Icms e substituição tributária: aferição da racionalidade decisória na adin n. 1851-al e no re n. 593849-mg
Trabalho de Conclusão de Curso (Graduação)O presente trabalho destina-se a defender que toda decisão judicial deve ser fundamentada e racional, haja vista determinação expressa da nossa Constituição Federal de 1988 em seu art. 93, inciso IX e Código de Processo Civil em seu art. 489. Nesse sentido, serão apresentados a comunidade jurídica, um conjunto de critérios mínimos que devem fazer parte de uma decisão judicial, baseado nas imposições da nossa Carta Magna e do nosso Código de Processo Civil, bem como serão expostas teses jurídicas atuais que apresentam reflexões sobre a legitimidade e fundamentação das decisões judiciais. Posto tais considerações sobre a “decisão judicial fundamentada”, cumpre aplica-las a nossa realidade. Nesse momento, para demostrar a necessidade de uma análise legítima das decisões judiciais, serão esmiuçados os julgados do Supremo Tribunal Federal sobre a restituição do Imposto Sobre Circulação de Mercadorias e Serviços pago a mais na chamada Substituição Tributária para frente. Note-se que o STF em dois momentos, quando do julgamento da Ação Direta de Inconstitucionalidade nº 1.851-4 AL e do Recurso Extraordinário nº 593849 MG, enfrentou a mesma problemática, qual seja, se o contribuinte teria direito ou não à diferença entre o valor do ICMS-ST recolhido previamente e aquele realmente devido no momento da venda. No julgamento dos referidos julgados, o STF fixou teses diferentes, tomando decisões contrárias. Diante disso, considerando que toda decisão deve ser racional e fundamentada, bem como partindo da análise de dois julgados sobre a mesma matéria em que teses diferentes foram fixadas, o presente escrito ocupar-se-á em aferir quais das duas decisões mais se aproximou de ser fundamentada e racional com base nas determinações da nossa Carta Magna e do Código de Processo Civil, e ainda, dos escritos atuais sobre a decisão judicial fundamentada
Adaptações neurofisiológicas após sessões de caminhada em declive e caminhada para trás com e sem alívio do peso corporal

certas regiões do sistema nervoso central, frequentemente associada a alterações estruturais,
que refletem uma adaptação do sistema nervoso em resposta a atividades desempenhadas a
curto ou longo prazo. A caminhada, por exemplo, tem sido bastante utilizada para induzir
plasticidade na medula espinhal, sendo uma intervenção interessante do ponto de vista clínico
pela sua simples execução e por promover benefícios para o controle motor e acentuar as
melhorias observadas em diversas condições patológicas. OBJETIVO: O presente estudo tem
como objetivo avaliar os efeitos de uma sessão de caminhada em declive (CD) ou caminhada
para trás (CT) na neurofisiologia da medula espinhal e se esses efeitos são equivalentes com
ou sem o uso de suporte de peso corporal. MÉTODOS: Quinze adultos saudáveis participaram
do estudo, sendo 9 homens e 6 mulheres (26,2 ± 5,8 anos; 76,15 ± 17,98 kg; 1,72 ± 0,10 cm).
