Trade Mark Cluttering: An Exploratory Report Commissioned by UKIPO
This report explores the problem of âclutteringâ of trade mark registers. The report consists of two parts: the first presents a conceptual discussion of âclutteringâ of trade mark registers. The second part provides an exploratory empirical analysis of trade mark applications at the UK Intellectual Property Office (UKIPO) and the European trade mark office (OHIM). This part contains results of a descriptive and an econometric analysis. According to our definition, cluttering arises where firms hold trade marks that are overly broad or unused raising search costs for later applicants. The report distinguishes between three mechanisms that can lead to cluttering. It also considers a series of mechanisms that work against cluttering. This discussion is based on a review of the previous literature. The tentative empirical evidence provided in the second part of the report suggests that trade marks are more frequently registered in several classes at the same time and also that firms in pharmaceuticals increasingly resort to multiple simultaneous applications to ensure that they will register at least one trade mark. There is also some evidence that firms seek to avoid mechanisms such as relative grounds examination which can prevent cluttering. Finally, we report direct survey-based evidence that applicants perceive cluttering to be a problem in specific fields and countries. However, our exploratory analysis does not provide strong evidence that cluttering has already become a systemic problem for the trade mark systems that is comparable to the effect of patent thickets for patent systems
Analysing the role of complexity in explaining the fortunes of technology programmes : Empirical application of the NASSS framework

Complexity theory can help explain why. Phenomena may be simple (straightforward, predictable, few components), complicated (multiple interacting components or issues) or complex (dynamic, unpredictable, not easily disaggregated into constituent components). The recently published NASSS framework applies this taxonomy to explain Non-adoption or Abandonment of technology by individuals and difficulties achieving Scale-up, Spread and Sustainability. This paper reports the first empirical application of the NASSS framework. Methods: Six technology-supported programmes were studied using ethnography and action research for up to 3 years across 20 health and care organisations and 10 national-level bodies. They comprised video outpatient consultations, GPS tracking technology for cognitive impairment, pendant alarm services, remote biomarker monitoring for heart failure, care organising software and integrated case management via data warehousing. Data were collected at three levels: micro (individual technology users), meso (organisational processes and systems) and macro (national policy and wider context). Data analysis and synthesis were guided by socio-technical theories and organised around the seven NASSS domains: (1) the condition or illness, (2) the technology, (3) the value proposition, (4) the adopter system (professional staff, patients and lay carers), (5) the organisation(s), (6) the wider (institutional and societal) system and (7) interaction and mutual adaptation among all these domains over time. Results: The study generated more than 400 h of ethnographic observation, 165 semi-structured interviews and 200 documents. The six case studies raised multiple challenges across all seven domains. Complexity was a common feature of all programmes. In particular, individuals' health and care needs were often complex and hence unpredictable and 'off algorithm'. Programmes in which multiple domains were complicated proved difficult, slow and expensive to implement. Those in which multiple domains were complex did not become mainstreamed (or, if mainstreamed, did not deliver key intended outputs). Conclusion: The NASSS framework helped explain the successes, failures and changing fortunes of this diverse sample of technology-supported programmes. Since failure is often linked to complexity across multiple NASSS domains, further research should systematically address ways to reduce complexity and/or manage programme implementation to take account of it.Peer reviewedFinal Published versio
The Birchwood Junk Food Cafe, Skelmersdale
The University of Manchester conducted an evaluation of the Birchwood Junk Food Cafe, Skelmersdale, to assess the additional benefits of their adapted approach. A mixed methods evaluation was conducted, including interviews and questionnaires with both customers and those running the cafe. This highlighted benefits of the cafe and the impact of the cafe on its volunteers and customers. Key messages: Junk Food Cafes have the potential to have a positive impact on public health. Junk Food Cafes have the potential to help combat food poverty and social isolation in deprived communities
Ten steps or climbing a mountain: A study of Australian health professionals' perceptions of implementing the baby friendly health initiative to protect, promote and support breastfeeding
Background: The Baby Friendly Hospital (Health) Initiative (BFHI) is a global initiative aimed at protecting,
promoting and supporting breastfeeding and is based on the ten steps to successful breastfeeding. Worldwide,
over 20,000 health facilities have attained BFHI accreditation but only 77 Australian hospitals (approximately 23%)
have received accreditation. Few studies have investigated the factors that facilitate or hinder implementation of
BFHI but it is acknowledged this is a major undertaking requiring strategic planning and change management
throughout an institution. This paper examines the perceptions of BFHI held by midwives and nurses working in
one Area Health Service in NSW, Australia.
Methods: The study used an interpretive, qualitative approach. A total of 132 health professionals, working across four maternity units, two neonatal intensive care units and related community services, participated in 10 focus groups. Data were analysed using thematic analysis.
Results: Three main themes were identified: âBelief and Commitmentâ; âInterpreting BFHIâ and âClimbing a
Mountainâ. Participants considered the BFHI implementation a high priority; an essential set of practices that would
have positive benefits for babies and mothers both locally and globally as well as for health professionals. It was
considered achievable but would take commitment and hard work to overcome the numerous challenges including a number of organisational constraints. There were, however, differing interpretations of what was required to attain BFHI accreditation with the potential that misinterpretation could hinder implementation.
A model described by Greenhalgh and colleagues on adoption of innovation is drawn on to interpret the findings.
Conclusion: Despite strong support for BFHI, the principles of this global strategy are interpreted differently by
health professionals and further education and accurate information is required. It may be that the current
processes used to disseminate and implement BFHI need to be reviewed. The findings suggest that there is a
contradiction between the broad philosophical stance and best practice approach of this global strategy and the
tendency for health professionals to focus on the ten steps as a set of tasks or a checklist to be accomplished. The
perceived procedural approach to implementation may be contributing to lower rates of breastfeeding

âKeeping Birth Normalâ: Exploratory evaluation of a training package for midwives in an inner-city, alongside midwifery unit
Objectives
to gain understanding about how participants perceived the value and effectiveness of âKeeping Birth Normalâ training, barriers to implementing it in an along-side midwifery unit, and how the training might be enhanced in future iterations.

