the activation of the jurisdiction of the International Criminal Court over the crime of aggression

A 14 de dezembro de 2017, a Assembleia de Estados Parte (AEP) do Tribunal Penal Internacional (TPI), reunida em Nova Iorque, adotou a decisão histórica para ativar a jurisdição do tribunal sobre o crime de agressão. Inicialmente, através da descrição da realização do estágio de 4 meses na Missão Permanente de Portugal junto das Nações Unidas, este relatório tenciona apresentar qual o contexto que se revelou propício a esta decisão de ativação e explicar a razão pela qual o crime de agressão foi escolhido como tema principal. De facto, a discussão sobre o crime de agressão começa em Nuremberga e tem sido lentamente integrada na ordem internacional durante os últimos 60 anos. Através da análise do contexto histórico que levou até ao Estatuto de Roma e depois até às emendas de Kampala, o objetivo é perceber o que estava em causa quando a decisão foi tomada e quais as diferentes ramificações do sistema legal. Finalmente, este relatório focar-se-á no âmbito de proteção concedido pelo regime do crime de agressão, que exclui Estados Não-Parte e Estados NãoRatificantes da jurisdição do TPI. Tal conclusão representa uma reversão total do paradigma de justiça penal internacional do TPI e prejudica a luta contra a impunidade e a proteção de direitos humanos, mesmo que não possamos ignorar a importância da decisão tomada por consenso pela Assembleia de Estados-Parte para o mundo de hoje.On 14 December 2017, the Assembly of States Parties (ASP) of the International Criminal Court (ICC) gathered in New York and took an historic decision to activate the jurisdiction of the Court over the crime of aggression. By firstly describing the 4-month internship at the Permanent Mission of Portugal to the United Nations, this paper intends to set the context in which the activation was carried out and explain the choosing of the crime of aggression as the specific subject-matter. Indeed, this has been a discussion taking place since Nuremberg and that has, in the past 60 years, slowly been integrated in the international legal order. By analysing the historic background that led to the Rome Statute and then to the Kampala amendments, the aim is to understand what was at stake when the decision was made on 14 December 2017 and the different ramifications of the legal system. Finally, this paper will focus on the scope of protection granted by the regime of the crime of aggression, that excludes non-States Parties and nonratifying States Parties from the jurisdiction of the ICC. Such conclusion represents a true reversal of the international criminal justice paradigm that is represented by the ICC and will undermine the fight against impunity and the protection of human rights, even though the importance of the decision achieved at the ASP, by consensus, to the world today cannot be understated

The lyrics of the songs "Coco livre" e "Taquarulua": poetry, culture and imaginary

This article analyzes the lyrics of the songs “Coco Livre”, on the CD Brasís: as canções e o povo (1998), by Genésio Tocantins, and “Taquarulua”, on the CD Taquarulua (2009), by Dorivã, exploring the words that relate to local culture, poetry and the imaginary of Tocantins. Genésio Tocantins began his musical career in the 1970s and Dorivã a decade later, around the 1980s. The two artists have been active in the art and culture of the state of Tocantins for over 40 years, participating in and winning several song festivals in the state and around Brazil, as well as being invited to international events to represent Tocantins and the Brazilian music. The guiding question asks whether the lyrics of the analyzed songs address regional themes and can be considered representatives of regional music. Furthermore, it is our intention to discuss how these themes can be acknowledged as identity and cultural representations present in the imaginary of the state of Tocantins. Thus, the main objective is to present the two Tocantins musicians and their musical productions, specifically the lyrics of the songs mentioned above, observing if their music can be considered regionalist and if it can be part of the representations of the identity and culture of this Brazilian state. The theorists that support this reflection are: Cândido (1995), Compagnon (2001), Hall (2015), and Moraes (2000)

Wavelets decomposition, volatility analysis and correlation for financial indexes

Since the benefits of portfolio international diversification results appeared in financial literature, the issue of financial co-movements among different markets has been a key question. Many recent studies have approached this topic targeting a correlation investigation among financial indicators. Unfortunately, the huge majority of them focus only in the time domain, ignoring the relevant frequency domain which could differentiate long and short-run investment contribution to the energy of a time series. This paper proposes a wavelet-based volatility and correlation analysis of key financial indexes for the Brazilian, American and European markets looking for some results concerning the correlation structure between them in time and frequency domain, obtaining distinct results for long and short-run investment performance and contribution.Acontecimentos recentes no ambiente financeiro internacional suscitaram algumas questões relacionadas à inter-relação e interdependência dos diversos mercados ao longo do globo e seus graus de integração. Nesse sentido, este artigo propõe uma análise de variância e correlação para índices financeiros como o Dow Jones Industrial, o Ibovespa e o Euro Stoxx 50 através da decomposição destas séries em ondaletas. Uma vez que a metodologia de ondaletas é capaz de separar as diferentes frequências de uma série temporal ao longo do tempo (frequência-temporal), o estudo de uma estrutura de correlações e variâncias através desta metodologia é capaz de evidenciar fenômenos particulares de cada frequência de dados que, de forma agregada, são perdidos

