    Límites del derecho a huelga en los servicios públicos

    In the context of the right to strike in Spain, its constitutional roots emerge as a fundamental means for safeguarding labor interests, recognized as a subjective, constitutional, fundamental, and inalienable right. However, despite its significance, the current regulation faces notable challenges. The absence of specific legislation for public officials, despite its explicit recognition in the Basic Statute for Public Employees (EBEP), creates a regulatory gap that requires immediate attention. The lack of clear limits and specific conditions for the exercise of the right to strike by public officials adds complexity to the situation. While the EBEP expressly acknowledges this right, the absence of detailed regulations raises questions about crucial aspects such as the procedures for calling and processing strikes, as well as the exceptions and limitations applicable to this group. The urgency to address this lack of specific legislation is based on the need to ensure an equitable exercise of the right to strike by public officials. Normative clarity regarding limits and conditions will enable a more consistent and fair application of this fundamental right, harmonizing labor dynamics in the public sector with the constitutional principles governing the right to strike. This call for legislative action aims to overcome current complexities and consolidate a robust regulatory framework that ensures the protection of fundamental rights and the effective functioning of essential public services.En el contexto del derecho de huelga en España, se evidencia su arraigo constitucional como un medio fundamental para la protección de los intereses laborales, siendo reconocido como un derecho subjetivo, constitucional, fundamental e inalienable. No obstante, a pesar de su importancia, la regulación actual presenta desafíos notables. La falta de una legislación específica para funcionarios públicos, a pesar de su reconocimiento expreso en el Estatuto Básico del Empleado Público (EBEP), genera un vacío normativo que requiere atención inmediata. La carencia de límites claros y condiciones específicas para el ejercicio del derecho de huelga por parte de los funcionarios públicos añade complejidad a la situación. Mientras el EBEP reconoce expresamente este derecho, la ausencia de una normativa detallada deja interrogantes sobre aspectos cruciales como los procedimientos de convocatoria y tramitación, así como las excepciones y limitaciones aplicables a este colectivo. La urgencia de abordar esta falta de legislación específica se fundamenta en la necesidad de garantizar un ejercicio equitativo del derecho de huelga por parte de los funcionarios públicos. La claridad normativa en cuanto a los límites y condiciones permitirá una aplicación más coherente y justa de este derecho fundamental, armonizando así las dinámicas laborales en el ámbito público con los principios constitucionales que rigen el derecho de huelga. Este llamado a la acción legislativa pretende superar las complejidades actuales y consolidar un marco normativo robusto que asegure tanto la protección del derecho fundamental como el funcionamiento efectivo de los servicios públicos esenciales

    Trying to achieve greater respect for administrative efficiency in dependency procedures is crucial when it comes to guaranteeing timely and adequate care for people who depend on the services and benefits of the social protection system. To do this, and to avoid long delays in the procedures for resolution of degree and granting any of the benefits that best suits your personal circumstances, it is necessary to incur in a simplification of administrative processes and expedite response times. Even more so when we are dealing with a group as vulnerable as people in a situation of dependency. This implies implementing greater coordination between the different entities and organizations involved and making use of all available means at our disposal, prioritizing the attention and well-being of these people.Intentar lograr un mayor respeto a la eficacia administrativa en los trámites de dependencia es crucial a la hora de garantizar una atención oportuna y adecuada a las personas que depende de los servicios y prestaciones propios del sistema de protección social. Para ello, y para evitar las grandes dilaciones en los procedimientos de resolución de grado y de concesión cualquiera de las prestaciones que mejor se adapte a su circunstancia personal, es necesario incurrir en una simplificación de los procesos administrativos y agilizar los plazos de respuesta. Más aún cuando estamos ante un colectivo tan vulnerable como son las personas en situación de dependencia. Esto implica implementar una mayor coordinación entre las diferentes entidades y organismos involucrados y hacer uso de todos los medios disponibles a nuestro alcance priorizando la atención y el bienestar de estas personas

