O CASO BATTISTI: CONDIÇÕES DA AÇÃO NA RECLAMAÇÃO ITALIANA
O presente artigo busca analisar as condições da ação na reclamação proposta pela República Italiana ao Supremo Tribunal Federal em reação à negativa do então Presidente da República de proceder à entrega do nacional italiano Cesare Battisti, cujo pedido de extradição foi julgado legal e procedente pela Suprema Corte. Na ocasião do julgamento da reclamação, o colegiado entendeu, por maioria, que a Itália não seria parte legítima para ajuizar reclamação para anular um ato do Presidente da República e que não poderia o Tribunal cassar um ato eminentemente político emanado do Chefe do Executivo. Neste artigo, valendo-nos do direito positivo aplicável e da doutrina em Direito Constitucional, Direito Administrativo, Direito Internacional Público e Teoria Geral do Processo, tentaremos demonstrar que, ao contrário do consignado pelo Supremo Tribunal Federal, estão sim presentes as condições da ação na reclamação proposta pela Itália, de forma que deveria ter sido esta ação conhecida e, no mérito, julgada procedente.
Desativismo judicial: a extradição Battisti no Supremo Tribunal Federal
Na ordem jurídica brasileira a extradição reponta em mais de um tópico da Constituição Federal, sendo regulada no plano ordinário pelo Estatuto do Estrangeiro e pelos tratados internacionais que comprometem o Brasil ___ entre estes o compromisso bilateral com a Itália, vigente desde 1993. A própria Carta dispõe sobre o instituto em quatro oportunidades: ao vedar, no rol de garantias, a extradição de brasileiro e do acusado de crime político ou de opinião; ao atribuir à União a competência privativa para legislar sobre a matéria; e ao reservar à competência originária do Supremo Tribunal Federal o processo e julgamento da extradição solicitada por Estado estrangeir
Structural analysis of massive galaxies using HST deep imaging at z < 0.5
Taking advantage of HST CANDELS data, we analyze the lowest redshift (z<0.5)
massive galaxies in order to disentangle their structural constituents and
study possible faint non-axis-symmetric features. Due to the excellent HST
spatial resolution for intermediate-z objects, they are hard to model by purely
automatic parametric fitting algorithms. We performed careful single and double
S\'ersic fits to their galaxy surface brightness profiles. We also compare the
model color profiles with the observed ones and also derive multi-component
global effective radii attempting to obtain a better interpretation of the
mass-size relation. Additionally, we test the robustness of our measured
structural parameters via simulations. We find that the S\'ersic index does not
offer a good proxy for the visual morphological type for our sample of massive
galaxies. Our derived multi-component effective radii give a better description
of the size of our sample galaxies than those inferred from single S\'ersic
models with GALFIT. Our galaxy population lays on the scatter of the local
mass-size relation, indicating that these massive galaxies do not experience a
significant growth in size since z~0.5. Interestingly the few outliers are
late-type galaxies, indicating that spheroids must reach the local mass-size
relation earlier. For most of our sample galaxies, both single and
multi-component S\'ersic models with GALFIT show substantial systematic
deviations from the observed SBPs in the outskirts. These residuals may be
partly due to several factors, namely a non-optimal data reduction for low
surface brightness features, the existence of prominent stellar haloes for
massive galaxies and could also arise from conceptual shortcomings of
parametric 2D image decomposition tools. They consequently propagate into
galaxy color profiles
LEVANTAMENTO FLORÍSTICO PRELIMINAR DA CAATINGA SUBLITORÂNEA NA PARAÍBA, NORDESTE DO BRASIL
Os estudos florísticos realizados no Agreste, área de transição entre os biomas Caatinga e Mata Atlântica, vêm sendo melhor discutidos recentemente. Entretanto são necessários novos estudos que envolvam uma maior amplitude das áreas limítrofes destes biomas, especialmente no que se refere às Florestas Estacionais Deciduais de Terras Baixas. Nesta concepção, o referente trabalho apresenta um levantamento florístico preliminar realizado no Agreste Sublitorâneo, bem como aponta as similaridades e diferenças entre esta formação e a Caatinga interiorana, a Mata Atlântica litorânea e o Agreste da Borborema. Foram registradas 231 espécies de Angiospermas, sendo Fabaceae, com 46 espécies, e Bignoniaceae, com 15 espécies, as famílias mais representativas na região. A estrutura florística do Agreste Sublitorâneo se assemelha as descritas em levantamentos realizados no Agreste da Borborema. Entretanto, diversas espécies amplamente distribuídas na Caatinga, que também ocorrem no Agreste da Borborema não ocorrem nas Florestas Estacionais Deciduais de Terras Baixas da Paraíba, sugerindo que a diferença de altitude entre a Depressão Sublitorânea e o Planalto da Borborema pode atuar como barreira de isolamento, impedindo que estas espécies se dispersem pela Caatinga Sublitorâne
Cirugía percutánea de la litiasis renal. Experiencia inicial
