    Unlocking IP to stimulate Australian innovation: An issues paper

    \u27Public rights\u27 in intellectual goods (the broad usage of \u27the public domain\u27), are increasingly important as a driver of innovation in information economies. This submission examines ten areas where changes to strengthen or protect Australia\u27s copyright public domain may be desirable to encourage innovation. They are intended to be areas where change is possible within the constraints of our Constitution and international obligations, rather than impractical areas such as changes to the copyright term. The ten areas are: The scope for further exceptions to copyright; Legal deposit\u27s role in the public domain; Finding missing rights-holder (orphan works); Enabling open content licensing to thrive; Maximising the value of free and open source software (FOSS); Moving toward open standards; Coexistence of open content and compulsory licences; Re-usable government works; Public rights in publicly-funded research; and Indigenous culture\u27s relationship to the public domain

    The Meaning of 'Free Access to Legal Information': A Twenty Year Evolution

    Free online access to legal information is approaching maturity in some parts of the world, after two decades of development, but elsewhere is still in its early stages of development. Nowhere has it been realised fully.  The main question asked in this paper is “what should 'free access' mean in relation to legal information in order for it to be fully effective?” As with software, we must ask whether free access to law is ‘free as in beer, or free as in speech?’ The six most significant attempts over the last twenty years to answers this question are analysed to show that a substantial degree of international consensus has developed on what ‘free access to legal information’ now means. Of thirty separate identifiable principles, most are found in more than one statement of principles, and many are now relatively common in the practices of both States and providers of free access to legal information (government and NGO). Many concern measure to avoid the development of monopolies in publication of the core legal documents of a jurisdiction. Which principles are essential to the meaning of ‘free access to legal information’, and which are only desirable, is usually clear. Two complementary meanings of ‘free access to legal information’ emerge. The first states the obligations of the State in relation to ensuring free access to legal information – but not necessarily providing it. The key elements concern the right of republication. The second meaning states the conditions under which an organisation can correctly be said to be a provider of free access to legal information. We argue that a better definition is needed than the ‘consensus’ suggests, and propose one based on the avoidance of conflicts with maximisation of the quality and quantity of free access. One use of such a set of principles is to help evaluate the extent to which any particular jurisdiction has implemented free access to legal information. A brief example is given of Australia, a county with a generally good record but some deficiencies. Finally the paper considers what steps should be taken to most effectively realise a reformulated concept of ‘free access to legal information’, by civil society, by States at the national level, and at the international level

    Servant Leadership and Follower Job Performance: The Mediating Effect of Public Service Motivation

    This article advances our understanding of the effects of servant leadership, an employee- and community-focused leadership style, on followers’ public service motivation (PSM) and job performance. Based on social learning theory, we argue that by emphasizing to their followers the importance of serving others both inside and outside the organization and by acting as role models by serving others themselves, servant leaders enhance job performance by engendering higher PSM in their followers. A multi-level analysis of three waves of multi-source data from a Chinese government agency reveals that PSM mediates the influence that servant leadership has on followers’ job performance. The results are consistent with the theoretical predications that the altruistic behaviour displayed by servant leaders elicits higher levels of the altruistic behaviours that characterize PSM, which in turn increases job performance. Hence, this study contributes to our overall understanding of how leadership drives performance in the public sector

    Servant Leadership, Trust, and the Organizational Commitment of Public Sector Employees in China

    Servant leaders strive selflessly and altruistically to assist others before themselves, work to develop their followers to their greatest potential, and seek to benefit the wider community. This paper examines the trust-based mechanisms by which servant leadership influences organizational commitment in the Chinese public sector, using data from a survey of civil servants. Quantitative analysis shows that servant leadership strongly influences affective and normative commitment, while having no impact on continuance commitment. Furthermore, we find that affective trust rather than cognitive trust is the mechanism by which servant leadership induces higher levels of commitment. Our findings suggest that in a time of decreasing confidence levels in public leaders, servant leadership behavior may be used to reestablish trust and create legitimacy for the Chinese civil service

    The Servant Leadership Survey: Development and Validation of a Multidimensional Measure

