    Van Nederlands naar 'Europees' onrechtmatige daadsrecht

    In deze bijdrage gaat het om de vraag hoeveel invloed het Europese, in de zin van: van de Europese Unie (EU) afkomstige, recht op het Nederlandse buitencontractuele aansprakelijkheidsrecht heeft. Die invloed is niet zo heel groot, zoals wij aan de hand van een korte schets van de huidige stand van zaken zullen laten zien (§2). Dat betekent tevens dat onze (Nederlandse) omgang met het (nog steeds Nederlandse) aansprakelijkheidsrecht niet fundamenteel gewijzigd is door de toenemende stroom van regelgeving vanuit Europa. Er gebeurt wel van alles op het terrein van het aansprakelijkheidsrecht, maar die gebeurtenissen spelen eerder op wat wij maar ‘particulier terrein’ noemen. Er zijn sinds de jaren ’90 namelijk een aantal groepen van wetenschappers die zich voorgenomen hebben het voortouw te nemen bij de harmonisatie van het buitencontractuele aansprakelijkheidsrecht. Juist omdat de EU tot op heden veel ruimte overlaat voor particulier initiatief, zullen wij die particuliere ontwikkelingen, met name de ontwerpen voor zogenaamde ‘Principles’, beschrijven (§3). Vervolgens wordt de vraag besproken of het eigenlijk zinvol is om te streven naar een geharmoniseerd aansprakelijkheidsrecht binnen de EU en of we beter af zijn met dit soort ‘Principles’ (§4). Ons antwoord luidt dat zulks slechts in beperkte mate het geval is. We concluderen in die paragraaf verder nog dat de rol van de EU waarschijnlijk gering zal blijven omdat de eenmaking op het gebied van het onrechtmatige daadsrecht tegen een aantal concrete hindernissen oploopt en de politieke noodzaak tot harmonisatie van algemene basisregels ontbreekt

    Validation of IMERG Precipitation in Africa

    Our understanding of hydroclimatic processes in Africa has been hindered by the lack of in situ precipitation measurements. Satellite-based observations, in particular, the TRMM Multisatellite Precipitation Analysis (TMPA) have been pivotal to filling this void. The recently released Integrated Multisatellite Retrievals for GPM (IMERG) project aims to continue the legacy of its predecessor, TMPA, and provide higher-resolution data. Here, IMERG-V04A precipitation data are validated using in situ observations from the Trans-African Hydro-Meteorological Observatory (TAHMO) project. Various evaluation measures are examined over a select number of stations in West and East Africa. In addition, continent-wide comparisons are made between IMERG and TMPA. The results show that the performance of the satellite-based products varies by season, region, and the evaluation statistics. The precipitation diurnal cycle is relatively better captured by IMERG than TMPA. Both products exhibit a better agreement with gauge data in East Africa and humid West Africa than in the southern Sahel. However, a clear advantage for IMERG is not apparent in detecting the annual cycle. Although all gridded products used here reasonably capture the annual cycle, some differences are evident during the short rains in East Africa. Direct comparison between IMERG and TMPA over the entire continent reveals that the similarity between the two products is also regionally heterogeneous. Except for Zimbabwe and Madagascar, where both satellite-based observations present a good agreement, the two products generally have their largest differences over mountainous regions. IMERG seems to have achieved a reduction in the positive bias evident in TMPA over Lake Victoria

    Ultrahigh temperature and strain hybrid integrated sensor system based on Raman and femtosecond FBG inscription in a multimode gold-coated fiber

    In this paper, a novel approach for hybrid systems combining Raman distributed sensors with fiber Bragg grating (FBG) sensors to carry out distributed and quasi-distributed temperature/strain measurements was proposed and experimentally demonstrated. Three FBGs were inscribed by the point-by-point technique in a simple setup for type I femtosecond inscription in a pure silica core multimode gold-coated fiber. Employing a single fiber, temperatures up to 600 °C and strains up to 4144 µE approximately were measured simultaneously and without interferences between both distributed and point measurements. Moreover, a new calibration technique was implemented to calibrate the distributed temperature system using the FBG measurements as reference.Spanish Government FEDER Funds (TEC2016-76021-C2-2-R)

    Recognising Victimhood: Lessons from the International Criminal Court and Mass Claim Programmes for the Compensation Procedure Parallel to the Trial of International Crimes in the Netherlands

    In the Netherlands, the Dutch criminal court in The Hague (hereinafter: ‘Netherlands International Crimes Court’ or ‘NIC court’) is assigned to try international crimes, and to provide compensation to victims of such crimes. Whereas it has specific criminal laws at its disposal to try international crimes, it applies ‘regular’ Dutch civil law to assess claims for compensation. Yet compensation for international crimes entails challenges that are quite different from domestic crimes: international crimes are normally committed against a large number of victims, and frequently result in bodily harm. This article argues that the NIC court will most likely rule a large number of claims for compensation inadmissible, as a consequence of which victims cannot benefit from the advantages inherent in the award of compensation within the criminal process. It then explores the adjudicative and reparatory standards that the International Criminal Court and mass claim programmes have applied to simplify both the adjudication of a large number of claims, and the calculation of a large number of instances of bodily damage. It is submitted that adoption by the NIC court of international reparatory standards could facilitate the assessment of a large number of civil claims within the criminal process, without prejudice to the legitimate interests of the defendant for an adequate procedure. However, these standards require the NIC court to strike a new balance between tailor-made compensation and symbolic compensation, and thereby between corrective justice and restorative justice

