Enhanced cooperation in the EU

Η ενισχυμένη συνεργασία αποτελεί μία νομοθετική διαδικασία προβλεπόμενη στο πρωτογενές δίκαιο της ΕΕ (άρθρο 20 ΣΕΕ και άρθρα 326-334 ΣΛΕΕ), η οποία επιτρέπει σε τουλάχιστον εννέα κράτη μέλη να νομοθετήσουν σε ένα τομέα μη αποκλειστικής αρμοδιότητας της Ευρωπαϊκή Ένωσης, εφόσον έχει κριθεί ότι το συγκεκριμένο νομοθετικό κείμενο δεν μπορεί να υιοθετηθεί από την Ευρωπαϊκή Ένωση ως σύνολο και εφοσόν οι περαιτέρω νομικές προϋποθέσεις πληρούνται. Ταυτόχρονα, η ενισχυμένη συνεργασία αποτελεί μία μορφή διαφοροποιημένης ενοποίησης, δεδομένου ότι επιτρέπει την προώθηση της ενοποιητικής διαδικασίας μεταξύ κάποιων κρατών μέλων της Ευρωπαϊκής Ένωσης, αλλά όχι όλων. Συνεπώς, αποτελεί την εξαίρεση στην γενική αρχή της ενότητας που διέπει εξ αρχής την ευρωπαϊκή έννομη τάξη και τη διαδικασία της ευρωπαϊκής ενοποίησης. Συνεπώς, αφορά στη συζήτηση που διεξάγεται ως προς τον κίνδυνο που ενέχουν τα σχήματα διαφοροποιημένης ενοποίησης για την ενότητα της ευρωπαϊκής έννομης τάξης. Η παρούσα διπλωματική εργασία εξετάζει την ενισχυμένη συνεργασία, αφενός, ως μία μορφή διαφοροποιημένης ενοποίησης και, αφετέρου, ως ένα αποτελεσματικό εργαλείο για την προώθηση της ευρωπαϊκής ενοποίησης. Σκοπός της εργασίας είναι να καταδείξει ότι, αν και μία μορφή διαφοποιημένης ενοποίησης, η ενισχυμένη συνεργασία αποτελεί ένα χρήσιμο εργαλείο για την προώθηση της ενοποιητικής διαδικασίας λόγω των νομικών δικλείδων και εγγυήσεων που προβλέπονται στις διατάξεις των Συνθηκών και διαμορφώνουν το νομοθετικό της πλαίσιο, οι οποίες στοχεύουν στη διαφύλαξη της πεμπτουσίας της έννομης τάξης της Ευρωπαϊκής Ένωσης.Enhanced Cooperation is a legislative procedure enshrined in primary EU law (article 20 TEU and articles 326-334 TFEU), which enables the adoption of a legislative act in an area of non-exclusive competence of the European Union between at least nine Member States when it has been established that it cannot be adopted by the Union as a whole and provided that the further legal requirements are fulfilled. In that it allows the advancement of integration between some but not all Member States, enhanced cooperation constitutes a form of differentiated integration and consequently, an exception to the rule of unity that has guided the process of European integration from the outset. Therefore, it is relevant to the debate on the risk that such forms of flexibility and differentiation entail for disrupting the unity of the EU legal order. The present study examines enhanced cooperation as a form of differentiated integration and as an effective tool for the promotion of European integration. The purpose of the study is to demonstrate that being a form of differentiated integration, enhanced cooperation constitutes an effective tool for the purposes of advancing the integration process by reason of the legal safeguards and guarantees enshrined in the provisions of the Treaties, which frame it so as to not adversely affect the integrity of the legal order of the European Union

Confusion after spine injury: cerebral fat embolism after traumatic rupture of a Tarlov cyst: Case report

<p>Abstract</p> <p>Background</p> <p>Acute low back pain is a very common symptom and reason for many medical consultations. In some unusual circumstances it could be linked to a rare aetiology.</p> <p>Case presentation</p> <p>We report a 70-year-old man with an 8-month history of left posterior thigh and leg pain who had sudden confusion after a fall from standing. It was due to cerebral fat embolism suspected by computed tomography scan, later confirmed by brain magnetic resonance imaging (MRI). A spinal MRI scan was then performed and revealed a sacral fracture which drained into an unknown perineurial cyst (Tarlov cyst). Under medical observation the patient fully recovered within three weeks.</p> <p>Conclusions</p> <p>Sacral perineurial cysts are rare, however they remain a potential cause of lumbosacral radiculopathy.</p
