The text analyzes how masturbation, carried out by adolescents and young people in a situation of deprivation of liberty, in a unit of the socio-educational system of Salvador, constitutes an important focus for thinking about the control of collective security, reiteration and subversion sexuality norms within the accommodation and other living spaces. Therefore, it is argued that masturbation can be used by a pedagogy that considers eroticism as a fundamental part of people's lives, without neglecting the existence of sexual practices in the context of deprivation of liberty and how they can establish bonds that go beyond the place of violence and generate solidarity, pleasure and learning. Beyond Sufficiency: G.A. Cohen's Community Constraint on Luck Egalitarianism
G. A. Cohen conceptualizes socialism as luck egalitarianism constrained by a community principle. The latter mitigates certain inequalities to achieve a shared common life. This article explores the plausibility of the community constraint on inequality in light of two related problems. First, if it is voluntary, it fails as a response to “the abandonment objection” to luck egalitarianism, as it would not guarantee imprudent people sufficient resources to avoid deprivation and to function as equal citizens in a democratic society. Contra Cohenite socialism, this appears unjust. Second, if it is instead enforced, coercive equalization beyond sufficiency-constrained luck egalitarianism, which is possibly necessary to achieve a shared common life, seems to require unjustified restrictions on liberty. I therefore argue that the constraint is most plausibly specified as requiring enforcement of sufficiency and only voluntary equalization thereafter. I also note, skeptically, why this constraint might be morally preferable to a purely sufficientarian alternative

Deprivation of Liberty in the Shadows of the Institution
ePDF and ePUB available Open Access under CC-BY-NC licence.
During the 20th century the locus of care shifted from large institutions into the community. However, this shift was not always accompanied by liberation from restrictive practices. In 2014 a UK Supreme Court ruling on the meaning of ‘deprivation of liberty’ resulted in large numbers of older and disabled people in care homes, supported living and family homes being re-categorized as ‘detained’.
Placing this ruling in its social, historical and global context, this book presents a socio-legal analysis of social care detention in the post-carceral era. Drawing from disability rights law and the meanings of ‘home’ and ‘institution’ it proposes solutions to the Cheshire West ruling’s paradoxical implications

In the liminal spaces of mental health law - what to do when section 136 expires?
The pressure on mental health services has not gone unremarked and is of widespread concern in England and Wales. This can have implications when a bed is being sought for a patient who has undergone a Mental Health Act assessment and is deemed to meet the criteria for being formally admitted to hospital. Once the 24 h period for assessment under section 136 of the Act has lapsed, the ongoing detention of the patient can lead to a legal grey area. Through a fictional example this paper examines the relevant case law and statute that may be used to continue the detention and explores the ethical problems that this may cause
The pervasive nature of heterodox economic spaces at a time of neoliberal crisis: towards a “postneoliberal” anarchist future
Re-reading the economic landscape of the western world as a largely non-capitalist landscape composed of economic plurality, this paper demonstrates how economic relations in contemporary western society are often embedded in non-commodified practices such as mutual aid, reciprocity, co-operation and inclusion. By highlighting how the long-overlooked lived practices in the contemporary world of production, consumption and exchange are heavily grounded in the very types and essences of non-capitalist economic relations that have long been proposed by anarchistic visions of employment and organization, this paper displays that such visions are far from utopian: they are embedded firmly in the present. Through focusing on the pervasive nature of heterodox economic spaces in the UK in particular, some ideas about how to develop an anarchist future of work and organization will be proposed. The outcome is to begin to engage in the demonstrative construction of a future based on mutualism and autonomous modes of organization and representation. © 2012 The Authors.
