    Evidenciação de dolo e má-fé na improbidade administrativa pela recomendação do Ministério Público

    O artigo pretende avaliar, por meio do método hipotético-dedutivo, a possibilidade de utilização da recomendação expedida pelo Ministério Público (art. 6º, XX, da Lei Complementar nº 75 de 1993, art. 23, VII, da Lei nº 8.625/93, Resolução nº 164 de 28 de março de 2017 do Conselho Nacional do Ministério Público) como alerta de dolo e má-fé nos atos de improbidade administrativas. Tendo por base o elevado número de absolvições nas ações de responsabilização por atos de improbidade fundamentadas na ausência de dolo e/ou má-fé do sujeito ativo, pretende-se construir, à luz do que já reconhecido pelos Tribunais Superiores acerca dos alertas emitidos pelos Tribunais de Contas (art. 59, §1º, da Lei Complementar nº 101, de 4 de maio de 2000), uma forma de evidenciar o elemento subjetivo dos agentes ímprobos na violação da probidade administrativa por meio da expedição de recomendações na tutela do patrimônio público. Conclui-se que a utilização de instrumentos preventivos no combate aos atos ímprobos, tais como a recomendação administrativa, fortalece uma atuação resolutiva no combate à corrupção e, ao mesmo tempo, robustece o arsenal probatório do demandante no âmbito da ação de responsabilização por ato de improbidade administrativa

    Coverage-based quality metric of mutation operators for test suite improvement

    The choice of mutation operators is a fundamental aspect in mutation testing to guide the tester to an effective test suite. Designing a set of mutation operators is subject to a trade-off between effectiveness and computational cost: a larger mutation population might uncover more faults, but will take longer to analyse. With the aim of resolving this trade-off, several authors have defined an assortment of metrics to determine the most valuable operators. In this work, we extend an existing quality metric by incorporating an additional source of data and coverage information and therefore investigate the extent to which mutants that are often covered but rarely killed can improve the evaluation of mutation operators for the refinement of the test suite. As a case study, we analyse C++ class-level operators based on the new coverage-based quality metric to assess whether the original metric is enhanced. The results when selecting the best-valued operators show that this metric has great potential to help the tester in finding effective mutation operators. In comparison with the metric from which it is derived, the use of coverage data allows to reduce the number of mutants but often loses fewer test cases and, in addition, retains those that seem hard to design

    Contribution of ULF Wave Activity to the Global Recovery of the Outer Radiation Belt During the Passage of a High-Speed Solar Wind Stream Observed in September 2014

    Energy coupling between the solar wind and the Earth's magnetosphere can affect the electron population in the outer radiation belt. However, the precise role of different internal and external mechanisms that leads to changes of the relativistic electron population is not entirely known. This paper describes how ultralow frequency (ULF) wave activity during the passage of Alfvénic solar wind streams contributes to the global recovery of the relativistic electron population in the outer radiation belt. To investigate the contribution of the ULF waves, we searched the Van Allen Probes data for a period in which we can clearly distinguish the enhancement of electron fluxes from the background. We found that the global recovery that started on 22 September 2014, which coincides with the corotating interaction region preceding a high-speed stream and the occurrence of persistent substorm activity, provides an excellent scenario to explore the contribution of ULF waves. To support our analyses, we employed ground- and space-based observational data and global magnetohydrodynamic simulations and calculated the ULF wave radial diffusion coefficients employing an empirical model. Observations show a gradual increase of electron fluxes in the outer radiation belt and a concomitant enhancement of ULF activity that spreads from higher to lower L-shells. Magnetohydrodynamic simulation results agree with observed ULF wave activity in the magnetotail, which leads to both fast and Alfvén modes in the magnetospheric nightside sector. The observations agree with the empirical model and are confirmed by phase space density calculations for this global recovery period

    Estimating how inflated or obscured effects of climate affect forecasted species distribution

