    Democracy and judicial Independence

    One of the pillars of British liberal democracy is the independence of the judiciary; but the problem is how to reconcile judicial independence with efficiency in the administration of justice and with public accountability. The former question, though of immense importance, has received ameliorative attention only in the last few years. The latter question has been resolved largely through the consistent, apolitical appointment of persons of high ability to the Bench. One useful mechanism to promote the continued smooth functioning of the judicial system in the U.K. might be the establishment of a Department of State concerned entirely with the administration of justice and judiciary

    All legal systems work under a master narrative ā€“ the self-conception of most actors of the system itself. A master narrative is a short and simple story and it is the underlying premise upon which any legal system is based. It is a simple story because it paints the system in quick broad brushstrokes and at (most) times is oblivious to the paradoxes within it. Furthermore, a master narrative is important for legitimization purposes because the actorsā€™ legitimacy will depend on their (perceived) conformity with the systemā€™s master narrative. Therefore, legitimacy is self-referential; the yardsticks for a legitimate action are contained within the systemā€™s master narrative, not outside of it. When talking about different international courts it is important to remember that they are embedded within a master narrative that is contextual and contingent and, at different points, more or less contested. This paper explores the question of what happens when the master-narrative is in a period of transition (from a state cantered to a post-national world order) and when the actorsā€™ legitimacy, their interpretative endeavours the very fundamentals are in a state of flux. I use the margin of appreciation discussion as a focal point of describing the conflicting narratives under which the European Court of Human Rights works, narratives in which the different actors (judges, attorneys, NGO activists, government agents) and their consequences in terms of the interpretation of the European Convention on Human Rights

    Implementing Strategies to Reduce Central Line-Associated Blood Stream Infections on an Inpatient Pediatric Unit

    STRATEGIES TO REDUCE CENTRAL LINE ASSOCIATED BLOODSTREAM INFECTIONS Every central line associated bloodstream infection (CLABSI) leads to poor outcomes, increased mortality and increased healthcare costs. A pediatric care team in an academic tertiary medical center set a goal to reduce the number of these infections on their unit. The teamā€™s research showed that daily bathing greatly decreases CLABSI. Their baseline metrics demonstrated an unacceptable level of those with central lines being bathed. A root cause analysis revealed that patient and family refusal was the leading cause for those who did not bathe. A performance improvement plan was initiated that consisted of several KPIs. Post their rollout, a marked increase in the number of patients with central lines receiving baths was realized, as was a decrease in central line associated infections. Next steps include becoming a model for other patient care units and Maine Health associated hospitals

    CNTNAP2 variants affect early language development in the general population

    Early language development is known to be under genetic influence, but the genes affecting normal variation in the general population remain largely elusive. Recent studies of disorder reported that variants of the CNTNAP2 gene are associated both with language deficits in specific language impairment (SLI) and with language delays in autism. We tested the hypothesis that these CNTNAP2 variants affect communicative behavior, measured at 2 years of age in a large epidemiological sample, the Western Australian Pregnancy Cohort (Raine) Study. Singlepoint analyses of 1149 children (606 males and 543 females) revealed patterns of association which were strikingly reminiscent of those observed in previous investigations of impaired language, centered on the same genetic markers and with a consistent direction of effect (rs2710102, P = 0.0239; rs759178, P = 0.0248). On the basis of these findings, we performed analyses of four-marker haplotypes of rs2710102ā€“rs759178ā€“rs17236239ā€“rs2538976 and identified significant association (haplotype TTAA, P = 0.049; haplotype GCAG, P = .0014). Our study suggests that common variants in the exon 13ā€“15 region of CNTNAP2 influence early language acquisition, as assessed at age 2, in the general population. We propose that these CNTNAP2 variants increase susceptibility to SLI or autism when they occur together with other risk factors
