    After preliminary research on documents of title, security interests, warehouses and warehousemen, priorities, bankruptcy, administrative law and statutory construction, the lawyer must isolate the following questions to be answered before he can give the banker practical advice about handling the details of the proposed transaction: (1) Can a warehouseman make a valid pledge of his own warehouse receipt for fungible goods contained in his warehouse? (2) Does the Uniform Commercial Code wholly circumscribe the relations of the parties to the transaction or are there state and federal laws with substantive bearing? (3) If there is a default in the loan and it results in insufficient goods in the warehouse to cover all receipts outstanding in the hands of depositors, holders and other lenders, who will share in remaining goods and in what proportion? (4) Is it necessary to verify the authority of the agent or employee who signs the warehouse receipts which are to be pledged? (5) How does the bank perfect its security interest in the receipts and goods? (6) What can be done by the bank to insure its preferred position as a creditor in both the collateral when released to the warehouseman for sale or shipment and the proceeds from the sale of that collateral? The first four questions, dealt with in Part I, involve close consideration of Article 7 of the Code and are ancillary to, but inseparable from, the last two questions. Those two questions involve the problem of maintaining and enforcing the bank\u27s security interest and will necessitate a shift in the frame of reference to Article 9 of the Code. Perfecting a security interest and establishing a system of control so that the banker is always assured of his position involve considerations not necessarily peculiar to warehouse receipts. Part II of this article consequently contains a discussion of secured transactions broader in scope than the pledge of specific documents

    Toughening mechanisms in elastomer-modified epoxies

    The toughening mechanisms of elastomer-modified epoxies are examined by scanning electron microscopy, transmission electron microscopy, and optical microscopy, DGEBA epoxies toughened by various levels of several types of carboxyl terminated copolymers of butadiene-acrylonitrile (CTBN) liquid rubber are studied. The materials are deformed in uniaxial tension and in three-point bending with an edge notch. Scanning electron microscopy of fracture surfaces indicate cavitation of the rubber particles to be a major deformation mechanism. Particle-particle interaction is also found. Optical microscopy of thin sections perpendicular to the fracture surface shows that the cavitated particles generate shear bands. The toughening effect is hypothesized to be due to cavitation, which relieves the triaxial tension at the crack tip, and shear band formation, which creates a large plastic zone.Peer Reviewedhttp://deepblue.lib.umich.edu/bitstream/2027.42/44686/1/10853_2005_Article_BF01114294.pd

    Reevaluation of the role of Pex1 and dynamin-related proteins in peroxisome membrane biogenesis

    A recent model for peroxisome biogenesis postulates that peroxisomes form de novo continuously in wild-type cells by heterotypic fusion of endoplasmic reticulum–derived vesicles containing distinct sets of peroxisomal membrane proteins. This model proposes a role in vesicle fusion for the Pex1/Pex6 complex, which has an established role in matrix protein import. The growth and division model proposes that peroxisomes derive from existing peroxisomes. We tested these models by reexamining the role of Pex1/Pex6 and dynamin-related proteins in peroxisome biogenesis. We found that induced depletion of Pex1 blocks the import of matrix proteins but does not affect membrane protein delivery to peroxisomes; markers for the previously reported distinct vesicles colocalize in pex1 and pex6 cells; peroxisomes undergo continued growth if ission is blocked. Our data are compatible with the established primary role of the Pex1/Pex6 complex in matrix protein import and show that peroxisomes in Saccharomyces cerevisiae multiply mainly by growth and division

    A Long Time Gone: Post-conflict Rural Property Restitution under Customary Law

    Mass displacement of people due to violence poses a unique set of challenges for property restitution when people return to their homes after a long absence. This is particularly evident in rural areas where the dominant form of land holding is customary tenure. Violence-induced displacement, unlike voluntary migration, challenges both customary and public legaladministrative structures. The lack of written documentation of customary holdings and the importance of the support of community leaders means that incorporating returnees back into a community can be easier for those who choose to return, while reclaiming property without physical return is nearly impossible. This article seeks to make three contributions: 1) to note the diversity of return processes after long displacements in terms of timing and demographics; 2) to demonstrate that the nature of the claims people can make on customary tenure systems is at odds with international legal norms on property restitution after displacement; and 3) to introduce a set of observations and questions on how conflict can change customary law. The article is based on fieldwork conducted in Uganda, Liberia and Timor-Leste, all countries with extended displacement

    Prevalence of Hypermobile Ehlers-Danlos Syndrome in Postural Orthostatic Tachycardia Syndrome

    Despite well-established clinical associations between Hypermobile Ehlers-Danlos syndrome (hEDS) and postural orthostatic tachycardia syndrome (POTS), the precise prevalence is unknown. We therefore evaluated for hEDS in 91 POTS participants using the 2017 hEDS diagnostic checklist, which has three major criteria: 1) generalized joint hypermobility (Beighton score), 2) systemic features, family history, and 3) absence of exclusion criteria. Overall, 28 out of 91 POTS participants (31%) met clinical criteria for hEDS. An additional 24% of participants had generalized joint hypermobility without meeting hEDS criteria. Identifying the prevalence of hEDS in POTS is important for understanding possible mechanisms connecting these two syndromes

    Association between respiratory tract diseases and secondhand smoke exposure among never smoking flight attendants: a cross-sectional survey

    <p>Abstract</p> <p>Background</p> <p>Little is known about long-term adverse health consequences experienced by flight attendants exposed to secondhand smoke (SHS) during the time smoking was allowed on airplanes. We undertook this study to evaluate the association between accumulated flight time in smoky airplane cabins and respiratory tract diseases in a cohort of never smoking flight attendants.</p> <p>Methods</p> <p>We conducted a mailed survey in a cohort of flight attendants. Of 15,000 mailed questionnaires, 2053 (14%) were completed and returned. We excluded respondents with a personal history of smoking (n = 748) and non smokers with a history of respiratory tract diseases before the age of 18 years (n = 298). The remaining 1007 respondents form the study sample.</p> <p>Results</p> <p>The overall study sample was predominantly white (86%) and female (89%), with a mean age of 54 years. Overall, 69.7% of the respondents were diagnosed with at least one respiratory tract disease. Among these respondents, 43.4% reported a diagnosis of sinusitis, 40.3% allergies, 30.8% bronchitis, 23.2% middle ear infections, 13.6% asthma, 13.4% hay fever, 12.5% pneumonia, and 2.0% chronic obstructive pulmonary disease. More hours in a smoky cabin were observed to be significantly associated with sinusitis (OR = 1.21; p = 0.024), middle ear infections (OR = 1.30; p = 0.006), and asthma (OR = 1.26; p = 0.042).</p> <p>Conclusion</p> <p>We observed a significant association between hours of smoky cabin exposure and self-reported reported sinusitis, middle ear infections, and asthma. Our findings suggest a dose-response between duration of SHS exposure and diseases of the respiratory tract. Our findings add additional evidence to the growing body of knowledge supporting the need for widespread implementation of clean indoor air policies to decrease the risk of adverse health consequences experienced by never smokers exposed to SHS.</p

    The first Keystone symposium on the role of microenvironment in tumor induction and progression attracted 274 delegates from 13 countries to Banff in the heart of the Canadian Rockies. The meeting was organized by Mina Bissell, Ronald DePinho and Luis Parada, and was held concurrently with the Keystone symposium on cancer and development, chaired by Matthew Scott and Roeland Nusse. The 30 oral presentations and over 130 posters provided an excellent forum for discussing emerging data in this rapidly advancing field