    Climate is one of the main drivers of species distribution. However, as different environmental factors tend to co-vary, the effect of climate cannot be taken at face value, as it may be either inflated or obscured by other correlated factors. We used the favourability models of four species (Alytes dickhilleni, Vipera latasti, Aquila fasciata and Capra pyrenaica) inhabiting Spanish mountains as case studies to evaluate the relative contribution of climate in their forecasted favourability by using variation partitioning and weighting the effect of climate in relation to non-climatic factors. By calculating the pure effect of the climatic factor, the pure effects of non-climatic factors, the shared climatic effect and the proportion of the pure effect of the climatic factor in relation to its apparent effect (r), we assessed the apparent effect and the pure independent effect of climate. We then projected both types of effects when modelling the future favourability for each species and combination of AOGCM-SRES (two Atmosphere-Ocean General Circulation Models: CGCM2 and ECHAM4, and two Special Reports on Emission Scenarios (SRES): A2 and B2). The results show that the apparent effect of climate can be either inflated (overrated) or obscured (underrated) by other correlated factors. These differences were species-specific; the sum of favourable areas forecasted according to the pure climatic effect differed from that forecasted according to the apparent climatic effect by about 61% on average for one of the species analyzed, and by about 20% on average for each of the other species. The pure effect of future climate on species distributions can only be estimated by combining climate with other factors. Transferring the pure climatic effect and the apparent climatic effect to the future delimits the maximum and minimum favourable areas forecasted for each species in each climate change scenario.Ministerio de Ciencia e Innovación and FEDER (project CGL2009-11316/BOS).     Objetivou-se investigar o resultado do teste do reflexo vermelho, conhecido como teste do olhinho, e associar as impressões do reflexo com variáveis neonatais. Este é um estudo descritivo, quantitativo, realizado com 190 recém-nascidos de uma maternidade pública, dos quais 187 apresentaram resultado não alterado e três suspeitos. Observaram-se diferentes nuances de coloração do reflexo: em 50 (26,3%) a coloração do reflexo apresentou-se vermelha; 34 (17,9%) laranja-avermelhado; 92 (48,4%) alaranjado; 11 (5,8%) amarelo claro e três (1,6%) com manchas esbranquiçadas. Encontraram-se associações estatisticamente significantes entre o instrumento gradiente de cores e variáveis neonatais: peso (p=0,03), idade gestacional (p=0,019) e oxigenoterapia (p=0,024). Enfermeiros capacitados para prática e avaliação desse teste podem se tornar profissionais em potencial para a prevenção da cegueira infantil.The aim of this study was to investigate the results of the red reflex test and to associate these results with neonatal variables. This descriptive study was conducted with 190 newborns in a public maternity hospital. A total of 187 infants presented no alteration and three presented suspect results. Different shades of reflex color were observed: 50 (26.3%) presented red; 34 (17.9%) orange-red, 92 (48.4%) orange, 11 (5.8%) light yellow and three (1.6%) milky white spots. Statistically significant associations between the color gradient instrument and neonatal variables were found: weight (p=0.03), gestational age (p=0.019) and oxygen therapy (p=0.024). Nurses trained to practice and evaluate this test may become professionals in the potential for the prevention of childhood blindness.Se objetivó investigar el resultado de la prueba del reflejo rojo, conocido como prueba del ojito, y asociar las impresiones del reflejo con variables neonatales. Se trata de un estudio descriptivo, cuantitativo, realizado con 190 recién nacidos de una maternidad pública; de los cuales 187 presentaron resultados no alterados y tres sospechosos. Se observaron diferentes matices de coloración del reflejo: en 50 (26,3%) se presentó rojo; 34 (17,9%) naranja rojizo; 92 (48,4%) anaranjado; 11 (5,8%) amarillo claro y tres (1,6%) con manchas blanquecinas. Se encontraron asociaciones estadísticamente significativas entre el instrumento gradiente de colores y las variables neonatales: peso (p=0,03), edad de gestación (p=0,019) y oxigenoterapia (p=0,024).     Development of a biosensor for urea assay based on amidase inhibition, using an ion-selective electrode

    A biosensor for urea has been developed based on the observation that urea is a powerful active-site inhibitor of amidase, which catalyzes the hydrolysis of amides such as acetamide to produce ammonia and the corresponding organic acid. Cell-free extract from Pseudomonas aeruginosa was the source of amidase (acylamide hydrolase, EC 3.5.1.4) which was immobilized on a polyethersulfone membrane in the presence of glutaraldehyde; anion-selective electrode for ammonium ions was used for biosensor development. Analysis of variance was used for optimization of the biosensorresponse and showed that 30 mu L of cell-free extract containing 7.47 mg protein mL(-1), 2 mu L of glutaraldehyde (5%, v/v) and 10 mu L of gelatin (15%, w/v) exhibited the highest response. Optimization of other parameters showed that pH 7.2 and 30 min incubation time were optimum for incubation ofmembranes in urea. The biosensor exhibited a linear response in the range of 4.0-10.0 mu M urea, a detection limit of 2.0 mu M for urea, a response timeof 20 s, a sensitivity of 58.245 % per mu M urea and a storage stability of over 4 months. It was successfully used for quantification of urea in samples such as wine and milk; recovery experiments were carried out which revealed an average substrate recovery of 94.9%. The urea analogs hydroxyurea, methylurea and thiourea inhibited amidase activity by about 90%, 10% and 0%, respectively, compared with urea inhibition
