The exchange trial is one of the existing special processes, together with the payment order process, which have been created by the legislator in the field of civil procedural law, with the aim of obtaining a jurisdictional protection against credit rights. All these credit rights are incorporated in several of the existing exchange documents: bills of exchange, checks and promissory notes and are regulated thanks to the new Civil Procedure Law, as well as by the Exchange and Check Law. They are very important, because they are titles and documents, which nowadays are needed on a daily basis to be able to carry out transactions and relations within the commercial sphere, protecting above all the exchange creditor, granting him a privileged procedural situation, with several procedures within his reach, such as: the admission of the brief claim, the issuance of an injunction for payment, an immediate order of seizure of the debtor's assets and if the debtor opposes in due time and form to such injunction, the power to issue a writ of execution against the debtor. This, in this way, with these various procedures, this type of civil process and of exchange matter, they manage to make effective the credit rights of the creditor, which may be stated in one of the three existing exchange instruments.Departamento de Derecho Constitucional, Procesal y Eclesiástico del EstadoGrado en Derech

Facciones, linajes y conflictos urbanos en la Europa bajomedieval. Modelos y análisis a partir de Castilla y Toscana

Urban conflicts are a main historiographical field which study has been often conditioned by prejudices and misconceptions that prevented an appropriate knowledge of the development and consequences of their social, political, anthropological and cultural manifestations. In Italian cities, the so-called weigh of the political values from the Ancient world that would have been transferred to the Western civilization, has burdened our perception of the historical reality. Particularly regarding conflicts: an aspect that did not fit the ideal political virtues of the Italian comune. In the Castilian case, the main problem is the excessive political prominence attributed to royal power and its institutional and legal system, an approach that was reinforced in the 80’s when it was linked to the origins of the «Modern State». These perspectives have limited the study of urban conflicts in a complex political society that also managed the control of violence. The article proves that, by putting aside some of the mentioned perspectives, it is possible to achieve new findings regarding conflicts, social behavior in urban history

Redefining the Common Causes of Social Struggles: An Examination of the Antinomies of Value, Labor and Subsumption

In the global contemporary political context, diverse social struggles are being alienated from each other to the point that the illusion of capitalism as the only possible socio-economic system is blurring all horizons of social change. In this article, we will aim to redefine the common causes of social struggles, by demonstrating their intersectionality and interdependence. In order to do so, we will engage with a number of concepts from Marx’s philosophy. In the introduction, we will examine the notion of value, claiming that Marx’s value theory is not simply a labor theory of value, but that it rather reflects the parallax structure of production and circulation, crystallized in the ultimate value-form of money. Having obtained these preliminary insights, we will go back to the phenomenon of labor in capitalism, to reinterpret, in the first section of the article, the Marxian distinction between productive and unproductive labor. From this will follow the first concrete examples of the intersectionality of social struggles against the abstraction of capital: namely, showing that gender and racial struggles have certain common causes, rooted in the Gramscian hegemony. In the second section, we will examine the distinction that Marx establishes between the formal and the real subsumption. The latter, we will claim, is decisive for understanding how capital structures the quasi-totality of our social relations. Following an interpretation of Maren Ade’s film Toni Erdmann, we will propose some possible means of intersectional struggle against real subsumption, that will find their theoretical backing in the concept of subversive universals. The concluding remarks will address the nuclear logic of the distribution and accumulation of capital, a symptom that survives throughout history preserved and driven by the omnipresence of ideology, and stress again implicitly the importance of common struggle in the unfreezing of emergence of a new revolutionary subject

The Cinematic Daydream as a Tool of Political Emancipation: Plus-de-Jouir, Aufhebung and the Parallax

In this research, we will start by expo- sing the paradox of ‘surplus enjoyment’ (the Lacanian plus-de-jouir), showing that its parallax structure of lack and excess is also applicable to the pheno- menon of (surplus) repression. Linking his concept with the Hegelian Aufhebung, understood as a ‘failed negation of negation’ or a ‘negation of negation’ as failure, we will focus in detail on the central example illustrating our theoretical positions, which is Iciar Bollain’s film Tambien la Lluvia (Even the Rain). In analyzing its narrative structures that address the neocolonial reality, we will tend to approach indirectly, by reading the medium of cinematic narration, the ‘neocolonial question.

Ascenso de los discursos de extrema derecha en Chile: una aproximación desde la teoría crítica

Considering the political and social contingency at the international level nowadays, but with respect to the Chilean reality, we have proposed to interpret the rise of extreme right-wing and neo-fascist discourses. To address this problem, some guidelines of psychoanalytic thought applied to the field of culture were used, which from an early date addressed the problem of interpreting sociocultural phenomena, recognizing a relationship of imbrication and continuity between the conditions of culture, the social functioning, and the ways in which these phenomena find a place of embodiment in the experience of the subject. Within this framework of interpretation, we have opted for the validity of the concepts elaborated by authors linked to critical theory, with special emphasis on the ideas established by Reich, Adorno, and Benjamin, based on their receptions of Freudian theory.

