A FALÁCIA DA ISONOMIA ENTRE AS PARTES NO PROCESSO PENAL BRASILEIRO: QUANDO A ESTRUTURAÇÃO MATERIAL E ORÇAMENTÁRIA IMPORTA! THE FALLACY OF ISONOMY BETWEEN THE PARTIES IN THE BRAZILIAN CRIMINAL PROCEDURE: WHEN THE MATERIAL AND BUDGETARY STRUCTURE MATTERS!
Based on a bibliographical review and document analysis of the 2023 Brazilian Federal Annual Budget Law, this study sought to understand: what is the extent of isonomy of the parties according to the constitutional mandament of ample defense in favor of procedural subjects and to what extent the Brazilian State preserves and fulfills the individual rights and guarantees of access for all people to the legal system at all levels, judicial or extrajudicial, but especially in the investigative phase, or pretrial, of the criminal process? These questions with a focus on the Criminal Procedure and the (un)effective participation of the citizens in the preliminary investigation will allow us to understand an important point of maintainance of the inquisitorial mentality in the Brazilian criminal procedural system as a deliberate public policy, which is the lack of adequate implementation of the Public Defender's Office in the States and in the Union, reinforced by the repetition, affronting the Constitution, that the ample defense could be mitigated in the preliminary investigation.A partir de revisão bibliográfica e análise documental da Lei Orçamentária Anual de 2023 da União se buscou com este estudo compreender: qual a amplitude da isonomia das partes em vista da previsão constitucional da ampla defesa em favor dos sujeitos processuais e em que medida o Estado brasileiro preserva e realiza os direitos e garantias individuais de acesso de todas as pessoas ao sistema juridicional em todos os graus, judicial ou extrajudicial, mas especialmente na fase investigativa do processo penal? Essas perguntas com o foco no Processo Penal e na participação efetiva ou não dos cidadãos na investigação preliminar permitirão compreender um importante ponto de manutenção da mentalidade inquisitorial no sistema processual penal brasileiro como deliberada política pública, que é a não implantação adequada da Defensoria Pública nos Estados e na União, reforçada pela repetição, afrontosa à Constituição, de que a ampla defesa poderia ser mitigada na investigação preliminar
Fault Compensation Controller for Markovian Jump Linear Systems
In this paper, we tackle the fault-compensation controller in the context of Marko- vian Jump Linear Systems (MJLS). More specifically, we propose the design of H∞ Fault- Compensation Controllers under the MJLS formulation, which is provided in terms of linear matrices inequalities optimization problems. These particular controllers have as the main motivation the network communication loss which is inherent to any automation process. We present a numerical example of a coupled tank system, where a Monte Carlo simulation illustrates the feasibility of the proposed solution. The results show that the proposed approach is indeed a valuable alternative to compensate for the fault occurrence
Gain-Scheduled Controller for Fault Accommodation in Linear Parameter Varying Systems with Imprecise Measurements
We present the design of H∞ and H2 gain-scheduled fault-accommodation controllers for discrete-time Linear Parameter Varying systems. We design our conditions as Bilinear Matrix Inequalities, assuming that the scheduled parameters are imprecise, which is a commonly found characteristic of practical applications that happens due to measurement noise and inaccuracy on its estimation/acquisition procedure. The proposed solution is based on the use of a multi-simplex approach for solving the main conditions, which guarantees the stability of the system under imprecise measurements on the scheduling parameters. The efficacy of the proposed approach is illustrated with a numerical example
EDUCAÇÃO AMBIENTAL: O DESPERTAR DE UMA PROPOSTA CRÍTICA PARA A FORMAÇÃO DO SUJEITO ECOLÓGICO
O córrego Barbado, em Cuiabá-MT, a exemplo de outros córregos urbanos, tem sofrido todos os tipos de ações antrópicas, desde obras de canalizações e desvios de seu leito natural, quanto despejos de efluentes domésticos, lixos, destruição de sua mata ciliar e assoreamento. O objetivo deste trabalho foi avaliar alguns aspectos da problemática hidroambiental deste córrego, de sua nascente até a sua foz, usando o monitoramento da qualidade de suas aguas por parâmetros físico-químicos, e por meio da análise da percepção dos moradores do seu entorno. Concluiu-se que o córrego Barbado necessita de projetos de recuperação que incluam desde a conscientização dos moradores do seu entorno sobre a sua importância para o meio ambiente, quanto de investimentos no setor de saneamento básico que priorize a coleta e tratamento de efluentes e a coleta de resíduos sólidos dos bairros que o circundam
