Directive 2020/1828 on representative actions for the protection of the collective interests of consumers: an overview

This paper provides an overview of the most relevant elements that the recently enacted Directive (EU) 2020/1828 of the European Parliament and of the Council of 25 November 2020 on representative actions for the protection of the collective interests of consumers introduces into European Union law and that the Member States must take into account when transposing the aforementioned Regulation. Specifically, this paper deals with the aspects related to legal standing in national and “cross-border” representative actions, the subjective scope of protection, the opt-in and opt-out mechanisms, the nature of the claim, the relationship between the representative action and other subsequent actions, the supervision of the financing of representative.actions by third parties, the possibility of settlement agreements and the information and publicityof representative action

The objectives of this essay are to address the relationship between public and private enforcement of the rights contained in the General Data Protection Regulation (GDPR) in terms of data protection representative actions; to make a general overview of Directive 2020/1828 and to analyze to what extent a systematic interpretation of the various rules of different legal disciplines that may be involved in representative actions is possible and desirable. Furthermore, this paper addresses the question whether the introduction in the GDPR of new heads of international jurisdiction is appropriate and how these relate to the classical heads of jurisdiction of Regulation 1215/2012 that may be applicable in the area of representative actions.  Los objetivos de este trabajo son abordar la relación entre la aplicación pública y privada de los derechos contenidos en el Reglamento General de Protección de Datos (RGPD) en lo que respecta a las acciones de representación de protección de datos; realizar una aproximación a la Directiva 2020/1828 y analizar hasta qué punto es posible y deseable una interpretación sistemática de las distintas normas pertenecientes a diferentes disciplinas jurídicas que pueden potencialmente aplicarse en materia de acciones de representación. Además, se estudia si la introducción en el RGPD de nuevos foros de competencia judicial internacional es adecuada y cómo se relacionan éstos con los foros del Reglamento 1215/2012 que podrían ser aplicables en el ámbito de las acciones de representación

Reconocimiento y ejecución internacional de los laudos arbitrales anulados: Un análisis crítico

La Convención de Nueva York de 1958, sobre el Reconocimiento y la Ejecución de las Sentencias Arbitrales Extranjeras establece, por un lado, los motivos por los que se puede impugnar un laudo arbitral y obtener, eventualmente, la anulación total o parcial del mismo y, por otro, los supuestos que podrán dar lugar a que se deniegue el reconocimiento y la ejecución de la sentencia arbitral. En este sentido, cabe resaltar la problemática que se suscita en torno a los laudos que han sido anulados o suspendidos por una autoridad competente de un Estado en que, o conforme a cuya ley, ha sido dictada dicha sentencia arbitral. A este respecto, conforme el tenor literal de la Convención, se concede cierto margen de discrecionalidad a los Estados para determinar si se procede o no a la ejecución de un laudo que previamente ha sido anulado. Este trabajo analizará en el contexto internacional en qué medida la anulación del laudo constituye un verdadero obstáculo para la satisfacción de los intereses de la parte vencedora en el arbitrajeThe New York Convention of 1958 on the Recognition and Enforcement of Foreign Arbitral Awards sets out, on the one hand, the reasons why an arbitration award may be totally or partially set aside and, on the other hand, it determines in which cases the recognition and enforcement of foreign arbitral awards may be refused. In this regard, it is worth noting the problems that may arise in relation to the awards that have been set aside or suspended by a competent authority of a State in which, or under the law, has been issued such arbitral award. The following article aims to value and rescue the memory of Valencians athletes who were forced into exile after the end of the Spanish Civil War. Thus by means of qualitative methodology we have recovered and documented the sporting career of five outstanding athletes, three of them of the FUE (Federación Universitaria Escolar): the doctor Manuel Usano, rugby player; José Catalina Llorens, physical education teacher and three times athletics champion of Spain; the indefatigable teacher Alejandra Soler; José Martínez Fort, European boxing champion and the doctor Enrique Georgakopulos, who has the first international Valencian rugby player. We also remember the upholsterer Enrique Cano, Valencia F.C goalkeeper; the pilotari Isidro Muñoz Sesé, el Perolero or cyclist Juan Bautista Llorens. We also evoke the figure of the runner Manuel Lora, worthy representative of what has been called internal exile. The fate of these exiled athletes were countries like France, Algeria or, especially, Mexico and Argentina that hosted a large contingent of them. Most exiled athletes had higher education studies and were not professionals in the field of sport (given the incipient professionalism of the time) and most of them never returned to their land. The majority belonged to left parties and its draws attention the large number of athletes who were exiled from Valencian Country compared to what happened in other regions of Spain perhaps because Valencia was the capital of the Republic, among other factors analyzed

