    Argumentation based on statistical data at the very beginning of primary school – Evidence from two empirical studies

    Although students’ argumentation is subject of high interest in mathematics educational research, specific studies on argumentation based on statistical data are still scarce, especially with a focus on young students at the beginning of primary school. Therefore, relatively little is known so far to what extent children starting school may already be able to engage in argumentation based on statistical data. Addressing this research need, evidence is reported from two empirical studies, which were conducted with N = 11 and N = 29 students during their first weeks in school. The results show that data-based argumentation is possible for many students from the beginning of primary school on, and provide insight into the broad spectrum of students’ data-based arguments.The phase of data collection of the reported research had been supported by research funds from the Senate of Ludwigsburg University of Education

    The article aims to claim that the notion of human dignity can play a relevant role in private law, both in civil law and labor law. It is argued that Jeremy Waldron’s understanding of the concept of human dignity as a rank or status can provide a concrete content to the concept, forbidding any humiliating or degrading treatment to any human person. Then, the article analyzes some projections that can be articulated from this interpretation in the context of the law of contracts, the law of torts and labor law.El artículo tiene como objetivo plantear que la noción de dignidad humana puede tener un rol relevante en el derecho privado, tanto en el derecho civil como en el derecho laboral. Se sostiene que el entendimiento de la dignidad humana como rango o estatus, elaborado por Jeremy Waldron, le da un contenido concreto al concepto, prohibiendo los tratos humillantes o degradantes en contra de cualquier persona humana. Luego se analizan algunas proyecciones que pueden articularse a partir de esta interpretación en el ámbito del derecho de los contratos, la responsabilidad civil y en el derecho laboral

    Exploring the importance of within-canopy spatial temperature variation on transpiration predictions

    Models seldom consider the effect of leaf-level biochemical acclimation to temperature when scaling forest water use. Therefore, the dependence of transpiration on temperature acclimation was investigated at the within-crown scale in climatically contrasting genotypes of Acer rubrum L., cv. October Glory (OG) and Summer Red (SR). The effects of temperature acclimation on intracanopy gradients in transpiration over a range of realistic forest growth temperatures were also assessed by simulation. Physiological parameters were applied, with or without adjustment for temperature acclimation, to account for transpiration responses to growth temperature. Both types of parameterization were scaled up to stand transpiration (expressed per unit leaf area) with an individual tree model (MAESTRA) to assess how transpiration might be affected by spatial and temporal distributions of foliage properties. The MAESTRA model performed well, but its reproducibility was dependent on physiological parameters acclimated to daytime temperature. Concordance correlation coefficients between measured and predicted transpiration were higher (0.95 and 0.98 versus 0.87 and 0.96) when model parameters reflected acclimated growth temperature. In response to temperature increases, the southern genotype (SR) transpiration responded more than the northern (OG). Conditions of elevated long-term temperature acclimation further separate their transpiration differences. Results demonstrate the importance of accounting for leaf-level physiological adjustments that are sensitive to microclimate changes and the use of provenance-, ecotype-, and/or genotype-specific parameter sets, two components likely to improve the accuracy of site-level and ecosystem-level estimates of transpiration flux

    Securing protein for the approximate 10 billion humans expected to inhabit our planet by 2050 is a major priority for the global community. Evidence has accrued over the past 30 years that strongly supports and justifies the sustainable use of insects as a means to produce protein products as feed for pets, livestock, poultry, and aquacultured species. Researchers and entrepreneurs affiliated with universities and industries, respectively, from 18 nations distributed across North and South America, Europe, Asia, Africa and Australia contributed to the development of this article, which is an indication of the global interest on this topic. A brief overview of insects as feed for the aquaculture industry along with a review of the black soldier fly, Hermetia illucens (Diptera: Stratiomyidae), as a model for such systems is provided

    The present work is structured under two hypotheses. The first hypothesis claims that corrective justice is the principle that better explains the theory and practice of tort law. The second hypothesis, which shall be called the inseparability thesis, holds it is impossible to separate tort law from the demands of corrective and distributive justice. Both statements are based on its discussion in the Anglo-American literature, although some Chilean will also be discussed. Additionally, it is argued that the two hypotheses are applicable to the practical development of tort law's problems, providing a theoretical framework that allows creating new solutions to these problems that have not been addressed adequately by Chilean legal scholars.La présente étude est structurée autour de deux hypothèses de travail. Selon la première hypothèse, le principe qui explique le mieux la théorie et la pratique de la responsabilité extracontractuelle est la justice réparatrice. Selon la deuxième hypothèse, appelée thèse de l'inséparabilité, il est impossible de séparer la responsabilité extracontractuelle des requêtes de la justice distributive et réparatrice. Ces affirmations sont étayées par différents auteurs qui ont participé au débat en la matière dans la littérature anglo-saxonne, mais aussi par la doctrine chilienne. L'article postule également que les deux hypothèses mentionnées sont applicables au développement pratique des problèmes de responsabilité extracontractuelle et fournissent un cadre théorique qui permet d'apporter des réponses novatrices á des problèmes qui n'ont pas été suffisamment abordés dans la doctrine chilienne.El presente trabajo se estructura sobre la base de dos hipótesis. La primera, plantea que la justicia correctiva es el principio que mejor explica la teoría y la práctica de la responsabilidad extracontractual. La segunda, denominada como tesis de la inseparabilidad, sostiene que es imposible separar la responsabilidad extracontractual de las demandas de la justicia distributiva y correctiva. Estas afirmaciones se sustentan en la opinión de diversos autores provenientes de la discusión en la literatura anglosajona, pero también en la doctrina chilena. Adicionalmente, se plantea que las dos hipótesis enunciadas son aplicables al desarrollo práctico de los problemas de responsabilidad extracontractual, otorgando un marco teórico que permite dar nuevas respuestas a estos problemas que no han sido explorados en forma adecuada por la doctrina chilena
