    The Effectiveness of Law Relating to Educational Right of Children with Disabilities in Malaysia

    There are about 4.86 million persons with disabilities (PwDs) in Malaysia but only 1.58 per cent of them registered with the Malaysian Department of Social Welfare. The factor that must be taken into consideration to improve the quality of life of PwDs in Malaysia is their educational right since education is very important to someone’s life, including children with disabilities. This paper discusses the effectiveness of the law relating to the educational right of children with disabilities in Malaysia through current laws and policies. Suggestions are also provided to improve the effectiveness of laws relating to their educational right.     Dissensions internes du peuple n’zima kotoko et pratique de l’abissa a grand-bassam dans le sud de la Côte d’Ivoire

    Institution traditionnelle de cohésion sociale, l’Abissa représente pour la société N’Zima le socle des valeurs. Il marque le début du nouvel an consacré à la critique sociale, à la purification et au renforcement des liens communautaires et sociaux. Cependant, fort des dissensions internes qui apparaissent en 2018, une rupture dans sa pratique s’est observée. Le présent article se propose alors de comprendre comment les dissensions internes du peuple N’zima affectent la pratique de l’Abissa ainsi que les conséquences qui en découlent. Pour ce faire, l’entretien et l’observation ont été mobilisés comme techniques. L’enquête a mis en lumière l’intrusion des tiers dans la pratique de l’Abissa et les dissensions politiques comme facteurs de rupture. En effet, l’interventionnisme des pouvoirs dans la fixation des dates des festivités de l’Abissa sont interprétées par une frange ultra-conservatrice de la population comme un acte de désacralisation. A ce facteur, s’ajoute la position politique jugée partisane du souverain N’zima qui a exacerbé des tensions sociales et communautaires déjà assez fortes dans un contexte électoral cristallisé par la violence. Comme conséquences de cette situation confligène, la profanation de l’Abissa avec son corollaire la perturbation des énergies cosmiques en faveur du peuple, de même que la fragilisation des relations sociales se soldant par la récurrence des conflits intercommunautaires. La compréhension du phénomène s’est faite à partir la théorie des parties prenantes (J.D. Rendtoff, M. Bonnafous-Boucher, 2014) qui permet à partir de leur positionnement dans les actions d’identifier les acteurs en confrontation et les logiques de leurs actions

    Perkembangan ekonomi yang begitu cepat membuat masyarakat lebih kritis dalam berfikir untuk mengikuti perkembangan informasi ekonomi. Salah satu informasi ekonomi yang di gunakan adalah informasi keuangan, perusahaan adalah salah satu pihak yang menyediakan informasi keuangan tersebut yaitu berupa laporan keuangan yang digunakan bagi perusahaan bersangkutan untuk melaporkan keadaan dan kondisi keu angannya kepada pihak - pihak yang berkepentingan, terutama bagi pihak investor, kreditur, dan pihak manajemen perusahaan itu sendiri. Pihak perusahaan dituntut untuk menyajikan informasi laporan keuangan tersebut dengan jelas dan lengkap agar dapat digunaka n secara optimal oleh para pemakainya. Laporan keuangan menyajikan laporan keuangan perusahaan dan kinerja perusahaan dalam menghasilkan laba. Posisi keuangan perusahaan ditunjukan dalam laporan neraca. Dalam laporan neraca tersebut, kita dapat mengetahui kekayaan atau asset perusahaan yang dimiliki (sisi aktiva), dan di sisi pasiva dapat kita ketahui dari mana dana - dana untuk membiayai aktiva (dari modal sendiri atau hutang) tersebut kita peroleh sedangkan kinerja perusahaan dalam menghasilkan laba dapat k ita lihat dalam laporan laba rugi yang diterbitkan oleh perusahaan. Laporan keuangan yang diterbitkan oleh perusahaan memang memberikan informasi posisi dan kondisi keuangan perusahaan akan tetapi laporan tersebut perlu kita analisa lebih lanjut dengan ala t analisa keuangan yang ada untuk mendapatkan informasi yang lebih berguna dan lebih spesifik dalam menjelaskan posisi dan kondisi keuangan perusahaan. Adapun alat analisa yang dapat kita gunakan adalah rasio likuiditas, rasio solvabilitas, dan rasio renta bilitas. Analisa dengan rasio likuiditas akan memberikan kita informasi seberapa besar kemampuan perusahaan untuk memenuhi kewajiban jangka pendek yang harus segera dipenuhi. Kegunaan dari laporan keuangan itu sendiri yaitu data akuntansi yang diambil dari laporan laba rugi dan neraca dalam beberapa periode pencatatan. Kedua elemen tersebut berasal dari elemen laporan keuangan. Dengan adanya data tersebut dapat dianalisa melalui analisa rasio likuiditas, solvabilitas, dan rentabilitas. Analisa tersebut akan memberikan informasi tentang kinerja keuangan suatu perusahaan. PT KERETA API (Persero) merupakan salah satu Badan Usaha Milik Negara yang bergerak dalam bidang jasa angkutan penumpang, barang, dan usaha pendukung serta bisnis properti perkeretaapian. Ole h karena itu, PT KERETA API (Persero) dituntut untuk mampu menilai kondisi dan perkembangan perusahaan melalui analisis rasio laporan keuangan agar dapat mempertahankan keberadaaan perusahaan dan mampu meningkatkan pertumbuhan perusahaan ditengah pertumbuh an ekonomi yang semakin pesat dan persaingan usaha yang semakin ketat.     Legal Issues and Challenges in Managing Kuala Lumpur as a Tourism Destination: A case study of the Silang Street