Short-term transcutaneous electrical nerve stimulation reduces pain and improves the masticatory muscle activity in temporomandibular disorder patients: a randomized controlled trial
Studies to assess the effects of therapies on pain and masticatory muscle function are scarce. Objective To investigate the short-term effect of transcutaneous electrical nerve stimulation (TENS) by examining pain intensity, pressure pain threshold (PPT) and electromyography (EMG) activity in patients with temporomandibular disorder (TMD). Material and Methods Forty patients with myofascial TMD were enrolled in this randomized placebo-controlled trial and were divided into two groups: active (n=20) and placebo (n=20) TENS. Outcome variables assessed at baseline (T0), immediately after (T2) and 48 hours after treatment (T1) were: pain intensity with the aid of a visual analogue scale (VAS); PPT of masticatory and cervical structures; EMG activity during mandibular rest position (MR), maximal voluntary contraction (MVC) and habitual chewing (HC). Two-way ANOVA for repeated measures was applied to the data and the significance level was set at 5%. Continental fishes from the Tambaba Environmentally Protected Area, Paraíba State, Brazil
A Área de Protenção Ambiental de Tambaba localiza-se na costa sul do Estado da Paraíba, no bioma Mata Atlântica da região Nordeste do Brasil. A Área de Protenção Ambiental de Tambaba é composta por uma série de drenagens independentes: microbacias do Rio Graú, Mucatú e do Rio Bucatú, e sub-bacia do rio Caboclo, pertencente à microbacia do rio Gurugi. Amostras da ictiofauna foram coletadas em cinco expedições científicas entre os meses de junho e julho de 2015. Vinte e nove locais de diferentes habitats (por exemplo, abrangendo tributários, córregos, rios e estuários) foram acessados para amostragem. Um total de 44 espécies distribuídas em 38 gêneros, 25 famílias e 17 ordens foram distribuídas na região hidrográfica de Tambaba. Espécies de água doce compreendem 36% (n = 16) e espécies marinhas-estuarinas 64% (n = 28) do total de espécimes coletados. Duas espécies invasoras ocorrem nos locais de água doce: Cichla monoculus e Poecilia reticulata. Cheirodon jaguaribensis, Cichlasoma orientale e Crenicichla brasiliensis são endêmicos da região Nordeste do Brasil, com as primeiras espécies restritas à ecorregião hidrográfica Nordeste Caatinga e Drenagens Costeiras.Tambaba environmentally protected area is situated on the south coast of Paraíba State, within the Atlantic forest biome of the northeastern region in Brazil. The Tambaba environmentally protected area consists of a series of independent drainages: Graú, Mucatú, and Bucatú river micro-basins, and Caboclo River sub-basin that belongs to Gurugi River micro-basin. Ichthyological samples were collected in five scientific expeditions between months of June and July in 2015. Twenty-nine sites from different habitats (e.g., spanning tributaries, streams, rivers, and estuaries) were accessed for sampling. A total of 44 species distributed within 38 genera, 25 families, and 17 orders were assigned to the Tambaba hydrographic region. Freshwater species comprised 36% (n = 16) and marine-estuarine species 64% (n = 28) of the total collected specimens. Two invasive species occur in the freshwater sites: Cichla monoculus and Poecilia reticulata. Cheirodon jaguaribensis, Cichlasoma orientale, and Crenicichla brasiliensis are endemic to the Brazilian Northeast region with the first species restricted to the Northeast Caatinga and Coastal drainages hydrographic ecoregion
Heavy Metal Poisoning in a Cockatiel (Nymphicus hollandicus)
Background: In recent decades the demand for unconventional pets has been relatively increasing, a situation that increasingly causes veterinarians to encounter these animals in medical and surgical practice. Of these animals, the birds stand out. Animals of the order Psittaciform are known as very curious and active creatures that have the tendency to chew objectsin their environment. Among the several occurrences that lead this animal to attend the veterinary clinic, we highlight the poisoning by heavy metals, especially lead poisoning (Pb) and zinc (Zn). The objective of this work was to report a case of heavy metal intoxication in cockatiel (Nymphicus hollandicus).Case: A cockatiel was taken