    Purpose: The purpose of this paper is to describe the development and validation of a multi-dimensional instrument to measure servant leadership. Design/Methodology/Approach Based on an extensive literature review and expert judgment, 99 items were formulated. In three steps, using eight samples totaling 1571 persons from The Netherlands and the UK with a diverse occupational background, a combined exploratory and confirmatory factor analysis approach was used. This was followed by an analysis of the criterion-related validity. Findings: The final result is an eight-dimensional measure of 30 items: the eight dimensions being: standing back, forgiveness, courage, empowerment, accountability, authenticity, humility, and stewardship. The internal consistency of the subscales is good. The results show that the Servant Leadership Survey (SLS) has convergent validity with other leadership measures, and also adds unique elements to the leadership field. Evidence for criterion-related validity came from studies relating the eight dimensions to well-being and performance. Implications: With this survey, a valid and reliable instrument to measure the essential elements of servant leadership has been introduced. Originality/Value The SLS is the first measure where the underlying factor structure was developed and confirmed across several field studies in two countries. It can be used in future studies to test the underlying premises of servant leadership theory. The SLS provides a clear picture of the key servant leadership qualities and shows where improvements can be made on the individual and organizational level; as such, it may also offer a valuable starting point for training and leadership development

    Stressful conditions reveal decrease in size, modification of shape but relatively stable asymmetry in bumblebee wings

    Human activities can generate a wide variety of direct and indirect effects on animals, which can manifest as environmental and genetic stressors. Several phenotypic markers have been proposed as indicators of these stressful conditions but have displayed contrasting results, depending, among others, on the phenotypic trait measured. Knowing the worldwide decline of multiple bumblebee species, it is important to understand these stressors and link them with the drivers of decline. We assessed the impact of several stressors (i.e. natural toxin-, parasite-, thermic- and inbreeding-stress) on both wing shape and size and their variability as well as their directional and fluctuating asymmetries. The total data set includes 650 individuals of Bombus terrestris (Hymenoptera: Apidae). Overall wing size and shape were affected by all the tested stressors. Except for the sinigrin (e.g. glucosinolate) stress, each stress implies a decrease of wing size. Size variance was affected by several stressors, contrary to shape variance that was affected by none of them. Although wing size directional and fluctuating asymmetries were significantly affected by sinigrin, parasites and high temperatures, neither directional nor fluctuating shape asymmetry was significantly affected by any tested stressor. Parasites and high temperatures led to the strongest phenotype modifications. Overall size and shape were the most sensitive morphological traits, which contrasts with the common view that fluctuating asymmetry is the major phenotypic marker of stress

    Hypnosis Antenatal Training for Childbirth (HATCh): a randomised controlled trial [NCT00282204]

    BACKGROUND: Although medical interventions play an important role in preserving lives and maternal comfort they have become increasingly routine in normal childbirth. This may increase the risk of associated complications and a less satisfactory birth experience. Antenatal hypnosis is associated with a reduced need for pharmacological interventions during childbirth. This trial seeks to determine the efficacy or otherwise of antenatal group hypnosis preparation for childbirth in late pregnancy. METHODS/DESIGN: A single centre, randomised controlled trial using a 3 arm parallel group design in the largest tertiary maternity unit in South Australia. Group 1 participants receive antenatal hypnosis training in preparation for childbirth administered by a qualified hypnotherapist with the use of an audio compact disc on hypnosis for re-enforcement; Group 2 consists of antenatal hypnosis training in preparation for childbirth using an audio compact disc on hypnosis administered by a nurse with no training in hypnotherapy; Group 3 participants continue with their usual preparation for childbirth with no additional intervention. Women > 34 and < 39 weeks gestation, planning a vaginal birth, not in active labour, with a singleton, viable fetus of vertex presentation, are eligible to participate. Allocation concealment is achieved using telephone randomisation. Participants assigned to hypnosis groups commence hypnosis training as near as possible to 37 weeks gestation. Treatment allocations are concealed from treating obstetricians, anaesthetists, midwives and those personnel collecting and analysing data. Our sample size of 135 women/group gives the study 80% power to detect a clinically relevant fall of 20% in the number of women requiring pharmacological analgesia – the primary endpoint. We estimate that approximately 5–10% of women will deliver prior to receiving their allocated intervention. We plan to recruit 150 women/group and perform sequential interim analyses when 150 and 300 participants have been recruited. All participant data will be analysed, by a researcher blinded to treatment allocation, according to the "Intention to treat" principle with comprehensive pre-planned cost- benefit and subgroup analyses. DISCUSSION: If effective, hypnosis would be a simple, inexpensive way to improve the childbirth experience, reduce complications associated with pharmacological interventions, yield cost savings in maternity care, and this trial will provide evidence to guide clinical practice