Os participantes realizaram 4 visitas ao laboratório, com intervalo de 1 semana. Em cada visita,
foi realizado uma sessão de caminhada de 20 min em quatro diferentes condições, de forma
aleatorizada: 1) CD com peso corporal total (CDPT); 2) CD com alívio de 20% do peso (CD20);
3) CT com peso corporal total (CTPT); 4) CT com alívio de 20% do peso (CT20). O reflexo H do
músculo sóleo (SO) foi mensurado antes (PRE) e após 10 min (POS) e 45 min (POS45) do
término da caminhada. Parâmetros extraídos da alça ascendente da Curva de Recrutamento
(CR) do reflexo H foram comparados entre os tempos e entre as condições (CDPT x CD20 e
CTPT x CT20), além da Inibição Pré-Sináptica (IPS) D1 e D2. Frequência cardíaca (FC),
pressão arterial (PA) e percepção subjetiva de esforço (PSE) também foram mensuradas a
cada 5 min durante a caminhada. Uma ANOVA de medidas repetidas de duas vias foi aplicada
para detectar diferenças nos parâmetros do reflexo H entre as situações (PRE x POS x
POS45) e entre as condições (CDPT x CD20 e CTPT x CT20). Quando necessário, um teste
post hoc LSD foi empregado para detectar diferenças significativas. O nível de significância
adotado foi de p<0,05. RESULTADOS: Foram encontradas reduções significativas em vários
parâmetros da curva associadas aos motoneurônios de diferentes calibres para todas as
condições em momentos distintos, mas não foram detectadas diferenças nos parâmetros
associados aos mecanismos pré-sinápticos (IPS-D1 e IPS-D2), o que mantém aberta a
discussão sobre qual mecanismo neurofisiológico altera o padrão de recrutamento dos
motoneurônios após as diferentes condições de caminhada. CONCLUSÃO: O presente
estudo foi capaz de verificar que 20 minutos de CD e CT foram capazes de gerar adaptações
neurofisiológicas na excitabilidade reflexa dos motoneurônios (MNs) do SO. Aparentemente, o
fato da CD e da CT envolver uma complexidade motora maior do que a caminhada em plano
horizontal, caracterizada principalmente pelas contrações excêntricas dos músculos do
membro inferior pode explicar a redução da excitabilidade geral dos MNs. Além disso, sugere-
se que possivelmente as ligações heterônimas dos nervos de diferentes musculaturas
envolvidas durante a caminhada vão muito além da simples ação de inibição pré-sináptica
entre antagonistas e podem ter influenciado nas respostas apresentadas no presente estudo.
Ainda, foi verificado que mesmo após suporte de 20% do peso, ambas as condições de
caminhada manifestaram adaptações neurofisiológicas na excitabilidade dos MNs do SO.
Estes resultados sugerem, por exemplo, que a CD e a CT podem ser utilizadas como
estratégia de reabilitação para diferentes populações que possuem restrições ortopédicas e
funcionais.Activity-dependent neuroplasticity is characterized by a reorganization in certain regions of the
central nervous system, associated with previous alterations, which reflect an adaptation of the
nervous system in response to activities performed in the short or long term. Walking, for
example, was widely used to induce plasticity in the spinal cord, being an interesting
intervention from the clinical point of view for its simple execution and for promoting benefits for
motor control and accentuating the improvements observed in various pathological conditions.
PURPOSE: The present study aims to evaluate the effects of a downhill walking (DW) or
backward walking (BW) session on spinal cord neurophysiology and whether these effects are
equivalent with or without the use of body weight support. METHODS: Fifteen healthy adults
participated in the study, 9 men and 6 women (26.2 ± 5.8 years; 76.15 ± 17.98 kg; 1.72 ± 0.10
cm). Participants made 4 visits to the laboratory, with a 1 week interval. At each visit, a 20-min
walking session was performed under four different conditions, in a randomized manner: 1) DW
with total body weight (DWTW); 2) DW with 20% body weight support (DW20); 3) BW with total
body weight (BWTW); 4) BW with 20% body weight support (BWT20). The soleus muscle (SO)
H reflex was measured before (PRE) and after 10 min (POS) and 45 min (POS45) after the end
of the walk. Parameters extracted from the ascending loop of the Recruitment Curve (RC) of the
H reflex were compared between times and between conditions, in addition to Presynaptic
Inhibition (PSI) D1 and D2. Heart rate (HR), blood pressure (BP) and subjective perceived
exertion (SPE) were also measured every 5 minutes during walking. A two-way repeated
measures ANOVA was applied to determine differences in the H-reflex parameters between
times (PRE x POS x POS45) and between conditions (CDPT x CD20 and CTPT x CT20). When
necessary, a post hoc LSD test was performed to detect differences. The level of significance
adopted was p <0.05. RESULTS: Reductions were found in several parameters of the curve
associated with motoneurons of different sizes for all conditions at different times, but no
differences were detected in the parameters associated with presynaptic mechanisms (IPS-D1
and IPS-D2), which maintains open discussion on which neurophysiological mechanism alters
the pattern of recruitment of motoneurons after different walking conditions. CONCLUSION:
The present study was able to verify that 20 minutes of walking downhill and backward were
able to generate neurophysiological adaptations in the reflex excitability of the SO motoneurons.