to the veterinarian with a history of apathy, motor incoordination, exacerbated water consumption and regurgitation. Complete anamnesis was instrumental in directing suspected heavy metal intoxication. Radiopaque particles were visualized through radiographic examination, suggesting heavy metal intoxication. The diagnosis wasconcluded through complementary examinations since the clinical symptoms are nonspecific. The treatment was intended to provide emergency intervention, avoid further absorption, use of antidotes, provide supportive measures and provide guidance to the owner. It can be concluded that the diagnosis and treatment were successful.Discussion: Metal poisoning can kill birds. The veterinarian should always seek the literature in order to perform the best support and treatment. For this, detailed history and detailed medical history must be taken into account, since the time of ingestion and the type of metal interfere with the therapeutic conduct. The use of imaging tests such as x-rays andultrasound are essential to assist the clinician, especially in cases where the tutor does not know whether or not the animal has ingested an object. In the radiographic examination, the heavy metal has the characteristic of having high radiopacity, which was evidenced in the case in question. Radiographic positions should be considered in order to avoid false negatives. In the literature, the treatment of chelation therapy is prioritized to remove the circulating heavy metal and thus act on the cause of the problem. In the case in question calcium EDTA was used intramuscularly, which showed clinical improvement in the animal after the second application. Calcium EDTA binds to metals and facilitates their transport and excretion. The use of fluid therapy is necessary as a supportive treatment to prevent kidney damage, since heavy metals are highlyharmful to nephrons. Especially in cases where the animal stops feeding and ingesting water. The use of antibiotics is essential because in many cases the animal, in addition to not feeding, becomes prone to infections due to metal toxicity, therefore, prophylactic use is essential for a better prognosis. In the case in question, the use of enrofloxacin was effective,as reported in the literature. It is recommended that the diagnosis of serum lead and zinc dosage should be made, however, due to the difficulties of obtaining the samples, and since other metals may also cause intoxication, in the case in question the treatment was started without these results. According to the results obtained in this work, the treatment described in the literature is effective and can be performed immediately to save animal life without subsequent sequelae.Keywords: bird, lead, zinc, calcium EDTA
Aprendizagem da matemática com recurso a materiais tecnológicos
Esta comunicação está inserida no desenvolvimento de um projecto de investigação que procura compreender a forma como os professores de matemática podem integrar o uso de materiais tecnológicos em benefício da aprendizagem dos alunos. O projecto centra-se essencialmente nos materiais electrónicos que acompanham os manuais escolares, CD-Roms, eBooks, portais, filmes e conjuntos de outras actividades que apelam ao uso do computador. Procura-se compreender o papel que estes materiais desempenham no processo de ensino aprendizagem, nomeadamente na forma como os professores se apropriam desses materiais e o uso que fazem dos mesmos na sala de aula. Procurar-se-á apresentar nesta comunicação um breve enquadramento teórico do tema em estudo indicando as principais opções assumidas pelos autores.publishersversionpublishe
Monitorização de uma abordagem tecnológica em matemática - a Academia de khan em Portugal
Este trabalho é apoiado por fundos públicos portugueses através da Fundação para a Ciência e a Tecnologia, Projeto UID/CED/02861/2016.Este texto apresenta um plano de monitorização do projeto de implementação da Plataforma da Academia de Khan em salas de aula de matemática do 1º ao 9º ano em Portugal. Com base numa parceria entre a EDUCOM, a Portugal Telecom e o Ministério da Educação português, está em curso um projeto que envolve a formação de professores na utilização da plataforma e a sua implementação com alunos de cinco escolas nos arredores de Lisboa. Apresentamos aqui os pressupostos teóricos e metodológicos subjacentes a esta monitorização, com o objectivo de caracterizar a formação dos professores envolvidos, a aprendizagem dos alunos e o papel desempenhado pela plataforma no processo de ensino e aprendizagem da matemática.publishersversionpublishe