Os Modos Regulatórios e suas Relações entre os Estudantes de Ciências Contábeis

Objective: Based on the Regulatory Mode theory by Kruglanski, Thompson, Higgins, Atash, Pierro, Shah and Spiegel (2000), individuals present two self-regulatory functions. The locomotion function corresponds to a strong focus towards action. The assessment function corresponds to the capacity to critically assess the means and ends. In this study, we aimed to associate the students’ regulatory modes with vocational education aspects in the undergraduate program in Accountancy, such as satisfaction with the course, academic performance and professional career aspects. Method: A survey was undertaken among 94 students from an undergraduate program in Accountancy. After the validity and reliability tests of the scales, Pearson’s Correlation test was used to analyze the results. Results: The students’ regulatory mode of locomotion was positively associated with satisfaction and performance in the course. The locomotion profile was also positively associated with the intention to work in the accounting area, especially in opportunities that value the conquest of professional experiences,personal satisfaction and promotion through career plans. Contributions: The results suggest that students with a locomotion (vs. assessment) profile experience a regulatory adjustment and are more fit to the Accountancy course.Objetivo: Baseado na teoria dos Modos Regulatórios, de Kruglanski, Thompson, Higgins, Atash, Pierro, Shah e Spiegel (2000) os indivíduos apresentam duas funções de autorregulação. A função de locomoção corresponde à forte orientação para a ação. A função de avaliação corresponde à capacidade de avaliação crítica dos meios e dos fins. Neste estudo, buscou-se associar os modos regulatórios dos alunos com aspectos da formação profissional no curso de graduação em Ciências Contábeis, como a satisfação com o curso, o desempenho acadêmico e aspectos da carreira profissional. Método: Um levantamento foi realizado com 94 alunos de um curso de graduação em Ciências Contábeis. Após realizados os testes de validade e confiabilidade das escalas, adotou-se o teste de Correlação, de Pearson, para análise dos resultados. Resultados: O modo regulatório de locomoção dos alunos se associou positivamente com a satisfação e o desempenho no curso. O perfil de locomoção também apresentou associação positiva com a intenção de atuar, profissionalmente, na área contábil, especialmente em oportunidades que valorizam a conquista de experiências profissionais, a satisfação pessoal e a promoção por meio de planos de carreira. Contribuições: Os resultados sugerem que alunos com perfil de locomoção (vs. avaliação) experenciam um ajuste regulatório e são mais adequados ao curso de Ciências Contábeis

Systematic review of the effects of coffee or its components on platelets and their regulators

Coffee includes some potentially bioactive components that can interfere with platelets, which can influence coagulation, despite generating controversy. The aim of this systematic review is to verify whether coffee or its components can influence platelet regulators and/or aggregation. Materials and Methods: The research was conducted on July 29, 2021, in PubMed, Scopus, andWeb of Science, using the followingmesh-terms: (caffeine)) OR (coffee)) AND (platelets). Eligibility criteria were: studies carried out in humans, referring to the effects of coffee consumption, or one of its components, on platelets or their regulators. We exclude in vitro or animal studies, reviews, editorials, and non-English written studies. From a total of 836 publications, 17 articles were included from which we extracted the relationship between coffee consumption and changes in blood platelets and performed a subjective assessment of bias. Results: Ten articles refer to the non-interference of coffee or its components with platelets, nine affirm results that support the increase in platelet aggregation, and eight articles observe the decrease in platelet aggregation when coffee is consumed. Some articles presented the lack of data regarding the sample collection location, age group, or classification as to the type of study, which is limiting. Conclusions: The heterogeneity of results makes it difficult to correctly interpret the possible interaction of coffee or its components with platelets or their regulators. O AMPARO JURÍDICO A GESTANTE QUANTO AO DIREITO DO ANONIMATO

O presente trata sobre o parto anônimo que foi tratado no projeto lei n° 3220/08, que defendia o direito mulher de anonimamente dar seu filho a adoção no momento do parto, preservando a sua identidade. Este busca evitar situações como a do abandono do nascituro, fato criminoso erepudiado e do aborto clandestino. Mesmo sendo um desmembramento do que o Estatuto da Criança e do Adolescente já trata. Machines of complexity: dialogues with Edgar Morin