Apparently, the fact that DW and BW involve a greater motor complexity than walking in a
horizontal plane, characterized mainly by eccentric contractions of the muscles of the lower
limb, may explain the reduction in the general excitability of motoneurons (MNs). In addition, it is
necessary that possibly the heteronymous connections of the nerves of different muscles
involved during walking go far beyond the simple action of presynaptic inhibition between
antagonists and may have influenced the responses to the present study. Furthermore, it was
verified that even after the 20% body weight support, the walking conditions manifested
neurophysiological adaptations in the excitability of the SO MNs. These results obtained
demonstrates that a BW and DW can be used as a rehabilitation strategy for different
populations that have orthopedic and adapted restrictions, even with a body weight support
A Genetic Programming Model for Association Studies to Detect Epistasis in Low Heritability Data
The genome-wide associations studies (GWAS) aims to identify the most influential markers in relation to the phenotype values. One of the substantial challenges is to find a non-linear mapping between genotype and phenotype, also known as epistasis, that usually becomes the process of searching and identifying functional SNPs more complex. Some diseases such as cervical cancer, leukemia and type 2 diabetes have low heritability. The heritability of the sample is directly related to the explanation defined by the genotype, so the lower the heritability the greater the influence of the environmental factors and the less the genotypic explanation. In this work, an algorithm capable of identifying epistatic associations at different levels of heritability is proposed. The developing model is a aplication of genetic programming with a specialized initialization for the initial population consisting of a random forest strategy. The initialization process aims to rank the most important SNPs increasing the probability of their insertion in the initial population of the genetic programming model. The expected behavior of the presented model for the obtainment of the causal markers intends to be robust in relation to the heritability level. The simulated experiments are case-control type with heritability level of 0.4, 0.3, 0.2 and 0.1 considering scenarios with 100 and 1000 markers. Our approach was compared with the GPAS software and a genetic programming algorithm without the initialization step. The results show that the use of an efficient population initialization method based on ranking strategy is very promising compared to other models
Vespas sociais capturadas pela aranha Trichonephila clavipes (L.) em ambientes antropizados associados a fragmentos de Mata Atlântica no sul de Minas Gerais, Brasil
Spiders are found in diverse natural ecosystems and urban environments, exhibiting a broad variety of morphological characteristics and prey-capture strategies. These arthropods play important functions in trophic chains, acting as both predators and prey, which is of great relevance for ecosystem management and biological control in agricultural systems. This study aimed to identify social wasps captured by Trichonephila clavipes (L., 1767) in anthropogenic areas associated with semideciduous seasonal forest fragments. The study was conducted in 2023 in anthropogenic areas associated with Atlantic Forest fragments in southern Minas Gerais, Brazil. Two individuals of Protopolybia sedula (de Saussure, 1854) were recorded. The specimens were captured in suspended webs of T. clavipes. Given the paucity of information on this interaction, further research is needed to better understand the frequency and impact of the relationship on social wasp populations.Aranhas são encontradas em diversos ecossistemas naturais e ambientes urbanos, e exibem uma ampla variedade de características morfológicas e estratégias de captura de presas. Desempenham importantes funções nas cadeias tróficas, seja como predadores e presas, o que tem relevância para o manejo de ecossistemas e o controle biológico em sistemas agrícolas, portanto, o objetivo deste trabalho é relatar vespas sociais capturadas por Trichonephila clavipes (L., 1767) em áreas antropizadas associadas a fragmentos de floresta estacional semidecidual. O estudo foi conduzido em 2023 em áreas antrópicas associadas a fragmentos de Mata Atlântica no sul de Minas Gerais, Brasil. Foram registrados dois indivíduos de Protopolybia sedula (de Saussure, 1854), presos em teias suspensas dessa aranha. Dada a escassez de informações sobre essa interação, ressalta-se a necessidade de pesquisas adicionais para compreender melhor a frequência e o impacto dessa relação sobre as populações de vespas sociais
Fitness muses as docile bodies: an analysis of normalization processes in contemporary culture
