    The Principles of Subsidiarity and Decentralisation During the COVID-19 Pandemic, with Particular Emphasis on the Polish and Finnish Legal Systems

    The article focuses on the principles of subsidiarity and decentralisation during the COVID-19 pandemic, with particular emphasis on the Polish and Finnish legal systems (both countries in the Baltic Sea Region). How were those constitutional principles concerning self-government “treated” (dealt with) by public authorities? It analyses the principles of subsidiarity and decentralisation, interpretations of the principle of decentralisation in both Poland and Finland, relations between the state and local self-government, cooperation between the government and self-government administration in combating the pandemic in selected countries, and Polish and Finnish regulations during the pandemic. Methodologically speaking, many different  methods and sources are applied. The methodological  approach is analytical (analysis of legal acts, literature, media releases and different reports), but also empirical (observation of reality). The thesis is that the principles of subsidiarity and decentralisation during the COVID-19 pandemic were commonly disregarded during the pandemic

    This is rather the first book with a title Philosophy of Law in the Arctic in the literature. This philosophy of law is a very wide and cross-disciplinary area of research: between law, philosophy, anthropology, history, cultural ecology or environmental studies. I have no doubts that we have done such kind of philosophy in the academia so far, not using this term, but keeping up with the concept, the idea. The book is a result of research conducted by many members of the Sub-group of Philosophy of Law in the Arctic (the University of the Arctic). This team seems a very interdisciplinary academic group. Our cooperation bears fruit. The aim of the book is to define and systematise Arctic legal philosophy problems. In this book, there are five thematic parts. Each part consists of two-five short articles (we can call them also chapters or papers). These are the sixteen short articles all together. Each article consists of between six and fourteen pages. So going further, what we see in the book then is, in fact, a set of both theoretical and practical papers. The topics of these papers (chapters) are different as the authors are different while representing a wide-ranging scope of academic disciplines or specialisations. Each paper is followed by a relevant bibliography, which might be helpful for other scholars interested in the field. The seventeen writers come from such countries as Finland (4), Norway (1), Canada (3), Poland (3), Japan (2), Austria (1), Ireland (1), and England (2). Some of them have Arctic indigenous roots (3).     Relationship Between Anti-DFS70 Autoantibodies and Oxidative Stress

    Background: The anti-DFS70 autoantibodies are one of the most commonly and widely described agent of unknown clinical significance, frequently detected in healthy individuals. It is not known whether the DFS70 autoantibodies are protective or pathogenic. One of the factors suspected of inducing the formation of anti-DFS70 antibodies is increased oxidative stress. We evaluated the coexistence of anti-DFS70 antibodies with selected markers of oxidative stress and investigated whether these antibodies could be considered as indirect markers of oxidative stress. Methods: The intensity of oxidative stress was measured in all samples via indices of free-radical damage to lipids and proteins such as total oxidant status (TOS), concentrations of lipid hydroperoxides (LPH), lipofuscin (LPS), and malondialdehyde (MDA). The parameters of the non-enzymatic antioxidant system, such as total antioxidant status (TAS) and uric acid concentration (UA), were also measured, as well as the activity of superoxide dismutase (SOD). Based on TOS and TAS values, the oxidative stress index (OSI) was calculated. All samples were also tested with indirect immunofluorescence assay (IFA) and 357 samples were selected for direct monospecific anti DFS70 enzyme-linked immunosorbent assay (ELISA) testing. Results: The anti-DFS70 antibodies were confirmed by ELISA test in 21.29% of samples. Compared with anti-DFS70 negative samples we observed 23% lower concentration of LPH (P =.038) and 11% lower concentration of UA (P =.005). TOS was 20% lower (P =.014). The activity of SOD was up to 5% higher (P =.037). The Pearson correlation showed weak negative correlation for LPH, UA, and TOS and a weak positive correlation for SOD activity. Conclusion: In samples positive for the anti-DFS70 antibody a decreased level of oxidative stress was observed, especially in the case of samples with a high antibody titer. Anti-DFS70 antibodies can be considered as an indirect marker of reduced oxidative stress or a marker indicating the recent intensification of antioxidant processes

    Analysis of the impact of sex and age on the variation in the prevalence of antinuclear autoantibodies in Polish population: a nationwide observational, cross-sectional study

    The detection of antinuclear autoantibody (ANA) is dependent on many factors and varies between the populations. The aim of the study was first to assess the prevalence of ANA in the Polish adult population depending on age, sex and the cutoff threshold used for the results obtained. Second, we estimated the occurrence of individual types of ANA-staining patterns. We tested 1731 patient samples using commercially available IIFA using two cutoff thresholds of 1:100 and 1:160. We found ANA in 260 participants (15.0%), but the percentage of positive results strongly depended on the cutoff level. For a cutoff threshold 1:100, the positive population was 19.5% and for the 1:160 cutoff threshold, it was 11.7%. The most prevalent ANA-staining pattern was AC-2 Dense Fine speckled (50%), followed by AC-21 Reticular/AMA (14.38%) ANA more common in women (72%); 64% of ANA-positive patients were over 50 years of age. ANA prevalence in the Polish population is at a level observed in other highly developed countries and is more prevalent in women and elderly individuals. To reduce the number of positive results released, we suggest that Polish laboratories should set 1:160 as the cutoff threshold

    Indigenous peoples, their rights and customary laws in the North: the case of the Sámi people

    The paper focuses on indigenous peoples, their rights and customary laws in the North in context of the Sámi people situation in the Nordic countries and Russia. It is to analyse and conceptualise some important issues concerning Sámi customary laws in the light of indigenous rights, constitutional law and legal pluralism as well as to propose new forms of cooperation between universities or scholars in the North in research in this field. First, after proposing new forms of academic cooperation, we flash focus on theory of legal pluralism and on Sámi customary laws. Secondly, we differ the institutional axiology from the real axiology in state legal orders. Thirdly, we analyse rules concerning the Sámi in Finland’s legislation, Sweden’s constitutional acts and Norway’s Constitution. Fourthly, we express some chosen conflicts of laws: Sámi laws versus national laws and interests. Fifthly, using many criteria, we try to evaluate the Nordic countries in the field of recognition of indigenous rights. Sixthly, we show Russia’s laws and Sámi problems (the Ponoi case and violation of the Russian Sámi rights). Seventhly, we consider contemporary problems of Sámi: the right of indigenous peoples to customary law, the right to self-determination as a basis of Sámi claims, and finally, treating Sámi as “people”, “nation”, not “ethnic minority”. I also analyse what was behind the current state of affairs in Scandinavia, proposing a classification of political, ideological, religious and educational, economic, and cultural factors. In the conclusion, I maintain that indigenous rights, including Sámi rights to land and political self-government, should be better recognised in the North. It still remains a paradox, as the problem is not resolved in Scandinavian liberal societies, which are supposed to be sensitive in the field of human rights and protection of cultural diversity. I think that going back to customary laws or legal pluralism is such an inspiration for seeking new forms of political organisation of the Sámi people in Scandinavia (and maybe in Russia)