A presença da máquina como modelo de conhecimento tem assumido progressiva importância nas sociedades contemporâneas, sobretudo em razão do uso ampliado das máquinas cognitivas, as quais reconfiguram a organização das atividades produtivas, educativas, sociais e culturais. As consequências da utilização da máquina para o pensamento e fazer humanos, bem como a participação desse artefato como referência de funcionamento aos seres vivos e às sociedades são exploradas na obra O método, do filósofo e sociólogo francês Edgar Morin. Buscando compreender o significado da máquina ou, mais precisamente, do ser-máquina no pensamento complexo e confrontar as hipóteses de trabalho do doutorado intitulado A vida das máquinas: imaginário dos autômatos em O método de Edgar Morin, realizou-se uma entrevista com o autor no CNRS-Sorbonne, em Paris, atividade integrante do período de pesquisa desenvolvido na Universidade Grenoble Alpes e concluído na Faculdade de Educação da Universidade de São Paulo. Na entrevista, depois de esclarecer quais são as bases da noção de ser-máquina e suas peculiaridades em relação às abordagens cartesianas e lametrianas, o autor discorre sobre a importância do imaginário na produção do conhecimento e comenta as imagens pouco usuais que atribui às máquinas, como Pétrouchka. Por fim, Morin acentua a ideia de que os seres vivos são máquinas não triviais e não podem ser reduzidos aos determinismos que caracterizam as máquinas artificiais (artefatos), pois significativa parte de sua produção se dá a partir de processos criativos e auto-organizados.The presence of the machine as a model of knowledge has gained increasing importance in contemporary societies, especially because of the amplified use of cognitive machines that have reconfigured the organization of productive, educational, social, and cultural activities. Edgar Morin dissects in his work, La méthode, the consequences of using machines for human thought and action, as well as the consequences of this artifice being our reference for optimal human and societal functioning. An interview with this author was performed at CNRS-Sorbonne Paris as part of my PhD research, initially carried out at the University of Grenoble Alpes and concluded at the School of Education at the University of São Paulo. The goal of this interview was to better comprehend, in complexity theory, the meaning of the machine and, more precisely, of the machine-being, as well as to confront the hypothesis of my PhD thesis, named Machine Life: the imagery of machines in Edgar Morin’s La méthode. After clarifying the pillars of the concept machine-being and its peculiarities in regard to the works of Descartes and La Mettrie, the author discoursed about the importance of imagery in the production of knowledge and mentioned the unusual images that he attributes to machines, such as Pétrouchka. Finally, Morin emphasizes the notion that human beings are non-trivial machines and must not be reduced to the determinisms that portray artificial machines (artifices), since most of human production occurs through creative and self-organized processes

HETEROSSEXISMO: aspectos internacionais desta prática contrária aos direitos humanos

O presente trabalho desenvolveu um estudo sobre o heterossexismo, e de que forma os mecanismos internacionais de proteção aos direitos humanos podem servir como medida de combate a esta prática. Neste sentido, observou-se que ainda que haja uma atuação de órgãos da Organização das Nações Unidas - ONU no combate ao heterossexismo, não há nenhum tratado ou convenção internacional específica de combate à discriminação em razão da orientação sexual, o que ocasiona um déficit na proteção internacional. Palavras-chave:  Heterossexismo;  Proteção Internacional;  Orientação Sexual.Abstract:  This paper sought to develop a study about heterosexism, and how the international mechanisms for protecting human rights can serve as a measure against that practice. DIVERSIDADES, DIFERENÇAS E DIFERENÇA NO TERRITÓRIO ESCOLAR: CARTOGRAFIAS INICIAIS

This theoretical essay, the result of a research carried out in a public university in Bahia, tracks the concepts of diversity, differences and difference, through bibliographical research with an emphasis on systematic review, in a time frame from 2010-2020. The main objective was to identify theoretical matrices that support the key concepts mentioned. This was a qualitatively-based study, inspired by cartography, as recommended by Deleuze and Guattari (2011). The research procedure adopted was a systematic review, based on the descriptors “Diversity, differences and school”. As a methodological procedure, it was used the assumptions of cartography mapping the works by titles, abstracts, keywords and citation behavior to identify directions in the theoretical matrix and results obtained. The results showed that among the 24 researches in the corpus of analysis, at least 11 do not mention or indicate clues of the conceptions they take to support the research. In addition, it presents clues that, in general, the concept of diversity has been more strained towards the frontier of homogenization, with the fixation of subjects in existing categories, demarcating inequalities. There is, in general, an affirmation of cordial and celebratory diversity, and difference taken as a synonym for differences in the general scope of the research analyzed.Este ensaio teórico é resultado de pesquisa realizada em uma universidade pública baiana rastreia os conceitos de diversidade, diferenças e diferença, através da pesquisa bibliográfica com ênfase na revisão sistemática, num recorte temporal de 2010-2020. O objetivo central foi identificar matrizes teóricas que subsidiam os conceitos-chave mencionados. Tratou-se de um estudo de base qualitativa, inspirado na cartografia, conforme preconiza Deleuze e Guattari (2011). O procedimento de pesquisa adotado foi a revisão sistemática, a partir dos descritores “Diversidades, diferenças e escola”. Como procedimento metodológico utilizou-se dos pressupostos da cartografia realizando o mapeamento dos trabalhos pelos títulos, resumos, palavras-chave e comportamento de citações para identificação de direcionamentos na matriz teórica e resultados obtidos. Os resultados apontaram que dentre as 24 pesquisas do corpus de análise, pelo menos 11 não mencionam ou indicam pistas das concepções que tomam para subsidiar a pesquisa. Além disso, apresenta as pistas de que em geral o conceito de diversidade tem sido mais tensionado para a fronteira da homogeneização, com a fixação de sujeitos em categorias já existentes, demarcando desigualdades. Há em geral uma afirmação da diversidade cordial e celebrativa, e diferença tomada como sinônimo de diferenças no escopo geral das pesquisas analisadas