The transcription factor LEF1 interacts with NFIX and switches isoforms during adult hippocampal neural stem cell quiescence

Stem cells in adult mammalian tissues are held in a reversible resting state, known as quiescence, for prolonged periods of time. Recent studies have greatly increased our understanding of the epigenetic and transcriptional landscapes that underlie stem cell quiescence. However, the transcription factor code that actively maintains the quiescence program remains poorly defined. Similarly, alternative splicing events affecting transcription factors in stem cell quiescence have been overlooked. Here we show that the transcription factor T-cell factor/lymphoid enhancer factor LEF1, a central player in canonical beta-catenin-dependent Wnt signalling, undergoes alternative splicing and switches isoforms in quiescent neural stem cells. We found that active beta-catenin and its partner LEF1 accumulated in quiescent hippocampal neural stem and progenitor cell (Q-NSPC) cultures. Accordingly, Q-NSPCs showed enhanced TCF/LEF1-driven transcription and a basal Wnt activity that conferred a functional advantage to the cultured cells in a Wnt-dependent assay. At a mechanistic level, we found a fine regulation of Lef1 gene expression. The coordinate upregulation of Lef1 transcription and retention of alternative spliced exon 6 (E6) led to the accumulation of a full-length protein isoform (LEF1-FL) that displayed increased stability in the quiescent state. Prospectively isolated GLAST + cells from the postnatal hippocampus also underwent E6 retention at the time quiescence is established in vivo. Interestingly, LEF1 motif was enriched in quiescence-associated enhancers of genes upregulated in Q-NSPCs and quiescence-related NFIX transcription factor motifs flanked the LEF1 binding sites. We further show that LEF1 interacts with NFIX and identify putative LEF1/NFIX targets. Together, our results uncover an unexpected role for LEF1 in gene regulation in quiescent NSPCs, and highlight alternative splicing as a post-transcriptional regulatory mechanism in the transition from stem cell activation to quiescence.Peer reviewe

Early detection of anthracycline- and trastuzumab-induced cardiotoxicity: value and optimal timing of serum biomarkers and echocardiographic parameters.

    Get PDF
Aims To evaluate echocardiographic and biomarker changes during chemotherapy, assess their ability to early detect and predict cardiotoxicity and to define the best time for their evaluation. Methods and results Seventy-two women with breast cancer (52 ± 9.8 years) treated with anthracyclines (26 also with trastuzumab), were evaluated for 14 months (6 echocardiograms/12 laboratory tests). We analysed: high-sensitivity cardiac troponin T, NT-proBNP, global longitudinal strain (GLS), left ventricle end-systolic volume (LVESV), left ventricle end-diastolic volume (LVEDV), and left ventricular ejection fraction (LVEF). Cardiotoxicity was defined as a reduction in LVEF>10% compared with baseline with LVEF<53%. High-sensitivity troponin T levels rose gradually reaching a maximum peak at 96 ± 13 days after starting chemotherapy (P < 0.001) and 62.5% of patients presented increased values during treatment. NT-proBNP augmented after each anthracycline cycle (mean pre-cycle levels of 72 ± 68 pg/mL and post-cycle levels of 260 ± 187 pg/mL; P < 0.0001). Cardiotoxicity was detected in 9.7% of patients (mean onset at 5.2 months). In the group with cardiotoxicity, the LVESV was higher compared with those without cardiotoxicity (40 mL vs. 29.5 mL; P = 0.045) at 1 month post-anthracycline treatment and the decline in GLS was more pronounced ( 17.6% vs. 21.4%; P = 0.03). Trastuzumab did not alter serum biomarkers, but it was associated with an increase in LVESV and LVEDV (P < 0.05). While baseline LVEF was an independent predictor of later cardiotoxicity (P = 0.039), LVESV and GLS resulted to be early detectors of cardiotoxicity [odds ratio = 1.12 (1.02–1.24), odds ratio = 0.66 (0.44–0.92), P < 0.05] at 1 month post-anthracycline treatment. Neither high-sensitivity troponin T nor NT-proBNP was capable of predicting subsequent cardiotoxicity. Conclusions One month after completion of anthracycline treatment is the optimal time to detect cardiotoxicity by means of imaging parameters (LVESV and GSL) and to determine maximal troponin rise. Baseline LVEF was a predictor of later cardiotoxicity. Trastuzumab therapy does not affect troponin values hence imaging techniques are recommended to detect trastuzumab-induced cardiotoxicity.post-print3194 K
