    L’observança de la legislació sobre drets d’autor entre particulars funciona de la mateixa manera a tota la UE? Des de la creació de Napster, la còpia domèstica d’arxius digitals ha emprès el vol. Els primers proveïdors de programari o d’infraestructures per a l’intercanvi il·legal d’arxius van ser considerats responsables subsidiaris o contributius d’una infracció de drets d’autor. Com a resposta, van diluir ràpidament la cadena de responsabilitats fins al punt que ni els productors de programari ni els proveïdors de serveis van poder ser considerats responsables. Baixant de nivell en la cadena de comunicació, els titulars de drets exigeixen ara que els proveïdors d’internet els facilitin l’accés als usuaris finals per a ajudar-los a fer complir els seus drets. Aquest article aborda la jurisprudència relativa a l’aplicació dels drets d’autor per part dels proveïdors d’internet d’arreu d’Europa. A primera vista, l’aplicació dels drets d’autor ha estat harmonitzada per mitjà d’una sèrie de directives, i l’article 8(3) de la Directiva de drets d’autor (2001/29/EC) estableix que els estats membres de la UE han de garantir la posició dels titulars de drets en relació amb els requeriments judicials contra els proveïdors d’internet. Problema resolt? Aquest article analitza la jurisprudència de Dinamarca, Irlanda, Bèlgica, Noruega, Anglaterra, Països Baixos, Àustria i el Tribunal de Justícia de la UE. A més, examina les pràctiques legals vigents a Alemanya. El període de temps cobert per la jurisprudència va del 2003 al 2013; la jurisprudència ajuda a entendre millor les diferències que encara subsisteixen després de la implantació de la directiva.Copyright enforcement by private third parties – does it work uniformly across the EU? Since the inception of Napster, home copying of digital files has taken flight. The first providers of software or infrastructure for the illegal exchange of files were held contributory or vicariously liable for copyright infringement. In response, they quickly diluted the chain of liability to such an extent that neither the software producers, nor the service providers could be held liable. Moving further down the communication chain, the rights holders are now requiring Internet Service Providers (ISPs) that provide access to end customers to help them with the enforcement of their rights. This article discusses case law regarding the enforcement of copyright by Internet Access Providers throughout Europe. At first glance, copyright enforcement has been harmonised by means of a number of directives, and article 8(3) of the Copyright Directive (2001/29/EC) regulates that EU Member States must ensure the position of rights holders with regard to injunctions against ISPs. Problem solved? Case law from Denmark, Ireland, Belgium, Norway, England, The Netherlands, Austria and the Court of Justice of the EU was studied. In addition, the legal practice in Germany was examined. The period of time covered by case law is from 2003 to 2013; the case law gives insight into the differences that still exist after implementation of the directive.¿Funciona del mismo modo en toda la UE la observancia de la legislación sobre derechos de autor entre particulares? Los primeros proveedores de software o de infraestructuras para el intercambio ilegal de archivos fueron considerados responsables subsidiarios o contributivos de una infracción de derechos de autor. Como respuesta, diluyeron rápidamente la cadena de responsabilidades hasta el punto de que ni los productores de software ni los proveedores de servicios pudieron ser considerados responsables. Bajando de nivel en la cadena de comunicación, los titulares de derechos exigen ahora que los proveedores de internet les faciliten el acceso a los usuarios finales para ayudarles a hacer cumplir sus derechos. Este artículo aborda la jurisprudencia relativa a la aplicación de los derechos de autor por parte de los proveedores de internet de toda Europa.     Molluscan radiations and landscape evolution in Miocene Amazonia