Este artigo analisa as estratégias de docilização do corpo feminino por meio dos perfis de Eva Andressa e Gabriela Pugliesi, duas musas fitness famosas no Instagram. As duas se apresentam de modos diferentes: Andressa é adepta do bodybuilding e da suplementação proteica, e Pugliesi mantém um corpo esguio com base na atividade física regular e na alimentação vegana. Por meio da observação de suas postagens e de comentários, notamos que seus corpos são marcados por modos distintos de construção da feminilidade: uma é questionada pelo excesso de músculos, e a outra é saudada pelo corpo magro, considerado mais delicado e feminino. Mesmo assim, concluímos que as duas se afirmam como experts a partir de seus próprios corpos e de suas experiências de cuidado de si reconhecidas como bem-sucedidas pelos seus seguidores.Palavras-chave: Corpo feminino. Docilização. Fitness. Instagram. Saúde.This article analyzes female body docilization strategies through the profiles of Eva Andressa and Gabriela Pugliesi, two famous fitness muses on Instagram. Both come in different ways: Andressa is adept at bodybuilding and protein supplementation, and Pugliesi maintains a slender body based on regular physical activity and vegan nutrition. By observing their posts and commenting, we note that their bodies are marked by distinct ways of constructing femininity: one is questioned by excess muscle, and the other is hailed by the thin, more delicate and feminine body. Nevertheless, we conclude that the two assert themselves as experts from their own bodies and from their self-care experiences recognized as successful by their followers.Keywords: Female body. Volatile compounds and protein profiles analyses of fermented cocoa beans and chocolates from different hybrids cultivated in Brazil
Cocoa beans from different geographical and genetic origins show distinct fermentation dynamics which result in different chocolate qualities. In order to understand the effects of genetic improvement of cocoa plants, in this work volatile compounds and proteins profiles of beginning and end of the fermentation from different cocoa hybrids (CEPEC2004, PH15, PS1319, SJ02) were searched. Moreover, sensorial characterization of the produced chocolate from these hybrids was performed. According to the results obtained, different volatile compounds were identified in fermented beans and in the chocolate produced. Chocolate from CEPEC2004 was the most accepted by judges and correlated with sweet and bitter taste which can be explained by the presence of desired flavor compounds, such as 2,3-butanediol and 2-methyl-1-butanol. A higher presence of acids (undesirable compounds) was observed in chocolates samples from PS1319 hybrid, that have resulted in the low acceptance by judges. In addition, MALDI-TOF MS analysis showed that during fermentation the protein profile was different among the hybrids, which indicates this kind of compounds also contributes to the cocoa-specific flavor.Cledir Santos thanks the Universidad de La Frontera (Temuco, Chile) for the partial funding from Project DIUFRO PIA 17-0006. Liquid-phase microextraction (LPME): fundamentals and applications to the analysis of drugs in biological samples
The analysis of drugs and metabolites in biological fluids usually requires extraction procedures to achieve sample clean-up and analyte preconcentration. Commonly, extraction procedures are performed using liquid-liquid extraction or solid-phase extraction. Nevertheless, these extraction techniques are considered to be time-consuming and require a large amount of organic solvents. On this basis, microextraction techniques have been developed. Among them, liquid-phase microextraction has been standing out. This review describes the liquid-phase microextraction technique based on hollow fibers as a novel and promising alternative in sample preparation prior to chromatographic or electrophoretic analysis. The basic concepts related to this technique and its applicability in extraction of drugs are discussed
Uma ferramenta baseada em inteligência artificial para exploração de espaço de projeto para redes em chip / An artificial intelligence-based tool for exploiting design space for chip networks
Com o incremento em números de núcleos em sistemas em chip, arquiteturas de barramento tem sofrido com algumas limitações. Os requisitos das aplicações demandam mais largura de banda e baixas latências. Em face a esse cenário, redes em chip emergiram como uma opção para superar essas limitações. Redes em chip são compostas por um conjunto de roteadores e enlaces de comunicação. Nesse trabalho, nós propomos o uso de técnicas de inteligência artificial para otimizar a arquitetura das redes em chip. A ferramenta explora o espaço de projeto em termos de predição de área, latência e potência para diferentes configurações.
