Nix v. Williams: The Inevitable Discovery Exception to the Exclusionary Rule
In Nix v. Williams, the Supreme Court created an inevitable discovery exception to the exclusionary rule. This exception allows the prosecution to introduce illegally obtained evidence at trial upon a showing that such evidence would inevitably have been obtained, even without the police misconduct. The Supreme Court rejected the imposition of a second prong on the inevitable discovery exception which would have required the government to prove the absence of bad faith. The purpose of the inevitable discovery exception is to prevent the setting aside [of] convictions that would have been obtained without police misconduct
Bureaucratic Regulation and Emotional Labor: Implications for Social Services Case Management
Abstract
This paper examines Family and Independence Case Managers in the social services in Atlanta, GA, as they negotiate a highly bureaucratized benefit delivery system that undervalues the emotional costs inherent in its operation. I begin with an examination of Weber’s (1946) theories of bureaucracy, as typified by three components of authority and control in the office. I proceed to Ritzer’s (2004) theory of “McDonaldization,” which advances Weber’s explication of ideal types of bureaucracy by highlighting four institutionalized dimensions of the corporate business model. Then, by incorporating Hochschild’s (1983) discussion of emotional labor, I include an analysis of the impact of emotional labor on workers’ experiences. I use a snowball sampling strategy, interviewing ten former colleagues. By employing the use of in-depth interviews, I attempt to provide an accurate depiction of the work-lives of these case managers and of the struggles they face in relation to their work and to themselves
Community Structure in Time-Dependent, Multiscale, and Multiplex Networks
Network science is an interdisciplinary endeavor, with methods and
applications drawn from across the natural, social, and information sciences. A
prominent problem in network science is the algorithmic detection of
tightly-connected groups of nodes known as communities. We developed a
generalized framework of network quality functions that allowed us to study the
community structure of arbitrary multislice networks, which are combinations of
individual networks coupled through links that connect each node in one network
slice to itself in other slices. This framework allows one to study community
structure in a very general setting encompassing networks that evolve over
time, have multiple types of links (multiplexity), and have multiple scales.Comment: 31 pages, 3 figures, 1 table. Includes main text and supporting

Overrepresented and Under Discussed: From Conceptual Analysis to Practical Implications for Crossover among Black Girls
Crossover youth are young people who have experiences of maltreatment and exhibit delinquency, which may or may not come to the formal attention of the child welfare and juvenile justice systems. Black youth are overrepresented among the crossover youth population, and evidence suggests that Black girls who experience crossover are particularly in need of specialized attention. Black girls’ experiences within child welfare, juvenile justice, and related systems are unique given the intersection of race and gender in light of issues such as discrimination, disparate treatment, and abuse undergone while in the care of agencies touted to protect them. Guided by a Black Feminism perspective and Critical Race Theory that acknowledge the intersection of race, gender, and additional social identities as well as structural racism and power, this manuscript provides an overview of the aforementioned issues and focuses on practical implications for better serving Black girls who experience crossover and their mental health. The authors offer a strengths-based, community framework to better understand the mental health needs of Black girls who experience maltreatment and exhibit delinquent behavior. In particular, the aim is to recognize the role that systemic racism and gendered experiences and obstacles have on individuals navigating the child welfare and juvenile justice systems. Finally, the authors present tangible implications for individuals and communities that are unique to the intersectional needs of Black system-involved girls
A two weight local Tb theorem for the Hilbert transform
We obtain a two weight local Tb theorem for any elliptic and gradient
elliptic fractional singular integral operator T on the real line, and any pair
of locally finite positive Borel measures on the line. This includes the
Hilbert transform and in a sense improves on the T1 theorem by the authors and

in the treatment of the stopping form in v12: the proof of Lemma 9.3 there
requires a larger size functional, a collection of pairs is missing from the
decomposition at the bottom of page 149, and an error was made in the
definition of restricted norm of a stopping form. Main results unchange
