    Anticipating New References: Predicting the Contours of the New Otherwise Available to the Public Category of Prior Art

    As part of the move from a first-to-invent to a first-to-file patent system, the Leahy-Smith America Invents Act, passed in September 2011, modifies the novelty section of the patent statute. The new novelty section retains four familiar categories of prior art from the previous Patent Act, but also adds a new category: inventions “otherwise available to the public.” The Act does not define “otherwise available to the public,” leaving unanswered questions of what the drafters intended the new category to capture, and whether it truly encompasses any new types of prior art. This Note draws insights from the development of standards governing the retained categories of prior art, especially the printed publication category, to predict what new types of prior art references may be captured by the “otherwise available” language. Based on the policies underlying the “otherwise available” category, the Note argues that the language should be interpreted as extending the standards developed under the printed publication bar to non-documentary references, which would provide a flexible prior art category able to capture unanticipated new technologies and norms of disseminating information

    New Zealand contributions to the global earthquake model’s earthquake consequences database (GEMECD)

    The Global Earthquake Model’s (GEM) Earthquake Consequences Database (GEMECD) aims to develop, for the first time, a standardised framework for collecting and collating geocoded consequence data induced by primary and secondary seismic hazards to different types of buildings, critical facilities, infrastructure and population, and relate this data to estimated ground motion intensity via the USGS ShakeMap Atlas. New Zealand is a partner of the GEMECD consortium and to-date has contributed with 7 events to the database, of which 4 are localised in the South Pacific area (Newcastle 1989; Luzon 1990; South of Java 2006 and Samoa Islands 2009) and 3 are NZ-specific events (Edgecumbe 1987; Darfield 2010 and Christchurch 2011). This contribution to GEMECD represented a unique opportunity for collating, comparing and reviewing existing damage datasets and harmonising them into a common, openly accessible and standardised database, from where the seismic performance of New Zealand buildings can be comparatively assessed. This paper firstly provides an overview of the GEMECD database structure, including taxonomies and guidelines to collect and report on earthquake-induced consequence data. Secondly, the paper presents a summary of the studies implemented for the 7 events, with particular focus on the Darfield (2010) and Christchurch (2011) earthquakes. Finally, examples of specific outcomes and potentials for NZ from using and processing GEMECD are presented, including: 1) the rationale for adopting the GEM taxonomy in NZ and any need for introducing NZ-specific attributes; 2) a complete overview of the building typological distribution in the Christchurch CBD prior to the Canterbury earthquakes and 3) some initial correlations between the level and extent of earthquake-induced physical damage to buildings, building safety/accessibility issues and the induced human casualtie

    Density-functional studies of tungsten trioxide, tungsten bronzes, and related systems

    Tungsten trioxide adopts a variety of structures which can be intercalated with charged species to alter the electronic properties, thus forming `tungsten bronzes'. Similar optical effects are observed upon removing oxygen from WO_3, although the electronic properties are slightly different. Here we present a computational study of cubic and hexagonal alkali bronzes and examine the effects on cell size and band structure as the size of the intercalated ion is increased. With the exception of hydrogen (which is predicted to be unstable as an intercalate), the behaviour of the bronzes are relatively consistent. NaWO_3 is the most stable of the cubic systems, although in the hexagonal system the larger ions are more stable. The band structures are identical, with the intercalated atom donating its single electron to the tungsten 5d valence band. Next, this was extended to a study of fractional doping in the Na_xWO_3 system (0 < x < 1). A linear variation in cell parameter, and a systematic change in the position of the Fermi level up into the valence band was observed with increasing x. In the underdoped WO_3-x system however, the Fermi level undergoes a sudden jump into the conduction band at around x = 0.2. Lastly, three compounds of a layered WO_4&#215;a,wdiaminoalkane hybrid series were studied and found to be insulating, with features in the band structure similar to those of the parent WO_3 compound which relate well to experimental UV-visible spectroscopy results.Comment: 12 pages, 16 figure

    Masking of an auditory behaviour reveals how male mosquitoes use distortion to detect females

    The mating behaviour of many mosquito species is mediated essentially by sound: males follow and mate with a female mid-flight by detecting and tracking the whine of her flight-tones. The stereotypical rapid frequency modulation (RFM) male behaviour, initiated in response to the detection of the female's flight-tones, has provided a means of investigating these auditory mechanisms while males are free-flying. Mosquitoes hear with their antennae, which vibrate to near-field acoustic excitation. The antennae generate nonlinear vibrations (distortion products, DPs) at frequencies that are equal to the difference between the two simultaneously presented tones, e.g. the male and female flight-tones, which are detected by mechanoreceptors in the auditory Johnston's organ (JO) at the base of the antenna. Recent studies indicated the male mosquito's JO is tuned not to the female flight-tone, but to the frequency difference between the male and female flight-tones. To test the hypothesis that mosquitoes detect this frequency difference, Culex quinquefasciatus males were presented simultaneously with a female flight-tone and a masking tone, which should suppress the male's RFM response to sound. The free-flight behavioural and in vivo electrophysiological experiments revealed that acoustic masking suppresses the RFM response to the female's flight-tones by attenuating the DPs generated in the nonlinear vibration of the antennae. These findings provide direct evidence in support of the hypothesis that male mosquitoes detect females when both are in flight through difference tones generated in the vibrations of their antennae owing to the interaction between their own flight-tones and those of a female