31 midwives attending a one-day training package on one of three occasions.
Methods
data were collected using semi-structured observation of the training, a short feedback form (23/31 participants), and focus groups (28/31 participants). Feedback form data were analysed using summative content analysis, following which all data sets were pooled and thematically analysed using a template agreed by the researchers.
Findings
We identified six themes contributing to the workshop's effectiveness as perceived by participants. Three related to the workshop design: (1) balanced content, (2) sharing stories and strategies and (3) âless is more.â And three related to the workshop leaders: (4) inspiration and influence, (5) cultural safety and (6) managing expectations. Cultural focus on risk and low prioritisation of normal birth were identified as barriers to implementing evidence-based practice supporting normal birth. Building a community of practice and the role of consultant midwives were identified as potential opportunities.
Key conclusions and implications for practice
a review of evidence, local statistics and practical skills using active educational approaches was important to this training. Two factors not directly related to content appeared equally important: catalysing a community of practice and the perceived power of workshop leaders to influence organisational systems limiting the agency of individual midwives. Cyclic, interactive training involving consultant midwives, senior midwives and the multidisciplinary team may be recommended to be most effective
Beyond adoption: A new framework for theorising and evaluating Non-adoption, Abandonment and challenges to Scale-up, Spread and Sustainability (NASSS) of health and care technologies

Objective: Our objective was to produce an evidence-based, theory-informed, and pragmatic framework to help predict and evaluate the success of a technology-supported health or social care program. Methods: The study had 2 parallel components: (1) secondary research (hermeneutic systematic review) to identify key domains, and (2) empirical case studies of technology implementation to explore, test, and refine these domains. We studied 6 technology-supported programsâvideo outpatient consultations, global positioning system tracking for cognitive impairment, pendant alarm services, remote biomarker monitoring for heart failure, care organizing software, and integrated case management via data sharingâusing longitudinal ethnography and action research for up to 3 years across more than 20 organizations. Data were collected at micro level (individual technology users), meso level (organizational processes and systems), and macro level (national policy and wider context). Analysis and synthesis was aided by sociotechnically informed theories of individual, organizational, and system change. The draft framework was shared with colleagues who were introducing or evaluating other technology-supported health or care programs and refined in response to feedback. Results: The literature review identified 28 previous technology implementation frameworks, of which 14 had taken a dynamic systems approach (including 2 integrative reviews of previous work). Our empirical dataset consisted of over 400 hours of ethnographic observation, 165 semistructured interviews, and 200 documents. The final nonadoption, abandonment, scale-up, spread, and sustainability (NASSS) framework included questions in 7 domains: the condition or illness, the technology, the value proposition, the adopter system (comprising professional staff, patient, and lay caregivers), the organization(s), the wider (institutional and societal) context, and the interaction and mutual adaptation between all these domains over time. Our empirical case studies raised a variety of challenges across all 7 domains, each classified as simple (straightforward, predictable, few components), complicated (multiple interacting components or issues), or complex (dynamic, unpredictable, not easily disaggregated into constituent components). Programs characterized by complicatedness proved difficult but not impossible to implement. Those characterized by complexity in multiple NASSS domains rarely, if ever, became mainstreamed. Sustaining modified behaviours learnt in a diabetes prevention program in regional Australia : the role of social context
BackgroundThe Greater Green Triangle diabetes prevention program was conducted in primary health care setting of Victoria and South Australia in 2004--2006. This program demonstrated significant reductions in diabetes risk factors which were largely sustained at 18 month follow-up. The theoretical model utilised in this program achieved its outcomes through improvements in coping self-efficacy and planning. Previous evaluations have concentrated on the behavioural components of the intervention. Other variables external to the main research design may have contributed to the success factors but have yet to be identified. The objective of this evaluation was to identify the extent to which participants in a diabetes prevention program sustained lifestyle changes several years after completing the program and to identify contextual factors that contributed to sustaining changes.MethodsA qualitative evaluation was conducted. Five focus groups were held with people who had completed a diabetes prevention program, several years later to assess the degree to which they had sustained program strategies and to identify contributing factors.ResultsParticipants value the recruitment strategy. Involvement in their own risk assessment was a strong motivator. Learning new skills gave participants a sense of empowerment. Receiving regular pathology reports was a means of self-assessment and a motivator to continue. Strong family and community support contributed to personal motivation and sustained practice.ConclusionsFamily and local community supports constitute the contextual variables reported to contribute to sustained motivation after the program was completed. Behaviour modification programs can incorporate strategies to ensure these factors are recognised and if necessary, strengthened at the local level.<br /