    This PhD study aims to exploit the rich archive provided by the Miocene mollusc fauna of the Pebas Formation and other inland Miocene Amazonian formations to reconstruct landscape evolution and biotic development in lowland Amazonia during the Neogene. Over 160 samples from more than 70 Pebas Formation outcrops mostly collected by the author were processed for this study. Additional samples were collected in Andean areas of Colombia and Venezuela and further material from other northwestern South American basins was studied in museums. Pebas Formation samples and well log data made available by Occidental Peru from three wells in the Marañon Basin in Peru were also investigated. During this study four genera and 74 species from the Pebas Formation have been described and a further 13 species have been introduced in open nomenclature, and several species were reported for the first time. The number of mollusc species attributed to the Pebas fauna has increased from around 50 to 156. The Pebas fauna is characterised as aquatic, endemic and extinct, and is a typical representative of a long-lived lake fauna. Fluvial taxa are not common, (marginal) marine taxa are rare. An additional molluscan fauna from the Miocene Solimões Formation of Brazil, containing 13 fresh water species was also described. The newly documented fauna was used to improve biostratigraphic framework of Miocene Amazonian deposits. Twelve mollusc zones were introduced, the upper eleven of which cover a time interval of approximately seven million years covered previously by only three pollen zones. An age model calculated for the borehole data indicates that the Pebas Formation was deposited between c. 24 and 11 Ma. The areal distribution of the outcropping mollusc zones uncovered a broad dome structure, termed here the Iquitos-Araracuara anteclise in the study area. The structure appears to have influenced river courses and also contributed to edaphic heterogeneity that may have been in part responsible for the current high biodiversity in the study area. The Pebas system was a huge system (> one million km2) dominated by relatively shallow lakes, but also containing swamps and rivers. The system was fed by rivers draining the emergent Andes in the west and lowlands and cratons to the east. The Pebas system was located at sea level and was open to marine settings through a northern portal running through the Llanos Basin and East Venezuela Basin towards the Caribbean. Cyclical baselevel changes possibly related to Mylankhovitch cycles, have been documented in depositional sequences of the Pebas Formation. The composition of the Pebasian mollusc fauna implies that the system was mostly a fresh water system. Such an interpretation is matched by strontium isotope ratios as well as very negative δ18O ratios found in the shells, but is at odds with oligohaline and mesohaline ichnofacies found in the same strata. The mollusc fauna of the Pebas Formation diversified through most of the existence of the lake system. The diversification was mostly the result of in-situ cladogenesis. The success of some of the Pebasian endemic clades is explained by adaptation to fresh water, low oxygen, common unconsolidated lake bottoms (soup grounds) as well as high predation intensity. Maximum diversity was reached at the base of the late Middle to early Late Miocene Grimsdalea pollen zone, some 13 Ma. At the time some 85 species co-occurred, 67 of which are considered as Pebasian endemics. A subsequent drop in species richness coincides with indications of elevated salinities, although a causal relation still needs to be established. Apparently the Pebas fauna went (almost) entirely extinct with the replacement of the lake system into a fluvio-tidal system during the Early Late Miocene, some 11 Ma.Siirretty Doriast

    On the identity of broad-shelled mussels (Mollusca, Bivalvia, Mytilus) from the Dutch delta region

    Late Quaternary (Eemian) deposits of the Netherlands contain shells that resemble those of living Mytilus galloprovincialis. Similar broad-shelled mytilids also occur in estuaries of the southwestern Netherlands together with slender individuals typical of M. edulis. We sampled living mussels along a depth gradient in the Oosterschelde to a) investigate whether a relation exists between shell shape and depth, b) test if the broad-shelled specimens might represent M. galloprovincialis (or a hybrid with M. edulis) and c) assess by inference if the Quaternary specimens might be attributed to M. galloprovincialis as well. In order to do so, we compared genetic (length polymorphism of Me 15/16, COIII sequences and AFLPs) and shell-morphological characteristics (juvenile L/W ratios and so-called Verduin parameters) of the same specimens. The obtained dataset indicates that all studied mussels from the Oosterschelde should be attributed to M. edulis, including those with broad shell outlines. No correlation of shell-morphology and depth-distribution was found. The worn and generally damaged state of the Eemian specimens precluded measurement of the Verduin parameters, while juvenile L/W ratios turned out not to be diagnostic. Therefore the shell characters examined in this study are insufficient to demonstrate the possible presence of M. galloprovincialis shells in Quaternary deposits of the Netherlands

    Renewed diversification following Miocene landscape turnover in a Neotropical butterfly radiation