    Kuala Lumpur is a historical city with heritage significance for tourism destination. However, the heritage significance of the city may be challenged by several issues. One of which is the number of immigrants who have manipulated business activities in the busy street which is known as Silang Street. The issue of immigrants at Silang Street is not only on the matter of licence to operate business, but also involved the immigration aspect.     ‘Best Interest of a Child’ Doctrine in Divorce Cases: Resorting to family mediation practice

    The best interest of the children in divorce cases may be best protected using the family mediation model. Although Malaysia has adopted the practice of mediation, it is not made compulsory for family disputes. This study aims at analyzing the effective interpretation of the 'best interest of a child' by replacing the adversarial platform with a family mediation platform. This study adopts a qualitative approach utilizing doctrinal study, content analysis, and interview. The outcome showed that there is a need to promote family mediation in Malaysia and this may assist the stakeholders in developing a harmonious platform for family disputes.     THE IMPACT OF BARIATRIC SURGERY ON INFLUENZA VACCINATION AND HOST METABOLISM

    Bariatric surgery is the most effective method for weight loss in obese individuals. This is significant because obesity is associated with several co-morbidities, many of which have metabolic dysfunction as an underlying cause. One major obesity-associated co-morbidity is a compromised response to the influenza vaccine. Several questions remain unanswered with regard to bariatric surgery’s impact on obesity associated co-morbidities. In our study, we analyzed the impact of bariatric surgery on vaccine induced serum antibody levels and circulating nutrient and metabolic hormone/peptide levels. Our findings suggest altered serum antibody levels are not the mechanism through which obesity compromises the response to influenza vaccination. Additionally, our findings highlight the remedial effect of bariatric surgery on host metabolism.Bachelor of Scienc

    A Legal Perspective on Academic Plagiarism of Research Writing in Malaysian Universities

    Plagiarism is acknowledged as dangerous, especially when academicians are accused of being engaged in malpractice in publishing their research papers. The increased amount of online access to research led to academic dishonesty and plagiarism rising in higher learning institutions. It is challenging to balance the academic and public interest demand with the intervention of globalisation in education, which introduces the hegemonic world ranking universities. Plagiarism has resulted in the unoriginality of research outputs which can affect the knowledge in the future. It also resulted in the academicians abusing their honour while writing research papers in whatever discipline of knowledge. This is a severe problem that needs a quick reform to the legal framework. From the qualitative data, the study believes that by having a proper provision relating to plagiarism in the legal framework, especially for the academicians, plagiarism cases in the educational institution may be reduced. The current existing policies and guidelines should be inserted directly into any relevant Act or rules and regulation to be imposed on the parties involved. The government needs to produce a fair and standard provision on plagiarism in dealing with the weaknesses or loopholes in the educational institution policies and regulations for academic integrity to be upheld

There should be a specific law relating to special education for children with disabilities that integrates the Medical and Social Models of Disability to cover their educational rights better. This paper examines the effectiveness of law relating to special education in Malaysia. It proposes integrating the Medical and Social Model of Disabilities in formulating a special education law for children with disabilities in Malaysia. This research employs a library-based approach by analysing the related laws through legislation, journal articles and textbooks.