    Nitrogen hydrides in interstellar gas: Herschel/HIFI observations towards G10.6-0.4 (W31C)

    The HIFI instrument on board the Herschel Space Observatory has been used to observe interstellar nitrogen hydrides along the sight-line towards G10.6-0.4 in order to improve our understanding of the interstellar chemistry of nitrogen. We report observations of absorption in NH N=1-0, J=2-1 and ortho-NH2 1_1,1-0_0,0. We also observed ortho-NH3 1_0-0_0, and 2_0-1_0, para-NH3 2_1-1_1, and searched unsuccessfully for NH+. All detections show emission and absorption associated directly with the hot-core source itself as well as absorption by foreground material over a wide range of velocities. All spectra show similar, non-saturated, absorption features, which we attribute to diffuse molecular gas. Total column densities over the velocity range 11-54 km/s are estimated. The similar profiles suggest fairly uniform abundances relative to hydrogen, approximately 6*10^-9, 3*10^-9, and 3*10^-9 for NH, NH2, and NH3, respectively. These abundances are discussed with reference to models of gas-phase and surface chemistry.Comment: 5 pages, 3 figures, 2 online pages with 2 figures.     Management of children's urinary tract infections in Dutch family practice: a cohort study

    BACKGROUND: Optimal clinical management of childhood urinary tract infections (UTI) potentiates long-term positive health effects. Insight into the quality of care in Dutch family practices for UTIs was limited, particularly regarding observation periods of more than a year. Our aim was to describe the clinical management of young children's UTIs in Dutch primary care and to compare this to the national guideline recommendations. METHODS: In this cohort study, all 0 to 6-year-old children with a diagnosed UTI in 2001 were identified within the Netherlands Information Network of General Practitioners (LINH), which comprises 120 practices. From the Dutch guideline on urinary tract infections, seven indicators were derived, on prescription, follow-up, and referral. RESULTS: Of the 284 children with UTI who could be followed for three years, 183 (64%) were registered to have had one cystitis episode, 52 (18%) had two episodes, and 43 (15%) had three or more episodes. Another six children were registered to have had one or two episodes of acute pyelonephritis. Overall, antibiotics were prescribed for 66% of the children having had ≤ 3 cystitis episodes, two-thirds of whom received the antibiotics of first choice. About 30% of all episodes were followed up in general practice. Thirty-eight children were referred (14%), mostly to a paediatrician (76%). Less than one-third of the children who should have been referred was actually referred. CONCLUSION: Treatment of childhood UTIs in Dutch family practice should be improved with respect to prescription, follow-up, and referral. Quality improvement should address the low incidence of urinary tract infections in children in family practice

    <sup>89</sup>Zr-pembrolizumab imaging as a non-invasive approach to assess clinical response to PD-1 blockade in cancer

    Background: Programmed cell death protein 1 (PD-1) antibody treatment is standard of care for melanoma and non-small-cell lung cancer (NSCLC). Accurately predicting which patients will benefit is currently not possible. Tumor uptake and biodistribution of the PD-1 antibody might play a role. Therefore, we carried out a positron emission tomography (PET) imaging study with zirconium-89 ( 89Zr)-labeled pembrolizumab before PD-1 antibody treatment. Patients and methods: Patients with advanced or metastatic melanoma or NSCLC received 37 MBq (1 mCi) 89Zr-pembrolizumab (∼2.5 mg antibody) intravenously plus 2.5 or 7.5 mg unlabeled pembrolizumab. After that, up to three PET scans were carried out on days 2, 4, and 7. Next, PD-1 antibody treatment was initiated. 89Zr-pembrolizumab tumor uptake was calculated as maximum standardized uptake value (SUV max) and expressed as geometric mean. Normal organ uptake was calculated as SUV mean and expressed as a mean. Tumor response was assessed according to (i)RECIST v1.1. Results: Eighteen patients, 11 with melanoma and 7 with NSCLC, were included. The optimal dose was 5 mg pembrolizumab, and the optimal time point for PET scanning was day 7. The tumor SUV max did not differ between melanoma and NSCLC (4.9 and 6.5, P = 0.49). Tumor 89Zr-pembrolizumab uptake correlated with tumor response (P trend = 0.014) and progression-free (P = 0.0025) and overall survival (P = 0.026). 89Zr-pembrolizumab uptake at 5 mg was highest in the spleen with a mean SUV mean of 5.8 (standard deviation ±1.8). There was also 89Zr-pembrolizumab uptake in Waldeyer's ring, in normal lymph nodes, and at sites of inflammation. Conclusion: 89Zr-pembrolizumab uptake in tumor lesions correlated with treatment response and patient survival. 89Zr-pembrolizumab also showed uptake in lymphoid tissues and at sites of inflammation
