Sobre la noción de constitución en Hegel

In this work, Bobbio rebuilds the notion of constitution in Hegel’s work, and shows a way of conceiving it that does not match the constitutionalism as a theory of constitution that considers it a guarantee of individual freedom. Hegel understands the constitution, not as a law but as the foundation of the state unity against anarchy. This conception, which Bobbio considers that could be called “institutional”, is opposed to another way of understanding the constitution, which was typical of French and American constitutionalism or the British rule of law, where the constitution is based on a theory of freedom.En este trabajo, Bobbio reconstruye la noción de constitución en la obra de Hegel, y nos muestra un modo de concebirla que no coincide con el constitucionalismo en cuanto que teoría de la constitución como garantía de las libertades individuales. Hegel entiende la constitución, no como ley sino como fundamento de la unidad estatal frente a la anarquía. Esta concepción, que Bobbio considera que podría denominarse como “institucional”, se contrapone a otra forma de entender la constitución, que fue la típica del constitucionalismo francés y americano, o del rule of law británico, donde la constitución se fundamente en una teoría de la libertad

O texto aborda a distinção entre direita, centro-direita e extrema direita como variações político-ideológicas de um contiuum tal qual ocorre com esquerda, centro-esquerda e extrema esquerda, argumentando que cada subpólo político-ideológico não deve ser confundido com outro; que, portanto, a direita e a centro-direita não se confunde com a extrema-direita; que há semelhanças não teleológicas, mas instrumentais (o recurso à violência); entre extrema-direita e extrema-esquerda; que a direita reacionária define propriamente a extrema-direita; que a esquerda se define pela defesa do igualitarismo e a direita pela defesa do inigualitarismo; e destaca o principal teórico moderno do igualitarismo como Rousseau e o principal teórico moderno do inigualitarismo como Nietzsche

Die Zukunft der Demokratie

Da man mich gebeten hat, über die Zukunft der Demokratie zu referieren, also über ein ziemlich heimtückisches Thema, will ich mich zunächst mit Hilfe zweier Zitate verteidigen. Als Hegel in seinen Vorlesungen über die Philosophie der Geschichte an der Berliner Universitätvon einem Studenten gefragt wurde, ob die Vereinigten Staaten als das Land der Zukunft angesehen werden sollten, antwortete er ihm, sichtlich irritiert: »Amerika ist somit das Land der Zukunft ( ... ) und als ein Land der Zukunft geht es uns überhaupt hier nichts an; denn wir haben es nach der Seite der Geschichte mit dem zu tun, was gewesen ist und mit dem, was ist- in der Philosophie aber mit dem, was weder nur gewesen ist noch erst nur sein wird, sondern mit dem was ist und ewig ist - mit der Vernunft, und damit haben wir zur Genüge zu tun« (Hegel 1970: 114) In seiner berühmten Vorlesung, die Max Weber am Ende des Ersten Weltkriegs vor Studenten der Münchener Universität über die Wissenschaften als Beruf hielt, antwortete er seinen Zuhörern, die ihn eindringlich nach seiner Meinung über die Zukunft Deutschlands fragten: »der Prophet und der Demagoge (gehören) nicht auf das Katheder eines Hörsaals«.