    Decellularization and Characterization of Porcine Superflexor Tendon: A Potential Anterior Cruciate Ligament Replacement

    The porcine superflexor tendon (SFT) was identified as having appropriate structure and properties for development of a decellularised device for use in ACL reconstruction. SFTs were decellularised using a combination of freeze thaw and washes in hypotonic buffer and 0.1% (w/v) SDS in hypotonic buffer plus proteinase inhibitors followed by nuclease treatment and sterilisation using peracetic acid. The decellularised biological scaffold was devoid of cells and cell remnants and contained only 13 ng.mg-1 (dry weight) residual total DNA. Immunohistochemistry showed retention of collagens type I and III and tenascin-C. Quantitative analysis of sulphated sugar and hydroxyproline content revealed a loss of glycosaminoglycans compared to native tissue but no loss of collagen. The decellularised SFT was biocompatible in vitro and in vivo following implantation in a mouse subcutaneous model for 12 weeks. Uniaxial tensile testing to failure indicated that the gross material properties of decellularised SFT were not significantly different to native tissue. Decellularised SFTs had an ultimate tensile strength of 61.8 ± 10.3 MPa (± 95 % confidence limits), a failure strain of 0.29 ± 0.04 and a Young’s modulus of the collagen phase of 294.1 ± 61.9 MPa. Analysis of the presence of the alpha-Gal (galactose-α-1,3-galactose) epitope by immunohistochemistry, lectin binding and antibody absorption assay indicated that the epitope was reduced but still present post decellularisation. This is discussed in light of the potential role of non-cellular alpha-Gal in the acceleration of wound healing and tissue regeneration in the presence of antibodies to alpha-Gal

    'Selling it as a holistic health provision and not just about condoms ?' Sexual health services in school settings: current models and their relationship with sex and relationships education policy and provision

    In this article we discuss the findings from a recent study of UK policy and practice in relation to sexual health services for young people, based in - or closely linked with - schools. This study formed part of a larger project, completed in 2009, which also included a systematic review of international research. The findings discussed in this paper are based on analyses of interviews with 51 service managers and questionnaire returns from 205 school nurses. Four themes are discussed. First, we found three main service permutations, in a context of very diverse and uneven implementation. Second, we identified factors within the school context that shaped and often constrained service provision; some of these also have implications for sex and relationships education (SRE). Third, we found contrasting approaches to the relationship between SRE input and sexual health provision. Fourth, we identified some specific barriers that need to be addressed in order to develop 'young people friendly' services in the school context. The relative autonomy available to school head teachers and governors can represent an obstacle to service provision - and inter-professional collaboration - in a climate where, in many schools, there is still considerable ambivalence about discussing 'sex' openly. In conclusion, we identify areas worthy of further research and development, in order to address some obstacles to sexual health service and SRE provision in schools

    The night-sky at the Calar Alto Observatory

    We present a characterization of the main properties of the night-sky at the Calar Alto observatory for the time period between 2004 and 2007. We use optical spectrophotometric data, photometric calibrated images taken in moonless observing periods, together with the observing conditions regularly monitored at the observatory, such as atmospheric extinction and seeing. We derive, for the first time, the typical moonless night-sky optical spectrum for the observatory. The spectrum shows a strong contamination by different pollution lines, in particular from Mercury lines, which contribution to the sky-brightness in the different bands is of the order of ~0.09 mag, ~0.16 mag and ~0.10 mag in B, V and R respectively. The zenith-corrected values of the moonless night-sky surface brightness are 22.39, 22.86, 22.01, 21.36 and 19.25 mag arcsec^-2 in U, B, V, R and I, which indicates that Calar Alto is a particularly dark site for optical observations up to the I-band. The fraction of astronomical useful nights at the observatory is ~70%, with a ~30% of photometric nights. The typical extinction at the observatory is k_V~0.15 mag in the Winter season, with little dispersion. In summer the extinction has a wider range of values, although it does not reach the extreme peaks observed at other sites. The median seeing for the last two years (2005-6) was ~0.90", being smaller in the Summer (~0.87") than in the Winter (~0.96"). We conclude in general that after 26 years of operations Calar Alto is still a good astronomical site, being a natural candidate for future large aperture optical telescopes.Comment: 16 pages, 5 figures, accepted for publishing in the Publications of Astronomical Society of the Pacific (PASP