Percutaneous surgery of kidney stones was introduced in urology more than 20 years ago. Extracorporeal lithotripsy appeared shortly after. The objective of this article is to show the experience in this type of surgery after its introduction in the Urology Department. For this, the results of 50 patients undergoing percutaneous surgery for kidney stones were analyzed retrospectively. The two positions, known worldwide, were used. There was a minimum of complications, short surgical time and high effectiveness, reducing the post operative stay with a high problem-solving capacity and patient satisfaction.La intervención quirúrgica percutánea de la litiasis renal fue introducida en la Urología hace más de 20 años; poco después lo fue la litotricia extracorpórea. El objetivo de este trabajo es mostrar la experiencia en este tipo de intervención luego de su introducción en el Servicio de Urología, para lo que se analizaron, en forma retrospectiva, los resultados de 50 pacientes operados de litiasis renal por intervención quirúrgica percutánea. Se utilizaron las dos posiciones reconocidas mundialmente, con un mínimo de complicaciones bajo tiempo quirúrgico y una elevada efectividad, disminuyó la estadía post operatoria y hubo un alto poder de resolutividad y satisfacción de los pacientes
Estudos descritivos exploratórios qualitativos: um estudo bibliométrico
Objetivo: Avaliar estudos descritivos exploratórios dentro do contexto de estudo qualitativos. Métodos: Foi realizado um estudo bibliométrico em setembro de 2021 analisando artigos publicados nas principais plataformas de busca (PubMed, Scielo, BVS e Google scholar), englobando os anos de 2018 a 2021 utilizando os descritores “estudo”, “descritivo”, “exploratório” e “qualitativo”. Os dados foram extraídos para tabelas com informações pertinentes como local, área de saúde, número de participantes e construção de um produto. Após, foi construído uma nuvem de palavras no software Iramuteq a partir dos títulos dos artigos encontrados, realizando uma comparação com a literatura sobre os temas mais abordados. Resultados e discussão: foram encontrados 387 trabalhos, a maioria realizado em 2020, com o termo mais frequente nos títulos sendo “enfermagem”, o que pode ser justificado pela cultura destes profissionais de saúde em trabalhar com pesquisas qualitativas no cenário científico. Considerações finais: Considera-se, portanto, que as pesquisas de abordagem qualitativa vêm crescendo nos últimos anos trazendo um olhar diferenciado para explicação de fenômenos
Albiglutide and cardiovascular outcomes in patients with type 2 diabetes and cardiovascular disease (Harmony Outcomes): a double-blind, randomised placebo-controlled trial
Background:
Glucagon-like peptide 1 receptor agonists differ in chemical structure, duration of action, and in their effects on clinical outcomes. The cardiovascular effects of once-weekly albiglutide in type 2 diabetes are unknown. We aimed to determine the safety and efficacy of albiglutide in preventing cardiovascular death, myocardial infarction, or stroke.
Methods:
We did a double-blind, randomised, placebo-controlled trial in 610 sites across 28 countries. We randomly assigned patients aged 40 years and older with type 2 diabetes and cardiovascular disease (at a 1:1 ratio) to groups that either received a subcutaneous injection of albiglutide (30–50 mg, based on glycaemic response and tolerability) or of a matched volume of placebo once a week, in addition to their standard care. Investigators used an interactive voice or web response system to obtain treatment assignment, and patients and all study investigators were masked to their treatment allocation. We hypothesised that albiglutide would be non-inferior to placebo for the primary outcome of the first occurrence of cardiovascular death, myocardial infarction, or stroke, which was assessed in the intention-to-treat population. If non-inferiority was confirmed by an upper limit of the 95% CI for a hazard ratio of less than 1·30, closed testing for superiority was prespecified. This study is registered with ClinicalTrials.gov, number NCT02465515.
Findings:
Patients were screened between July 1, 2015, and Nov 24, 2016. 10 793 patients were screened and 9463 participants were enrolled and randomly assigned to groups: 4731 patients were assigned to receive albiglutide and 4732 patients to receive placebo. On Nov 8, 2017, it was determined that 611 primary endpoints and a median follow-up of at least 1·5 years had accrued, and participants returned for a final visit and discontinuation from study treatment; the last patient visit was on March 12, 2018. These 9463 patients, the intention-to-treat population, were evaluated for a median duration of 1·6 years and were assessed for the primary outcome. The primary composite outcome occurred in 338 (7%) of 4731 patients at an incidence rate of 4·6 events per 100 person-years in the albiglutide group and in 428 (9%) of 4732 patients at an incidence rate of 5·9 events per 100 person-years in the placebo group (hazard ratio 0·78, 95% CI 0·68–0·90), which indicated that albiglutide was superior to placebo (p<0·0001 for non-inferiority; p=0·0006 for superiority). The incidence of acute pancreatitis (ten patients in the albiglutide group and seven patients in the placebo group), pancreatic cancer (six patients in the albiglutide group and five patients in the placebo group), medullary thyroid carcinoma (zero patients in both groups), and other serious adverse events did not differ between the two groups. There were three (<1%) deaths in the placebo group that were assessed by investigators, who were masked to study drug assignment, to be treatment-related and two (<1%) deaths in the albiglutide group.
Interpretation:
In patients with type 2 diabetes and cardiovascular disease, albiglutide was superior to placebo with respect to major adverse cardiovascular events. Evidence-based glucagon-like peptide 1 receptor agonists should therefore be considered as part of a comprehensive strategy to reduce the risk of cardiovascular events in patients with type 2 diabetes.