¡Luces, cámara, a jugar! Videojuegos basados en películas y películas basadas en videojuegos: particularidades de la localización en diferentes escenarios

El cine llegó a nuestras vidas hace más de cien años, cuando en 1895 los hermanos Lumière proyectaron la primera película de la historia en la Ciudad de la Luz. Los videojuegos tardaron un poco más en hacer su aparición estelar. No fue hasta 1958 cuando el primer videojuego considerado como tal fue desarrollado en Estados Unidos por el físico William Higinbotham. Se trataba del conocido juego de Tennis for two, que básicamente consistía en un cúmulo de píxeles que formaban dos palitos y una bolita y cuyo mecanismo era muy similar al del tenis. No obstante, a día de hoy tras décadas y décadas de desarrollo tecnológico tanto las películas como los videojuegos no tienen nada que ver con lo que algún día ambos fueron. Si bien es cierto que los videojuegos comenzaron siendo algo más parecido a un juego de mesa debido a su sencillez, los desarrolladores no tardaron en fijarse en su hermano mayor el cine para buscar inspiración y un modelo a seguir. Y con esta tendencia que comenzó con los primeros videojuegos de las nuevas y más potentes generaciones (que comenzaron con PlayStation), a día de hoy vemos que los videojuegos cada vez más parecen unas películas interactivas que en muchas ocasiones no tienen nada que envidiar al cine. En este artículo hablaremos de las particularidades de la localización de videojuegos cuando estos están basados en películas de cine o viceversa, películas de cine basadas en videojuegos. Veremos cómo esta relación entre los dos productos audiovisuales afecta también a la parte de la traducción y cuáles son los escenarios más comunes

Reverse osmosis membrane composition, structure and performance modification by bisulphite, iron(III), bromide and chlorite exposure

Reverse osmosis (RO) membrane exposure to bisulphite, chlorite, bromide and iron(III) was assessed in terms of membrane composition, structure and performance. Membrane composition was determined by Rutherford backscattering spectrometry (RBS) and membrane performance was assessed by water and chloride permeation, using a modified version of the solution-diffusion model. Iron(III) dosage in presence of bisulphite led to an autooxidation of the latter, probably generating free radicals which damaged the membrane. It comprised a significant raise in chloride passage (chloride permeation coefficient increased 5.3–5.1 fold compared to the virgin membrane under the conditions studied) rapidly. No major differences in terms of water permeability and membrane composition were observed. Nevertheless, an increase in the size of the network pores, and a raise in the fraction of aggregate pores of the polyamide (PA) layer were identified, but no amide bond cleavage was observed. El presente estudio pretende caracterizar sociológicamente el consumidor recreativo de esteroides anabolizantes en tierras valencianas. La investigación se desarrolla así a partir de la aplicación de una metodología explícitamente cualitativa y la puesta en práctica de la técnica de la entrevista semiestructurada. El perfil sociológico del consumidor recreativo de esteroides anabolizantes se caracteriza por un bajo nivel de estudios, cierta inestabilidad laboral vinculada a menudo con el mundo del ocio nocturno y de la seguridad tanto privada como pública, problemas familiares, gusto por las discotecas y la playa, y frecuentes rupturas en sus relaciones de pareja, entre otros aspectos. Se concluye que el consumo de anabolizantes trasciende el ámbito deportivo y se aproxima a patrones de consumo relacionados con fines recreativos por lo que hay que continuar investigando los patrones de consumo recreativo de esteroides anabolizantes entre los jóvenes haciendo especial incidencia en determinadas poblaciones vulnerables para ampliar la información y los estudios sobre estas sustancias, como paso previo al diseño de intervenciones preventivas.The present study aims to provide a sociological overview of anabolic steroid use in Valencia (Spain).The research was developed by means of qualitative methodology based on a semi-structured interview. The sociological profile of the recreational anabolic steroid user includes low educational level, some employment instability related with public or private security and nightlife, frequent family problems, frequent splits in romantic relationships, and regular attendance at discotheques and the beach amongst other aspects. To sum up, in contexts that have been localized as areas of risk, such as gyms, medical practitioners’ offices, security companies, and other settings of socialization for the young, such as schools, clubs, sports clubs, universities, and sports and recreation centers. We concluded that anabolic steroids use has spread beyond the athletic environment, approaching use patterns related to recreational activities and other drugs of abuse and thus it is necessary to further investigate the patterns of recreational steroid use among young Valencians, paying special attention to certain vulnerable populations and occupations, to obtain more information and studies on these substances and to design preventive interventions