    International audienceAim: The landscape of the Neotropical region has undergone dynamic evolution throughout the Miocene, with the extensive Pebas wetland occupying western Amazonia between 23 and c. 10 Ma and the continuous uplift of the Andes mountains. The complex interaction between the Andes and Amazonia probably influenced the trajectory of Neotropical biodiversity, but evidence from time‐calibrated phylogenies of groups that diversified during this period is lacking. We investigate the role of these landscape transformations in the dynamics of diversification in the Neotropical region using a 26‐Myr‐old endemic butterfly radiation.Location: Neotropics.Time period: Oligocene to present.Major taxa studied: Ithomiini butterflies.Methods: We generated one of the most comprehensive time‐calibrated molecular phylogenies of a large clade of Neotropical insects, the butterfly tribe Ithomiini, comprising 340 species (87% of extant species) and spanning 26 Myr of diversification. We applied a large array of birth–death models and historical biogeography estimations to assess the dynamics of diversification and biotic interchanges, especially at the Amazonia–Andes interface.Results: Our results suggest that the Amazonian Pebas wetland system played a major role in the timing and geography of diversification of Ithomiini, by constraining dispersal and diversification in the Amazon basin until c. 10 Ma. During the Pebas wetland period, Ithomiini diversification mostly took place in the Andes, where terrestrial habitats were not affected. An explosion of interchanges with Amazonia and with the Northern Andes accompanied the demise of the Pebas system (11–8 Ma) and was followed by local diversification in those areas, which led to a substantial renewal of diversification.Main conclusions: Many studies on Neotropical diversity have focused only on the Andes, whereas we show that it is the waxing and waning of the Pebas mega‐wetland, interacting with Andean uplift, that determined the timing and patterns of regional interchanges and diversification in Ithomiini

    Evolution of size-dependent flowering in a variable environment: construction and analysis of a stochastic integral projection model

    Understanding why individuals delay reproduction is a classic problem in evolutionary biology. In plants, the study of reproductive delays is complicated because growth and survival can be size and age dependent, individuals of the same size can grow by different amounts and there is temporal variation in the environment. We extend the recently developed integral projection approach to include size- and age-dependent demography and temporal variation. The technique is then applied to a long-term individually structured dataset for Carlina vulgaris, a monocarpic thistle. The parameterized model has excellent descriptive properties in terms of both the population size and the distributions of sizes within each age class. In Carlina, the probability of flowering depends on both plant size and age. We use the parameterized model to predict this relationship, using the evolutionarily stable strategy approach. Considering each year separately, we show that both the direction and the magnitude of selection on the flowering strategy vary from year to year. Provided the flowering strategy is constrained, so it cannot be a step function, the model accurately predicts the average size at flowering. Elasticity analysis is used to partition the size- and age-specific contributions to the stochastic growth rate, λs. We use λs to construct fitness landscapes and show how different forms of stochasticity influence its topography. We prove the existence of a unique stochastic growth rate, λs, which is independent of the initial population vector, and show that Tuljapurkar's perturbation analysis for log(λs) can be used to calculate elasticities

    RELATIONSHIP BETWEEN ANKLE MOBILITY AND GOLF SWING KINEMATICS

    The purpose of this study was to examine the relationship between ankle mobility and golf swing kinematics. Sixteen male golfers volunteered to take part. Ankle mobility was assessed using the weight bearing lunge test and three-dimensional kinematic data from 10 golf drives were collected using a Vicon motion capture system. Pearson’s correlation coefficients were calculated to identify the relationship between ankle mobility and the rotations of four segments; pelvis, shoulders, upper arm and forearm. Large positive relationships were identified for the rotations of the pelvis (r = 0.670) and shoulders (r = 0.604) in the downswing as well as for peak rotational velocities of the pelvis (r = 0.553), shoulder (r = 0.571) and upper arm (r = 0.549) segments. These results indicate that improvements in ankle joint mobility are associated with superior rotations of segments further up the kinetic chain and that the weight bearing lunge test should be used as part of golf specific movement screening

    Age and size at maturity: sex, environmental variability and developmental thresholds

    In most organisms, transitions between different life-history stages occur later and at smaller sizes as growth conditions deteriorate. Day and Rowe recently proposed that this pattern could be explained by the existence of developmental thresholds (minimum sizes or levels of condition below which transitions are unable to proceed). The developmental-threshold model predicts that the reaction norm of age and size at maturity will rotate in an anticlockwise manner from positive to a shallow negative slope if: (i) initial body size or condition is reduced; and/or (ii) some individuals encounter poor growth conditions at increasingly early developmental stages. We tested these predictions by rearing replicated populations of soil mites Sancassania berlesei (Michael) under different growth conditions. High-food environments produced a vertical relationship between age and size at maturity. The slope became increasingly shallow as food was reduced. By contrast, high food in the maternal environment reduced the slope of the reaction norm of age and size at maturity, whereas low food increased it. Overall, the reaction norm of age and size at maturity in S. berlesei was significantly nonlinear and differed for males and females.
