolic violence. In this paper, the data concerning lethal violence against the transgender exerted by transphobic hatred is analyzed. The focus of this paper is an attempt of  comprehending the context in which these kinds of aggression arise and how some of the international organizations responsible for the protection of human rights deal with them. This paper uses as a foundation the studies made by Butler (2003), the comprehension of what the organizations of human rights have of gender identity, and the notion of speech proposed by Michel Foucault (2010 ; 2009). The results of this research demonstrate that the transgender is highly vulnerable to lethal violence, a fact that has been calling the attention of the institutions responsible for the protection of human rights.Keywords: Transexuality. THE FRAMES OF AMBIGUITY TRAVESTI IDENTITY EXPERIENCE AND SUBVERSION STRATEGIES

O presente trabalho tem a intenção de analisar a desnaturalização dos conceitos de sexo, gênero e sexualidade, objetivando examinar se essas categorias constroem processos de normalização e fabricação do sujeito humano. Parte-se da hipótese de que a experiência identitária travesti consegue demonstrar o caráter construído de todas as identidades. Desenvolvimento, liberdade e gênero: experiências trans = Development, freedom and gender: trans experiences

This essay seeks to make an examination on how the gender category influences in the development process, based on the concept of development as freedom by Amartya Sen. In view of this purpose, we analyze the main human rights violations suffered by travesties and transsexuals due to the female and male identity construction in contrast to social norms establishing hierarchical positions of men and women as constituents of male and female categories. “JUIZ TÉCNICO” E “JUIZ PENALISTA”: gramática jurídica e gênero nas decisões judiciais sobre a aplicação da lei maria da penha a mulheres trans

Objetivo analisar cinco decisões judiciais prolatadas por dois magistrados de violência doméstica e familiar contra a mulher atinentes à demanda de aplicação da Lei Maria da Penha a mulheres transexuais. Chamo-os de o “juiz técnico” e o “juiz penalista”, pois ambos recorrem a elementos dogmático-jurídicos para fundamentar suas sentenças, antagonizando com o manejo da gramática moral de gênero majoritariamente adotada pelos magistrados brasileiros nos processos envolvendo a questão da violência doméstica e familiar contra a mulheres trans. Adoto a análise qualitativa de documentos judiciais publicados entre 2015 e 2017 na Justiça da Bahia e do Distrito Federal, levantados por intermédio de uma etnografia documental no ciberespaço. Como resultados, noto que o recurso à uma gramática técnico-dogmática, em vez de atender a requisitos de neutralidade da linguagem jurídica, aciona formações discursivas perfeitas por relações articuladas de gênero, raça e classe que produzem sujeitos, ideais de Estado e de gênero.I aim to analyze five rulings of two judges in charge of cases of domestic and family violence against women concerning the demand to adequate the Maria da Penha Law for transexual women. I call them technical judge and criminal judge, because both of them use dogmatic and juridical elements to base their rulings, opposing the use of the moral gender grammar vastly adopted by Brazilian judges in the cases of violence previously mentioned. I adopt the qualitative analysis of judicial documents published between 2015 and 2017 in the courts of law of Bahia and Distrito Federal, which were selected through a documental ethnography of the cyberspace. As a result, I notice that the use of a technical-dogmatic grammar, instead of answering to the requirements of neutrality of the juridical language, it activates perfect discursive formations for articulated relationships of gender, race, and class, which in turn produce subjects and ideals of state and gender

Direitos sexuais, democracia e cidadania na experiência transexual e travesti

The identity of transsexual and transvestite people presents themselves today as one of the most discriminated in Brazilian society. This phenomenon happens because of the normative ideals that establish that for a person to be considered human it needs to observe the norms that determine the coherence and continuity between gender, sex and sexuality. As trans subjects perform their genders in contravention of these norms, they become more vulnerable to physical, symbolic and lethal violence. It is in the face of this reality that we observe trans political subjects using the grammar of rights as a way of overcoming unequal conditions of life. Therefore, we question in this work: to what extent can the use of the grammar of rights by the movements of trans people positively impact on the democratic dynamics related to the citizenship of these subjects? For this analysis, we start from the theoretical-methodological assumptions of discourse theory. We conclude that, although the instrumentalization of this grammar conjures up its own dangers, since it depends to some extent on the bureaucratic activity of the State, it can still contribute to the transformation of the living conditions of the transsexual people.A identidade de pessoas transexuais e travestis apresenta-se hoje como uma das mais discriminadas na sociedade brasileira. Tal fenômeno acontece em decorrência dos ideais normativos que estabelecem que para que uma pessoa seja considerada humana ela necessita observar as normas que determinam a coerência e continuidade entre o gênero, o sexo e a sexualidade. Como sujeitos trans performatizam seus gêneros contrariando essas normas, acabam se tornando mais vulneráveis à violência física, simbólica e letal. É diante dessa realidade que observamos sujeitos políticos trans utilizando a gramática dos direitos como forma de superar as condições desiguais de vida. Logo, questionamos nesse trabalho: em que medida a utilização da gramática dos direitos pelos movimentos de pessoas trans pode impactar positivamente nas dinâmicas democráticas relativas à cidadania desses sujeitos? Para a referida análise, partimos dos pressupostos teóricos-metodológicos da teoria do discurso. Concluímos que, apesar da instrumentalização dessa gramática conjurar seus próprios perigos, pois depende, em certa medida, da atividade burocrática do Estado, ainda assim pode contribuir para a transformação das condições de vida das pessoas transexuais