    It is necessary to start from a previous self-reflection that allows us to break with the generalizing, prejudiced and associative imaginary that equates disability with the impossibility of participating in the labor market. Since, the prejudices rooted in the idea of ​​disability itself are sustained by means of such beliefs, establishing solid mental barriers, the result, mainly, of ignorance. Which, without a doubt, will have a negative impact on the lives of people with disabilities, given the clear social, educational, political and legal implications, among others, that derive from them. All in all, although progress has been made in recent years in the design of inclusion policies for people with disabilities, there is still a long way to go to achieve important objectives around greater labor and social inclusion of the group. For their part, with regard to women with disabilities, traditional gender roles and other additions hinder entrepreneurial initiative, which has positioned itself as one of the possible solutions to the high unemployment rates both in Spain and Andalusia. This work aims to collect and analyze the socio-labour context of these women and the initiatives proposed by the legislator and public administrations.Es menester partir de una autoreflexión previa que nos permita romper con el imaginario generalizador, prejuicioso y asociativo que equipara discapacidad con imposibilidad de participar en el mercado de trabajo. Puesto que, los prejuicios enraizados en la idea de discapacidad en sí misma se sustentan por medio de tales creencias instaurando solidas barreras mentales fruto, principalmente, del desconocimiento. Lo cual, sin duda alguna, va a incidir negativamente en las vidas de las personas con discapacidad, dadas las claras implicaciones sociales, educativas, políticas y legales, entre otras, que de las mismas se derivan. Con todo, aunque se ha avanzado en los últimos años en el diseño de políticas de inserción de las personas con discapacidad, aún queda mucho camino por recorrer para alcanzar importantes objetivos entorno a una mayor inclusión laboral y social del colectivo. Por su parte, en lo que respecta a las mujeres con discapacidad, los roles tradicionales de género y otros añadidos dificultan la iniciativa emprendedora que se ha posicionado como una de las posibles soluciones a los elevados índices de desempleo tanto en España como en Andalucía. Este trabajo pretende recoger y analizar el contexto socio-laboral de estas mujeres y las iniciativas propuestas por el legislador y las administraciones públicas

En este sentido, la normativa específica entorno a la protección de la maternidad y paternidad ha sufrido numerosas modificaciones a lo largo de la historia con el fin de adaptarse a las nuevas necesidades familiares y al doble rol femenino de madre y trabajadora. Y es que, como demuestra el presente trabajo, cada vez son más las facilidades de acceso a la suspensión de la actividad laboral por maternidad y paternidad, y cada vez son más flexibles los requisitos para el disfrute de las prestaciones de la Seguridad Social, pero, sin embargo, aún queda mucho camino que recorrer para igualar las cargas familiares y laborales de ambos progenitores

    Self-Regulated Learning Microanalysis For The Study Of The Performance Of Clinical Examinations By Physiotherapy Students

    BackgroundStudents require feedback on their self-regulated learning (SRL) processes to improve the performance of clinical examinations. The key SRL processes used by students can be identified by SRL-micro-analysis but this method has not been previously applied to physiotherapy students. The aim of this pilot study was to evaluate the potential usefulness of SRL-microanalysis for the identification of key SRL processes used by physiotherapy students during the performance of a clinical examination skill. The objectives of the pilot study were: 1) to evaluate whether SRL-microanalysis could identify differences in the use of key SRL processes between successful and unsuccessful students; 2) to evaluate the reliability of SRL microanalysis ratings produced by different assessors.MethodsSRL-microanalysis was used with second year physiotherapy students of a Spanish university (n= 26) as they performed a goniometric task. The task required students to obtain a goniometric measurement of the shoulder joint of a peer. Two assessors evaluated student performance and conducted the SRL- microanalysis with all students. An analysis of inter-rater reliability was performed to evaluate the degree of agreement between assessors. ResultsThe SRL-microanalysis revealed differences in the use of key SRL processes between successful (n= 15: 57.0%) and unsuccessful performers (n= 11: 43.0%): The differences were particularly evident in strategic planning and self-monitoring skills. There was good inter-rater reliability for scoring of strategic planning (k=0.792), self-monitoring (k=0.946) and self-evaluation (k=0.846).ConclusionThe use of SRL microanalysis characterized the key SRL processes of physiotherapy students performing a clinical skill with reliability between the assessors. This pilot study supports the potential usefulness of SRL-microanalysis for the identification of key SRL processes in physiotherapy education. Therefore, this study paves the way to the development of a full study, with a larger number of students and more diverse clinical tasks, to evaluate the SRL processes in successful and unsuccessful students. <br/

    In vitro evaluation of composite resin fluorescence after natural aging

    Some composite resins contain luminophorous agents in order to reproduce tooth fluorescence. The objective of this study was to compare the fluorescence spectra emitted by composite resins with those of human enamel and dentin, and their emission behaviour after a 90-day natural aging period. Nine shades of the composite resins Z350XT/3M (XT), Opallis/FGM (OP) and Empress Direct/Ivoclar-Vivadent (ED) were analyzed. Five specimens (10.0 mm x 2.0mm) were fabricated for each shade. Enamel (5.0 mm x 0.30 mm) and dentin (5.0 mm x 1.0 mm) specimens were obtained from sound human third molars. Fluorescence spectra of human dentin and enamel as well as the composite specimens immediately after fabrication were measured at the excitation peaks of 375, 395 and 410 nm. To assess composite resin fluorescence intensity changes over time, measurements were conducted after 30, 60 and 90 days, at 395 nm. Differences in fluorescence intensity over time were analyzed with ANOVA and Tukey?s test (p<0.05). Fluorescence spectra baseline values of composites demonstrated no differences in intensity among the excitation peaks tested, with maximum emission found at the peak of 450 nm. Enamel and dentin spectra varied with different excitations, and the greater the excitation, the longer the wavelength in comparison to composite resins. After 90 days, XT presented an increase in fluorescence intensity, while OP and ED showed a reduction when compared with baseline values. Fluorescence intensity of composite resins changed during the period analyzed, with an emission behavior different from that of human enamel and dentin.     Neurodifferentiation and neuroprotection potential of mesenchymal stromal cell-derived secretome produced in different dynamic systems

    Parkinson’s disease (PD) is the second most common neurodegenerative disorder and is characterized by the degeneration of the dopamine (DA) neurons in the substantia nigra pars compacta, leading to a loss of DA in the basal ganglia. The presence of aggregates of alpha-synuclein (α-synuclein) is seen as the main contributor to the pathogenesis and progression of PD. Evidence suggests that the secretome of mesenchymal stromal cells (MSC) could be a potential cell-free therapy for PD. However, to accelerate the integration of this therapy in the clinical setting, there is still the need to develop a protocol for the large-scale production of secretome under good manufacturing practices (GMP) guidelines. Bioreactors have the capacity to produce large quantities of secretomes in a scalable manner, surpassing the limitations of planar static culture systems. However, few studies focused on the influence of the culture system used to expand MSC, on the secretome composition. In this work, we studied the capacity of the secretome produced by bone marrow-derived mesenchymal stromal cells (BMSC) expanded in a spinner flask (SP) and in a Vertical-Wheel™ bioreactor (VWBR) system, to induce neurodifferentiation of human neural progenitor cells (hNPCs) and to prevent dopaminergic neuron degeneration caused by the overexpression of α-synuclein in one Caenorhabditis elegans model of PD. Results showed that secretomes from both systems were able to induce neurodifferentiation, though the secretome produced in the SP system had a greater effect. Additionally, in the conditions of our study, only the secretome produced in SP had a neuroprotective potential. Lastly, the secretomes had different profiles regarding the presence and/or specific intensity of different molecules, namely, interleukin (IL)-6, IL-4, matrix metalloproteinase-2 (MMP2), and 3 (MMP3), tumor necrosis factor-beta (TNF-β), osteopontin, nerve growth factor beta (NGFβ), granulocyte colony-stimulating factor (GCSF), heparin-binding (HB) epithelial growth factor (EGF)-like growth factor (HB-EGF), and IL-13. Overall, our results suggest that the culture conditions might have influenced the secretory profiles of cultured cells and, consequently, the observed effects.
